Drudge Retort: The Other Side of the News

A San Fransisco jury has acquitted an undocumented immigrant who was charged with the murder of Kate Steinle. Jose Ines Garcia Zarate was acquitted of the murder charge following the 2015 shooting, according to the San Fransisco Chronicle. Steinle was fatally wounded while walking the San Francisco waterfront in 2015 by Zarate, who had been deported to Mexico on five previous occasions. She was 32 years old.

According to the Chronicle, the San Francisco Superior Court jury found Zarate not guilty of assault with a firearm, and convicted him of being a felon in possession of a gun. Zarate will be sentenced at a future date, which has not yet been set.

He had 7 previous felonies, but get this from USA today: www.usatoday.com

Garcia Zarate didn't deny shooting Steinle and said it was an accident.

The jury of six men and six women -- including three immigrants -- found Garcia Zarate not guilty of homicide. Steinle was killed while posing for pictures with her father on a San Francisco pier.

Zarate, who had been homeless, claimed he found the handgun on the pier and accidentally fired it when he picked it up. He said the bullet ricocheted before it hit Steinle. However, he reportedly told police interrogators that he fired the gun on purpose and was aiming at a seal.

But prosecutors said he had the gun all along and was playing his own "secret version of Russian roulette" when he fired the weapon into a crowd on the pier, and the bullet struck Steinle. After he shot Steinle, Zarate tossed the gun into the San Francisco Bay and was captured on surveillance cameras running away. Police found gunshot residue on his hand.

It was later determined that the gun had been stolen four days earlier from a car belonging to a federal agent with the Bureau of Land Management. Now Steinle's family is suing the agency.

Thank god this innocent illegal alien who never committed an 8th felony will be released back onto the street without even a manslaughter conviction.

I suppose, in right wing world, they should have went ahead and convicted him. You know, just for ***** and giggles.

I mean, after all:

Fake news.

Sad.

In reality, man receives a fair trial by jury, is acquitted of a crime he was accused of, and people view it as a political defeat.

Not sure why you feel the need to lie. He killed her, but was acquitted of murder. His lawyer said accidental ricochet, the jury agreed. He was guilty of the illegal firearm charge. Illegal immigrant, illegal firearm, accidental killing.

It will continue to be very weird to watch people calling this a political win.

More likely a state run prison as a maximum security inmate I think. They've been outsourcing to neighbor states lately to fight overcrowding, but it's a very small % relative to their prison population. Moder8 could probably best tell us what happens in cases like this guys upcoming felony sentencing for the firearm charge.

He couldn't have possibly aimed a ricochet shot. But, if he pulled the trigger in the city it was a reckless action which caused an unnecessary death, also known as manslaughter. Is this decision as crazy at Dan White? I don't think so. There's something about those San Francisco juries.

I have no idea if this verdict is just or not. Trump doesn't either. The people who had the most information on the actual incident -- the jury -- felt they didn't have enough to find him guilty.

My understanding was finding him guilty of a lesser charge than murder was not an option. Would have helped to have that as an option. If that is indeed the case, can you say Prosecutorial error?

I mean he did shoot the gun whatever the circumstances and he did admit to it and deserves to be in jail IMHO but obviously the jury didn't believe he deliberately shot her. I mean they had 3 different versions of the story - his, police and prosecutor. Way to confuse the subject... I didn't see the full video or any for that matter - that would be interesting to see.

Maybe you missed these Tweets of Trump's in your assessment of him:

"A disgraceful verdict in the Kate Steinle case! No wonder the people of our Country are so angry with Illegal Immigration."

"The Kate Steinle killer came back and back over the weakly protected Obama border, always committing crimes and being violent, and yet this info was not used in court. His exoneration is a complete travesty of justice. BUILD THE WALL!"

"The jury was not told the killer of Kate was a 7 time felon. The Schumer/Pelosi Democrats are so weak on Crime that they will pay a big price in the 2018 and 2020 Elections."

Clearly Trump has used this incident to score cheap political points, something you have chosen to overlook and in the process inherently criticized the US jury system as embodied in the 6th amendment to the US Constitution. Trump is at least consistent - he really does not like any US constitutional process that works independently, as intended by the drafters.

Kate Steinle's death has been politicized to the hilt by Trump and others on the right to serve their cause of demonizing immigrants. It was a central focus of his rallies. He tweeted about it many times.

Do you really expect people to forget that happened and pretend this was just another murder trial? Trump wanted a lynching of the evil undocumented immigrant and the jury didn't give him one.

From the link:
He was charged with murder. The jury was given the option of convicting Garcia Zarate of first-degree murder, second-degree murder or involuntary manslaughter.

What would have helped was the jury's understanding of 'involuntary manslaughter'.
Or the will to to impose it.
IMO

Personally, I think if the Jury in the George Zimmerman case had been give the latitude that was given in this case, GZ would be in jail right now. This guy killed a chick and the jury basically says "it's cool..."

I'm really not sure why they wasted time with the felony possession of a firearm charge...his argument was that he simply found it and picked it up. If that were true, it's a little cruel to convict him of possession. If it's not true, then neither was the rest of his story.

That's just fine in 'Murrica. Murder depends on intent, and only the shooter know what he intended.
