The Trump administration says the goal is simple: to punish people trying to enter the country illegally, and that means immediately arresting adults and placing them in detention without their children.But the result is a brand of justice that seems un-American to many, unrecognizable in its deliberate cruelty. The zero tolerance regime has earned a rebuke from the United Nations human rights office as "unlawful'' and inflicting "child rights violations.'' More than 650 children were separated from their parents at the border in the first two weeks after the policy was officially adopted in early May, according to Senate testimony of Department of Homeland Security officials.

Forcing the President to enforce a law he believes to be unconstitutional would be to force the President to act in a way that he believes unconstitutionally contravenes his Oath of Office to uphold the Constitution, which is the supreme law of the land.

Wrong. This is a Trump/sessions policy.

On May 7, Attorney General Jeff Sessions said in a speech that "If you're smuggling a child, then we're going to prosecute you, and that child will be separated from you, probably, as required by law. If you don't want your child separated, then don't bring them across the border illegally. It's not our fault that somebody does that."

The Law does NOT require it.

Lee Gelernt of the ACLU Immigrants' Rights Project said Tuesday that "Children are begging and screaming not to be separated from their parents, as they're hauled off to different cities. It's a harrowing situation, one that the president himself called horrible. No law even remotely requires the separation of children, and we filed a recent lawsuit arguing, in fact, that the Constitution prohibits this policy."

The original argument was that it was inhumane to simply separate a child from a parent who is arrested and charged with a crime. In both cases, you're not going to put the child in adult jail just because they were passengers.

The Borders weren't open before. Separating them started in 2018.

Simply not true. I posted at least two links above which gave examples where they were prior to 2016. You're seeing more separations now because existing laws are being enforced more vigorously and more people are actually being prosecuted.

Those detentions were "newsworthy" because of the rare act of separation.

Since then, separation is the policy, not a rare exceptional event, owing entirely to Trump's new policy.

Notice how the same people who argued the Constitutional authority granted to the Executive over immigration policy to ban Muslims are here arguing separation doesn't flow from that same Constitutional authority, but rather it's merely upholding as requires by law an Obama era policy that Trump is either unwilling or unable to change.
