Jonathan Turley: The image of FBI agents carting away computers and records of Michael Cohen, President Trump's personal lawyer, is just the latest cringeworthy moment from the life and times of the attorney. Few would be surprised by Cohen being criminally charged. However, Cohen's greatest danger to Trump may be not as a defendant but as bait. ... What must be endlessly frustrating to Trump's legal team in Washington is that this controversy continues to be driven by the likes of Cohen. All of the lawyers around Trump have struggled mightily to control the damage caused by Cohen. Now, Cohen may force the next steps and put Trump at even greater peril. To make matters worse, Trump would fall into this particular trap with a lawyer who may have tossed away any protections for his client.

So why is Trump so scared that he needs to fire Mueller for indicting people who actually broke the law?

I have a hunch you said the same thing during the Nixon-Whitewater investigation. That took over 2 years. We have lots of time left, Fishy. More people are going to jail... And your stupid posts aren't going to save them.

"We've been advised the president certainly has the power to make that decision," White House press secretary Sarah Sanders said when asked whether Trump could fire Mueller, who answers not to the White House but to deputy attorney general Rod Rosenstein.

Trump began the day tweeting in defense of Cohen, a longtime Trump Organization associate. "A TOTAL WITCH HUNT!!!" Trump wrote on Twitter Tuesday morning. He also added: "Attorney-client privilege is dead!"

A GOP operative close to the White House told POLITICO: "The all caps tweet, that's the primal scream. That's the war cry."

"He's losing his ----," the operative added. "We're at a different level now."

Amid the furor, the White House announced earlier Tuesday that Trump would skip an upcoming trip to Latin America and instead stay in Washington.

Trump's decision to scrap this weekend's long-planned travel to the Summit of the Americas in Lima, Peru, will leave the president largely alone in the White House with little on his schedule, giving him time to stew and watch cable news."

"Attorney-client privilege is dead!"

While the Crime-Fraud exception to the privilege that Trump holds could allow Cohen to cut a deal with Mueller regardless of whether an argument could be made that Trump has not waived the privilege, the only way I see that coming into play is if Mueller gets Cohen to plea to a campaign finance plea and not a plea for his involvement in the Manafort mess, which is supposedly what Mueller based his subpoena request on. If Cohen gets charged with the latter offense, then no Federal Court will agree that Trump's privilege is waived.

Five early morning thoughts on the situation: /1/

First, this warrant did not issue just on probable cause. There is no way--no sliver of a chance of a way--that the SDNY went to a magistrate for a search warrant *against the lawyer for the President of the United States* without much more than probable cause. /2/

You can thus assume there was A LOT of evidence in that warrant application. You can also assume the magistrate in question reviewed it carefully. In other words, you can assume that the evidence more than amply supports the action taken yesterday. /3/

Second, all of that evidence is the evidence prosecutors had before they collected anything yesterday. In other words, you can assume that Michael Cohen has a very serious legal problem on his hands. /4/

Third, it is not good for a client when his lawyer is the subject of a search warrant involving matters concerning the services that lawyer provided to him. /5/

Fourth, really not good. /6/

Fifth, the President's angry comments to the press yesterday and tweets today suggest that he perceives the ring as closing around him. I don't do predictions but I do think it's interesting that he perceives it that way. /7/

That's all I got.

Ok. Since we are playing mind games. Suppose Trump does fire Mueller and Mueller says he isn't leaving because only Rosenstein can fire him! Does Trump send over a goon squad to forcibly kick him and everyone on his team out of the office, change the locks, suspend accounts, etc.? Who would be in that goon squad: FBI? Wouldn't Trump need the cooperation of the director of the FBI director to get the FBI involved? Suppose the FBI director says no? The FBI director, like Mueller could easily claim that Trump doesn't have the authority to directly fire Mueller.

And, don't you think that Mueller has already thought through this scenario and made appropriate plans? I suspect that there is a daily off site backup of all files as well as relationships with state AGs that will persist if Mueller is fired.

I suspect that because of the ambiguity surrounding Trump's authority to fire the special counsel, Trump could have some serious difficulty enforcing the firing. Resolving this ambiguity might give Mueller enough time to issue a preliminary report immortalizing what he has uncovered and to dust off any pending indictments that have been reported to exist but have been temporarily shelved.

My guess that Mueller already has a preliminary report and is using it as a dead-man switch.

My guess is that Trump will eventually do anything in a desperate attempt just to buy time.

Related to the above and your post, word has it Trump is already muttering about firing his new FBI Director.
