I've known few people who left companies to start their own businesses and consequently got sued but won in court costing their former employers thousands. Non-compete clauses should be illegal unless the employer is offering a contract over years of employment. Requiring employees to sign non-compete clauses without any increase in pay or guaranteed job security over a period of time is requiring an employee to sign a contract without consideration and thus they should be illegal.

I remember the first accounting firm I worked at right out of college had us all come into the conference room and sign non-compete agreements. I told the partner that demanded them be signed "You can't block me from working in my chosen profession for five years without a payment of compensation in the non-compete agreement and I am not signing any legal document without my lawyer reviewing the document."

I went back to my desk and updated my resume and found a new job.

The free marketeer's are always telling us that competition is good for business. I see no problem with this decision.

There is still ample protection for trade secrets so they aren't necessary.

The real problem is that even IF they are unenforceable, companies use them to scare workers away from seeking other employment and getting raises. The employee can't spend $20,000 to fight the non-compete in Court and potentially wait months or years in court before starting the new job.

The question will be how the Supreme Court handles it. (Not really a question with this Supreme Court)

noncompete agreements are bogus anyway. If a company wants to sue you they will, it happened to me 20 years ago.

quit a job after 15 years, I didn't have a noncompete but that didn't stop the company from sueing me for 3 counts at 2M each. bogus acusations like sharing company secrets, etc... it all ended when I agreed to sign an agreement that I would not buy from certain vendors, blocking me out of the business. I didn't care because I had moved on to another field

Although I understand why they are in place, it is unnecessary given the power that companies have. In sales, non-competes are vital to ensure a person doesn't take all their customers with them. Logically, that makes sense. Problem is, companies have way too much power as it is in situations where the employee just has to accept the fact that it is what it is. Well, guess what, getting rid of non-competes could mean you lose business, well...it is what it is. If you are scared someone will take business from you, treat them better, pay them more, show them you are serious about keeping them.

Now, the one thing non-competes will always be useful for are trade secrets and they need to keep something in there about that. Leaving one company and going to another and giving them information about the other company isn't fair competition. And some might say well anything private is already protected. Problem is, it's not. Anyone with an ounce of ingenuity can give up secrets without anyone knowing they are the ones who did it, or even doing it in a way that doesn't give up the secrets but gives up enough to where the secrets are easy to expose.

That's actually non-solicitation. Those are still valid.

Anyone with an ounce of ingenuity can give up secrets without anyone knowing they are the ones who did it, or even doing it in a way that doesn't give up the secrets but gives up enough to where the secrets are easy to expose.

They can do that with a Non-Compete.

Just pay them for the secrets without hiring them. Ta-da.
