The Honolulu Police Department has sent letters to local medical marijuana patients ordering them to "voluntarily surrender" their firearms because of their MMJ status. The letters, signed by Honolulu Police Chief Susan Ballard, inform patients that they have 30 days upon receipt of the letter to transfer ownership or turn in their firearms and ammunition to the Honolulu Police.

The Honolulu Police Department cites state law, not federal law, as the basis for the order. "Under the provisions of the Hawaii Revised Statutes, Section 134-7(a), you are disqualified from firearms ownership," says the letter.

Curiously, HRS 134-7(a) makes no specific mention of a person's medical marijuana status. It's a blanket statement about federal law:

134-7(a) No person who is a fugitive from justice or is a person prohibited from possessing firearms or ammunition under federal law shall own, possess, or control any firearm or ammunition therefor.

You can have a device that kills 93 Americans per day on average, unless you use that plant that has never killed anyone.

Hawaiian police and regulatory authorities are known to be extremely corrupt. This motion does nothing useful other than prepare the islands for a gentler, kinder dictatorship.

What is sad is how much better their marijuana grows with such beautiful looooong sunsets. They could be the American economic powerhouse for weed, particularly the expanding CBD industry. Instead, we have putative policing.

If you are an MMJ license holder, just give your guns to your kids for safe keeping. Problem solved.

Gun sales are banned to any user of illegal drugs, marijuana is illegal at the federal level therefor HRS 134-7(a) does ban MMJ users.

However this article is old as of Tuesday HPD has stopped the order pending further review.

As long as state laws regarding marijuana differ from federal law these kinds of issues will be complicated. Federal government needs to just revise their laws regarding marijuana and allow each state to have their own laws, hahaha I crack myself up.
