The American Civil Liberties Union and a law firm have filed a lawsuit on behalf of a San Bernardino woman who spent a day in immigration custody despite repeatedly saying that she was an American citizen. Guadalupe Plascencia, 60, spent the night of March 29 in jail because of a decade-old bench warrant related to her alleged failure to appear as a witness in a court case. She said a San Bernardino County sheriff's deputy asked her to sign documents that night acknowledging that officials with U.S. Immigration and Customs Enforcement had inquired about her immigration status. As she tried to leave the West Valley Detention Center in Rancho Cucamonga, Plascencia said she was met by immigration enforcement agents, handcuffed and placed in the back of a van. She spent the rest of the day in ICE custody, fearful that she would be deported despite becoming a citizen nearly 20 years ago.

She filed a lawsuit Tuesday against the federal immigration agency and the San Bernardino County Sheriff's Department, claiming she was detained without probable cause, on the basis of her ethnicity. She seeks unspecified compensatory and punitive relief for unreasonable search and seizure, false arrest, false imprisonment and violation of equal protection under the law.

The lawsuit claims Plascencia's release from the San Bernardino County jail was delayed to give immigration agents time to pick her up.

I hope she collects bigly! Since Trump's inauguration our immigration system has turned into an accusatory organisation which revels in persecuting anyone who wants to immigrate to the United States. The Statue of Liberty should be shrouded because it's a lie. And I say this with personal connection to a potential immigrant who the bastards at the immigration services have just told they have a seven year wait because a form was processed in the wrong method. These folks have spent thousands of dollars trying to make it possible for a brilliant son to come here but the immigration service is so oppositional that I think that son is questioning if he actually wants to try to enter such a hateful nation.

I am with Danni on this. How did ICE even know she was in custody in San Bernadino? Someone reported it? And if the inquired about her "immigration status" who said she wasn't a citizen? On top of that a 10 year old bench warrant for failure to appear as a witness???? Really?

What a disgrace this country has become. She broke the law and was detained. They asked if she was a citizen and she said yes but couldn't provide identification to prove it. They detained her until they had the proper ID, which was brought by a family member. Hell, I spent a night in jail for disorderly conduct when I was young and couldn't get released until an adult officially came to get me (I was a minor). That's the due process. It's sad that people actually hate this country so much that they defend people who break the law and are then held to the same process everyone else is...just because she's not white.

The hatred (and white guilt where it applies) Danni and others have for white Americans and America in general is astounding, yet no one ever moves or does anything to make it any better.

She didn't break the law. She failed to appear as a witness in a trial - 10 years ago and a bench warrant was issued.

See the wonderful thing about this country is you DO NOT HAVE TO PROVIDE ID. You were detained because you were a minor who actually broke the law and released into the custody of your gaurdians - not because you didn't have an ID. That is NOT "due process" - please look up the definition of "due process" you are embarrassing yourself.

There is no police state ID requirement yet like in the communist countries or Nazi Germany although we are edging that way. There is the requirements for Identifying yourself and to have ID if you are driving or flying. The bottom line is they detained her illegally - this amounts to false imprisonment. SOME states have stop and identify laws but regardless of your state's law, police can never compel you to identify yourself without reasonable suspicion to believe you're involved in illegal activity. She identified herself and they knew her identity because of what she was arrested for - a 10 year old bench warrant. ICE too knew her identity and had no grounds to detain her period.

I'm afraid that all those facts go right over the head of most Rs. She wasn't white, she couldn't show her papers, therefore alternative facts (like those used by "Humtake") say she should be in jail. It's that simple.
