While under the influence of alcohol and drugs, a Baltimore man and his friend of 15 years were making an online video Wednesday where one tested a bullet-proof vest by shooting the other. Mark Ramiro, 30, missed the vest when he shot, killing his friend Darnell Mitchell, and is charged with first degree murder, second degree murder and two gun charges. "This in no way was my client ... trying to do anything but a stupid, ridiculous prank," said Ramiro's attorney Christopher Flohr.

Nothing like prosecutorial misconduct. Overcharging? Understatement. We've become addicted to retribution - justified or not. Our permanent state of war now includes our own citizens; it's sad and pathetic.

First, allow me to say, I don't think the murder 1's going to stick, HOWEVER...

In a purely technical sense, I doubt this can be called prosecutorial misconduct. The facts are pretty straight forward:

1. The shooter planned, in advance, to shoot his friend. The "testing of a bullet proof vest" doesn't change that simple fact. Mitigates the Belgium out of it, but doesn't change it.

2. While drunk, he shot and killed his friend.

As I said, I SERIOUSLY doubt that charge will stick, but it's not out of bounds to level as a charge, I don't think.
