Donald Trump's personal attorney Michael Cohen sued Buzzfeed on Tuesday for defamation over allegations about him in a dossier the news organization published that was commissioned in 2016 by the president's political opponents. Cohen said he also filed a second defamation suit against political intelligence firm Fusion GPS, which compiled the dossier, in federal court. Buzzfeed published the dossier in its entirety nearly a year ago, which it said it obtained from a source it didn't identify.

Cohen's complaint against Buzzfeed names editor-in-chief Ben Smith, reporter Ken Bensinger and editors Miriam Elder and Mark Schoofs, who were the bylines on the article Buzzfeed published accompanying the dossier. He provided the complaint and a confirmation email from the court system that he had filed the suit to Bloomberg News.

Cohen said he's mentioned in the dossier 15 times.

"The dossier is, and continues to be, the subject of active investigations by Congress and intelligence agencies. It was presented to two successive presidents, and has been described in detail by news outlets around the world. Its interest to the public is obvious," Buzzfeed spokesman Matt Mittenthal said in a statement.

"We look forward to defending the free press and our First Amendment rights in court."

"Cohen has emerged as a figure of interest to congressional investigators probing Russian interference in the 2016 election. Cohen testified to the House Intelligence Committee on Oct. 24 and to the Senate Intelligence Committee on Oct. 25. Both sessions were held behind closed doors.

He declined to say whether he has been interviewed by Special Counsel Robert Mueller, who is directing the FBI's investigation of Russia's activities in the election.

He said that he and Trump "don't talk about" the Russia investigations. "Why waste time talking about something that's not legitimate," he said."

In State Court, that is possible. In Federal Court, the consequences are far more serious for bringing a frivolous suit. That being said, this guy is a transactional lawyer so may not be aware of the difference.

If this gets dismissed early by Cohen then you are probably correct. If not, then it will be interesting to see how it plays out.

Dershowitz is saying that this suit will be dropped. They would not want to have Trump be deposed for hours or days on this.

Trump's attorney files a frivolous defamation suit right at the same time Trump is decrying our libel/defamation laws. Just a waste of tax payer money by using the courts for a political stunt.

Other media outlets should submit a "friend of the court" brief in support of Buzzfeed.

They would not want to have Trump be deposed for hours or days on this.

You would think that this would have occurred to Cohen prior to filing the law suit. If Trump refuses to be deposed, it would seem that Buzzfeed would have a good case to have the suite dropped.

I don't expect Buzzfeed to file a motion for summary judgment.

Instead, I expect them to proceed down the road towards a trial because they can subpoena Donald Trump for a deposition. And he will have to comply or drop the lawsuit.

If Buzzfeed files a counterclaim, the suit can't be dropped without Buzzfeed's permission or an order from the Court.

That would be so frickin awesome. Trump would probably perjure himself 5 times in the first minute.
