FBI investigators in New York raided the office of Michael Cohen, President Trump's longtime personal lawyer on Monday, a significant step given the amount and range of work he has handled for Trump. The New York Times first reported that federal prosecutors issued the search warrant after a referral from Justice Department special counsel Robert Mueller, who is investigating Russian interference in the 2016 presidential election and any potential ties between the Trump campaign and Russia.

Did he not notice the probable cause connection to this raid? Most likely not considering he also ignored the fact the warrant was awarded by a federal judge and obtained by a U.S. Attorney appointed by Trump himself.

There's no logical reason to fire Mueller or Rosenstein at this point. Mueller goes by the book and the DOJ has already settled upon the notion that the sitting POTUS cannot be indicted, so Mueller is only going for a recommendation to the House to bring about impeachment proceedings, if anything. We all know, including Trump, that the Repubs will not impeach Trump and even if the Dems Blue Wave takes both the House and Senate, you need two-thirds of the senate to convict; small chance at impeachment and almost zero chance to convict. Trump should know this, which would explain why he hasn't risked firing either Mueller or Rosenstein yet and most likely will not do so at all. And even if he does, he increases the risk of impeachment, but not by much, while not increasing his risk of conviction at all.

If the past is prologue Humpy will indeed try and fire Mueller at some point. Which will initiate a constitutional crisis. And Humpy leads by bouncing from one crisis to another. It's kind of his reality tv thing.

But, it doesn't matter. This Presidency is tainted and will forever be tainted in the history books. The best thing that could happen to Trump is he lets the investigation complete and that Mueller finds he has done nothing wrong.

It was already shown that Pres Trump prefers Mr Cohen to bear the heat. For example, when Pres Trump told reporters last week that Mr Cohen had not told Pres Trump about the payments made to Ms Daniels.

In saying that, Pres Trump diverted possible guilt from himself, and pushed it to Mr Cohen in the form of possible ethical issues, e.g., not informing Pres Trump about things he was doing on Pres Trump's behalf.

There may not be any exact words to that effect. Lawyers like Cohen are usually too smart to create an evidence trail when they're trying to extricate their client from involvement. It's more likely that Cohen said something like "I've taken care of it" if he made any admission to Trump at all.

BTW, does Trump's personal attorney remind anybody else of John Gotti's attorney back in the day . . . when the attorney became so close to his client that he became part of the criminal enterprise.

I don't agree. Although Pence is just as likely to get drunk with power, I don't think he has as much to hide as Trump. If he does, we'll soon be back to square one in the impeachment process with a better House of Representatives. That is if he hasn't learned any lesson whatsoever from Trump's train wreck.

Also, we don't know if Mueller's probe also involves Pence in some manner that would cause him to follow Trump out the door. The media has been a sphinx on this subject but we never know what surprises Mueller has in store for us.

We know that Manafort picked Pence and that Pence led the transition once Christie was ousted, so Pence may not be as squeaky clean as everyone thinks. We'll see.

Michael Cohen Has a Big Problem

It takes strong evidence to execute a search warrant against an attorney representing a subject in a federal investigation, let alone the president's personal counsel.

"Doing a search warrant rather than a subpoena suggests the investigators thought Cohen, if given a subpoena, would possibly destroy evidence or withhold key evidence, particularly if it were incriminating," Clinton Watts, a former FBI agent and a senior fellow at the Foreign Policy Research Institute, said.

Under normal circumstances, obtaining a search warrant on an attorney for the subject of a federal investigation is an incredibly aggressive move. When the attorney's client is the president of the United States, the stakes couldn't possibly get any higher.

There is also something known as the crime-fraud exception to attorney-client privilege.

"When the communications between an attorney and client are in furtherance of criminal activity, it's viewed as an exception to attorney-client privilege," Barrett said.

No, this is federal investigation run out of the SDNY office. (SDNY=U.S. District Court, Southern District of New York) For this to be a NY state investigation, it would have to be run out of AG Eric Schneiderman's office.

Great insight about Cohen from Adam Davidson, staff writer at New Yorker:

"Michael Cohen is the most important non-Trump in the Trump business world.
He oversaw nearly all the foreign deals as the Trump Org shifted its focus to sketchy third-tier overseas oligarchs.
He was not part of the Trump Org legal team in any real sense. Trump Org lawyers either set up contracts for deals others had brought or they handled litigation.
Cohen did neither. He was a deal maker. The only non-Trump deal maker doing all those international deals.

He, Ivanka, and Don, Jr., were the entire global development team at a time when the company was exploring dozens of deals all over the world.

If he were to flip, it would be Ivanka and Don, Jr. who should be most worried.

We know, of course, that the Trump Org did business with corrupt politicians, sanctions-violators, money launderers, etc. The only open question is how much they knew about their partners' activity.
Cohen knows how much they knew. He knows what he told them.

He is also the most obvious link between Trump and Russia. He oversaw the deal in Georgia which was, explicitly, a first attempt at a former Soviet deal with the goal of a ring of Trump properties all over the CIS.
Cohen flew to Kazakhstan and negotiated the failed deal there with Timur Kulibayev, a close ally of Putin's.
Cohen then worked on the Trump Moscow deal in 2015/2016.
In none of these deals was he acting like a traditional lawyer--simply advising, writing contracts, etc. He was in the country, meeting with the partners, structuring the deal, going back to NY and explaining the deal to the big boss and his kids.

Other than the President, nobody knows as much as Cohen. (And Cohen does seem to have a good memory).
It was stunning that Trump made Cohen his sole personal attorney post-election. Cohen left the Trump Org to form a firm with one client: the President.

But Cohen had never acted as a regular attorney for Trump. He had always been the fixer/deal-maker. So, the move to his new private firm seems solely designed to provide attorney-client privilege. To get his documents out of the Trump Org and into a private office.

This moment is what Trump has been terrified of and trying to avoid since long before Comey was fired and Mueller appointed.

Short of Ivanka or Don, Jr. flipping, Cohen is the key witness.
He knows way, way more than Manafort or Gates.
Also key: it's been a rough year-plus for Cohen. He lost his place in Trump's inner-circle, didn't get the big ticket to the WH.

He has been loudly/vocally loyal, But, in my experience, nobody in Trump-world is truly loyal. It's all transactional and a grand performance. (People have actually told me: I don't care how you make Trump look, just make me look like I am defending him.)

I'd guess the probability of a Cohen-pardon is high and the likelihood of Mueller being fired has grown.
I would also guess that there are NY state charges.
Mueller, of course, knows all this and much more and referred the raid anyway."

Trump most certainly will try to fire Mueller -- directly or through an intermediary -- because of one simple fact: Unlike the rest of us, Trump already knows what Mueller has found or will find. If that were going to be nothing, Trump would not be concerned. He would be quietly and calmly patient, waiting for Mueller to clear him. Instead, Trump is in an absolute panic to the point of frenzy. There could be only one explanation for this.
