More from the article...

... The state's highest court overturned a December 2022 appeals court decision that said doctors couldn't be prosecuted under the pre-statehood abortion ban.

As a result, it will be illegal to perform an abortion in Arizona except when necessary to save the life of the mother. The ban goes into effect 14 days from the ruling.

Abortion had been legal in Arizona up to 15 weeks of pregnancy under the appeals court decision. Tuesday's ruling has been awaited since the state Supreme Court heard arguments four months ago. ...

There is already an effort in Arizona to get an reproductive rights law on the November ballet. Organizers say they already have enough signatures well ahead of the deadline. Democrats across the state now give a collective thank you to the court on this decision because they just guaranteed passage of that measure but may have just headed control of the state legislature to Dems as well.

Lake is a major liar. From the linked article:

"I oppose today's ruling, and I am calling on [Democratic Gov.] Katie Hobbs and the State Legislature to come up with an immediate common sense solution that Arizonans can support," Lake said in a statement.

But Lake said in 2022 that the near-total ban the ruling upholds is a "great law" and said it sets an example for other states.

Lake, Gallego say they oppose Arizona abortion decision
thehill.com

... Both Arizona Senate candidates came out against the state Supreme Court's decision Tuesday that upholds one of the strictest abortion bans in the country.

The court's decision put into place an 1864 law barring abortion access in all cases except to save the life of the mother. Rep. Ruben Gallego (D-Ariz.) and GOP candidate Kari Lake each said the ruling should be overturned.

Lake, who has in the past called the 1864 law "great" and showed support for strict abortion bans, said the Legislature should instead decide on abortion rights legislation. The comments come just a day after former President Trump said the issue should be left to states. ...

Gallego, meanwhile, doubled down on his stance in favor of abortion rights.

"Today's ruling is devastating for Arizona women and their families," he said. "This is not what Arizonans want."

"This decision rips away the right for women to make their own healthcare decisions with their doctors," he continued. "I promise you that we will fight this together. And with your help, we will win."

Gallego also shared Lake's previous comments on the 1864 bill hours after the ruling, using them as an attack on her record.

"I won't let Kari Lake distort the record," he wrote on the social platform X. "She called this law a great law' -- even though it will ban nearly all abortions, including in cases of rape or ------." ...

Lake is parroting the line panicked GOPers are hanging onto. For example:

Rep. David Schweikert (R-Ariz.), the most vulnerable Republican in the state, came out against the Arizona Supreme Court's ruling upholding one of the most strict abortion laws in the country on Tuesday.

Schweikert denounced the court's decision, joining other Arizona Republicans in calling the move a step too far and pushing for the state legislature to pass new abortion rights legislation.

And you say there's an abortion constitutional amendment on Arizona's November ballot? Jayzus, it's messy but schadenfreude has a lot to recommend it.

My belief is that if women had the right to vote in 1787, abortion would be included in the 1st Amendment.

Kind of proof that women are second class citizens today.

State Attorney General Kris Mayes, a Democrat like Hobbs, promised that no doctor or woman would be prosecuted under the abortion law.

While I agree with the sentiment, it's good to know we can just prosecute which laws we want to and dont want to..

The Arizona SC didn't have to rule that the 160 year old law goes into effect in 14 days. To give the citizens of Arizona a chance to vote, they could have held off ruling or ruled that the law would go into effect after November's election if voters so decided. But, no, they had to reinstate a law that was created about 50 years before Arizona became a state and before women were allowed to vote. So I repeat:

"If I'm understanding it correctly it's a legal default in the wake of Dobbs and if that is correct I'm surprised it took this long."

The Arizona SC has 7 Republican judges, but only 6 of them ruled because one guy recused himself. According to the 2 dissenting judges, it didn't have to rule this way:

Vice Chief Justice Ann Scott Timmer, writing for the dissenters, took the same approach as the appeals court, finding that the two laws could exist harmoniously, with the 15-week ban acting as an exception to 1864's near-total restrictions. In that scheme, the 15-week ban would control abortions up to that point, and only then would the 1864 ban kick in.

A problem re: the Arizona abortion decision is that it is resurrection of a 19th century zombie law that nobody alive voted for and no person today would expect to get enforced. It should be a serious due process and political process violation to revive a law that was dead.

However, it does give Democrats a cultural issue to campaign on

Right after you said it was a legal default.

LOL.

We have literal insane people on the floor of the Arizona state house babbling nonsense, religious nonsense.

That is like a schizophrenic on a street corner yelling at the sky type ----

And these people are deciding the fate of women in America

That is some scary ----

Yeah leave it up to the voters. Fortunately AZ elected a sane Secretary of State

While I agree with the sentiment, it's good to know we can just prosecute which laws we want to and dont want to..

Wingnut sheriffs have been doing this for decades.

Funny, Republicans don't want to be controlled.

But that's exactly what they are doing to women here.

This is a loser for the GOP and they know it, hence their reaction..............(until they have power).

"Let's talk about AZ, 1864, and Biden...."

I thought Biden was in PA in 1864.

I thought Biden was in PA in 1864.

I think it would be funny if Biden claims (tongue-in-cheek) that he personally tried to talk Arizonan men out of passing this law back in 1864 but they wouldn't listen to him.

Just a reminder that Arizona didn't actually join the Union until 1912.

#83 | Posted by truthhurts at 2024-04-10 12:26 PM | Reply

Since they are enforcing a draconian law from 1864 they should have no problem enforcing the 1866 14th amendment of the U S Constitution.

Section 3.
No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.

Right?

Some of those "babies" are already dead and yet you choose to support the State in forcing the mothers to give birth to dead babies. YOU support that, sicko.

When was the last time you gave birth to a dead baby?

Oh no's...you dumb as fnkc.

If you love babies, then you must be very upset about the Dobbs decision because the actual effects of the Dobbs decision are as follows:

1. An increase in the rate of abortions (you know MORE abortions than would otherwise have been performed)
2. Pregnancy is now less safe
3. Women are choosing to not get pregnant
4. It is harder to get an abortion
So, in summary, since Dobbs, more abortions are occurring though it is more difficult to get an abortion, pregnancy has become more dangerous and fewer women are getting pregnant.

Lindsey Graham disagrees with Trump on states having the final say on abortion.

AZ rules, then Graham agrees w/ Trump. Graham says AZ needs to fix this.

WTF are people doing trusting what the GOP says?

Truth ...

I'll need citations showing actual statistics that back those claims. If you can't provide them then you're full of it.

Specifically referring to Number 1 bc you contradict yourself with Number 3. If Number 3 is true then it goes directly against 1 and Vice versa.

There is nothing contradictory at all. Women are scared of getting pregnant and having to deal with health problems and not be able to get an abortion

So they are more proactive in getting those abortions AND many women are choosing not to get pregnant. They're not the same people obviously

Democrats a cultural issue to campaign on that might gain traction if they take a moderate position.

POSTED BY BELLRINGER

Might gain traction?

Lol

Democrats don't have to actually do anything. Republicans are snatching defeat from the jaws of victory with their draconian laws against against women.

The polls are already turning in Biden's favor and there are months (and several criminal trials) to go before the elections.

I bet women won't need to be told what to do to protect themselves from Trumpy Republicans come November.

The dude who wrote this 1864 law was a pedophile:Meet the pursuer of nubile young females' who helped pass Arizona's 1864 abortion law

The Arizona Supreme Court has decided the law is still relevant. So let's talk about the guy who led the body that passed it.
