The nation's largest state bar association is overhauling ethics rules for attorneys for the first time in 30 years, and some lawyers are unhappy about a proposal that would open them up to discipline for having sex with clients. California currently bars attorneys from coercing a client into sex or demanding sex in exchange for legal representation. Supporters of an all-out ban say the relationship between a lawyer and client is inherently unequal, so any sexual relationship is potentially coercive. But some attorneys say it's an unjustified invasion of privacy. The proposal is part of a long-awaited shake-up of the state bar association's ethics rules for attorneys, which were last fully revised in 1987. Lawyers who violate the regulations are subject to discipline ranging from private censure to loss of their legal license.

This is so overdue! It is disgraceful that some attorneys seem to think it is okay to have sexual relationships with clients. When people come to us they often are desperate. For some lawyers to take sexual advantage of that desperation is sickening. And I am sad to say that over the years I have know several attorneys to do just that. Such individuals are the lowest types of worms.

Sounds reasonable that all such attorney - client sexual relationships should be banned by the BAR. Also as expected attorneys would frown on any ethics regulations or laws that would hamstring their wily ways.

@Moder8 - Look I am not going to say a lawyer wouldn't take advantage of someone. Hell I think most do. The point to me is that we are talking about consenting adults and not hormone struck teenagers. Sooooo why don't we put in place some real protections like real punishments and even a process to report you are engaging in a relationship rather than trying to run people's lives. I think you are probably a fool to consider dating a client personally, but I am also not one to stand in the way of consenting adults. Especially if they actually crave each others companionship.

But it's not consenting adults. It is one adult who has found themselves in a difficult (potentially life changing) situation going to an attorney for help. The potential for abuse is obvious. And it happens quite frequently. If these were individuals on an equal footing, rather than a situation where one is heavily dependent on another, then of course we would all have a different view of such relationship. But they are not on equal footing. Hell, there are even scumbag attorneys who demand sex in lieu of cash payment. It is grotesque. These are not "consenting adults". All too often there is a vulnerable coerced adult.

I understand your angle. Again - put real protections for their clients in place because a ban is just BS. Put some real teeth into this. These are not all cases of abuse. There are many cases of consenting adults. If a Lawyer is abusing his position that's a different matter. Why shouldn't I date a lawyer fighting a traffic ticket for me? I happen to meet her through an ad for her services... I mean that's just stupid. If a lawyer is abusing his/her position today as the article points out there are already consequences.

Don't get me wrong some people are desperate and will do anything I get that. *Whether there are rules or not.* But for other people what's the difference between a lawyer and a plumber? Just saying... I mean a plumber can take advantage of a situation too. What's next a mechanic?

Let me put it in perspective. I know a lawyer in particular. I have known him for years. I used to hunt with him and hang out until I learned what real genuine SOB he is. I dare say he is one those type of lawyers you are talking about given the right opportunity. His wife tried to leave him because he's an abusive cheating misogynist. Of course he told her how he would destroy her and she stayed with him out of fear. That's the kind of d-bag lawyer that needs to be taken care of.
