Drudge Retort: The Other Side of the News

This week, Attorney General William Barr joined Vice President Mike Pence in condemning the harrowing recent rise of "nationwide injunctions" as anti-constitutional judicial power grabs that disturb the carefully calibrated separation of powers system that the Constitution's Framers so sagaciously devised.

It really is happening. But the SCOTUS can handle this - I don't need my weapons. Or a goat. Strapped with explosives. Or a car antennae.

I can't believe we just walked through a coup attempt and a possible Second Civil War....

I've never seen anything like this in my long and lucky life.

'Constitution? What's that?'

""[f]or most of our history, courts understood judicial power as fundamentall[y] the power to render judgments in individual cases.""

This liar pretends that Marvury vs. Madison never happened. He is a hired gun, not worthy to be AG and the Republicans who approved him to be AG should be, but are incapable of being, ashamed.

Barr is angling for power.

Trump needs to watch out for something he's never heard of before, the Praetorian Guard.

We are fifty states.

#7 | Posted by visitor_ at 2019-05-26 10:11 AM | Reply

We are fifty states with a federal Constitution which is the law of the nation. If a state passes a law that violates the Constitution the SC can rightly override that state law. You don't like it...move to another country. The Civil War confirmed once and for all the power of the federal government to overrule states. You want to fight it over again, you'll lose again.

BTW, I think you will find it difficult to find a nation that allows anyone to challenge the power of their national government.

Maybe you didn't understand, this is about district judges ruling on nationwide injunctions.

Saint Zed has been fantasizing for 2 years about a coup. He used to fantasize about Trump's execution for treason but I think he was told to shut up.

No, that didn't happen.

For the record, again, traitors are by tradition hanged. Do I think Trump is a traitor? Yep.

Donald Trump and his minions are merely re-enacting scenes from "The Twelve Caesars". Old story, with just one or two historical outcomes.

"Maybe you didn't understand, this is about district judges ruling on nationwide injunctions."

Maybe you didn't understand that an injunction is not an overturn of a state law, it is just putting that state law on hold until a higher court can decide if it is constitutional.
Scenario: Mississippi Legislature decides to reestablish slavery and all former slaves are returned to their former owners, so a district judge places an injunction to prevent that from happening until a higher court decides the issue.
Same principle applies now in Mississippi, a woman is raped, becomes pregnant and the State Legislature enacts an evil anti-abortion bill which would prevent her from having an abortion which is 100% contrary to the decided law of the United States, so a court places an injunction of the enforcement of that law so that she is not prevented from having the abortion because, under federal law as decided by the SC, Roe v Wade is the law of the nation. Your position is that the law of the nation should be set aside whenever a state passes a law contrary to it. Your view does not respect the supremacy of federal law over state law. We are a nation and we do respect that the states have certain rights as long as they do not violate the Constitution or the edicts of federal law or the Supreme Court. When they do, the are struck down by the courts as well they should be because many of our states have enacted laws that reduce the rights of American citizens.

Which is a ridiculously unrealistic scenario.

But that won't stop you from labelling any federal law that you disagree with as being "slavery".

Let's say California passes a law to fine any company located in a state that doesn't ban plastic straws.

"Which is a ridiculously unrealistic scenario. "

Perhaps today but not in 1866. You conveniently ignore the latter point concerning ridiculous and horrible abortion laws which are currently being passed in several states despite the SC's "decided law" (as per Kavanaugh) which they hope to overturn so that women's lives can be ruled by uptight, right wing Christian terrorists. And that is not an exaggeration, they are terrorists just as much as the Taliban are. We should fight them with every ounce of our strength for as long as it takes to defeat them.

"Let's say California passes a law to fine any company located in a state that doesn't ban plastic straws."

OK, what harm does that do to you or anyone else. Now you want to compare that to a woman who was raped not being able to abort that pregnancy. You are clearly an idiot.
The ban on plastic straws actually serves a reasonable purpose. Actually a necessary purpose. Why can't you use a paper straw to drink your Big Gulp?

#22 | Posted by danni at 2019-05-26 11:42 AM | Reply

Oh wait, I know why you couldn't use a paper straw. It would limit your freedom....right???? Freedom! "They may take our lives but they will never take away our FREEDOM!!!!!"
When we went to see the movie we laughed out loud when that line was spoken.

#24 | Posted by Danforth at 2019-05-26 11:55 AM | Reply

Now you're arguing against injunctions.

#25 | Posted by visitor_ at 2019-05-26 01:01 PM | Reply

One judge can rightly stop a President's decision TEMPORARILY, when they believe the President's policy is unconstitutional. But it never ends there. Multiple Judges in Appeals Court will always review the case if is appealed and SCOTUS has intervened at least once in those types of decisions even though the appeals case was dropped and saddled the country with Citizens United.

We live under a President who has behaved like a dictator his entire business life and carried those behaviors into the White House. The orange sloth has openly praised dictators in China, North Korea, the Philippines, Russia, and Saudi Arabia and openly wishes to have similar powers.

Fortunately, some checks and balances remain in place. As usual, Barr and Trump are misscharacterizing the situation.
