A federal appeals court shot down claims Monday that New Jersey residents' refusal to wear face masks at school board meetings during the COVID-19 outbreak constituted protected speech under the First Amendment.

"Still, the court found that refusing to wear a mask during a public health emergency didn't amount to free speech protected by the Constitution.

"A question shadowing suits such as these is whether there is a First Amendment right to refuse to wear a protective mask as required by valid health and safety orders put in place during a recognized public health emergency. Like all courts to address this issue, we conclude there is not," the court said.

The court added:

"Skeptics are free to " and did " voice their opposition through multiple means, but disobeying a masking requirement is not one of them.

One could not, for example, refuse to pay taxes to express the belief that taxes are theft.' Nor could one refuse to wear a motorcycle helmet as a symbolic protest against a state law requiring them."

.

Next up, not putting your child in a car seat is a free speech protest.

Federal Appeals Court: Not Wearing a Mask Is Not Free Speech

How about not wearing underwear? Asking for a friend.

So exposing your neighbor, co-worker or stranger on the street to a potentially lethal virus or bacteria is not "free speech"? LOL. And what type of STUPID person actually disagrees with this? Other than Trumpers that is.

If I remember the case correctly they were not denied the opportunity to participate. Many meetings around here could be joined by video and, gasp, I didn't have to wear a mask. For several months that was the only public access.

The problem isn't the mandate. The problem is nobody has any criteria on what constitutes a healthcare emergency. Basically, what the court is saying is that any POTUS can claim there is a healthcare emergency and force people to do things they don't want to do. Now, right now to most of you, you will read that and not see a problem with it. But just remember, this gives ANY POTUS that power.

I know, as Liberals, you won't care and you will regard this as trivial and agree with everything the courts conclude that matches your ideology. But, as I've seen countless times in my 5 decades, what one party abuses the other party will also abuse. So it will happen. And all of you will whine and cry like babies when it does. And completely ignore that you supported this power being given to our leaders.

In this case, the criteria about what constitutes a healthcare emergency isn't in question by any serious person.

Over 110,000,000 million cases in the US. Over 1,000,000 deaths. Tens of thousands of cases and thousands of deaths every day at its peak.

Anybody with half a brain would see that as a health emergency. Were you on a deserted island from 2020 - 2022?

Health organizations have the criteria on what constitutes a healthcare emergency. WHO? CDC? The president makes decisions based on the findings of health organizations.

BADTAKE seems to be saying he didn't like what PO1135809 did as POTUS, and that liberals must be upset that a future not-PO1135809 president from "their side" would have that same authority?
