Hannah Levintova and Dana Liebelson, Mother Jones: Federal law prohibits convicted felons, subjects of permanent domestic-violence protective orders, as well as current and former spouses, parents and guardians who have been convicted of domestic-violence misdemeanors from possessing a gun. But this leaves many situations where potential abusers are allowed to keep their guns. The current law doesn't apply to misdemeanant stalkers, domestic-violence misdemeanants who are current or former dating partners but who've never cohabitated or had a child together, as well as accused partners subject to a temporary (rather than permanent) restraining order. This is concerning, especially considering that in more than half of all states, fatal violence between intimate partners is most often perpetrated with a firearm.

Don't forget the kids who skateboard next to "No Skateboarding" signs, old hippies who smoke a little weed, people who have American flags visible on their property, dog owners and people who wear socks with sandals.

Anyone who has dealt with family law knows exactly why.
Accusation is proof enough for restraining orders.
In many states you can get them without any input by the accused.
Divorce and domestic issues bring out the worst and lies are constant.

There has to be a balance before you take away rights.

They're not talking about people with permanent domestic violence restraining orders, RCADE. They're talking about people accused (but not convicted) of misdemeanor domestic violence who have received a precautionary restraining order. See Salamandagator's comment above. Do you think having your girlfriend's mom accusing you of being violent sufficient cause for having the police take your weapons away?

Here in Arizona, convicted felons can, and often do, petition the courts to have their right to own a gun restored.

And?

In AZ it's ten years past sentence and probation for serious offences and at least two years after sentence and probation for minor offences. At which point you must petition the court who is under no obligation to grant it.

It is similar in most states.

Seems plenty fair to me.

Oh and if it is considered a dangerous offence during sentencing you are never eligible again.

I had an ex file a TRO on me. Even after showing the judge her cell phone and emails, in which she and guy she was cheating on me with conspired to use the TRO as means to loot the house ("get a RO, when hes gone sell everthing and be sure to take the money out of the bank accounts"), he would not rescind it. One of judge's reasons was my CCW, saying it made me a danger to others. We already put an burden of responsibility on law abiding citizens. Everytime a possible solution is mentioned, SJWs come block it. Mental health background checks? Its unfair and intrudes into peoples lives. Mandatory min. sentences for convicted felons in possession? No, thats racial profiling and disportionately targets one segment of the population. Instead ridiculous measures are taken, such as:

Because so many crimes are commited with WWII vintage weapons.

I believe that criminals should be BANNED FOR LIFE from owning guns, but that's just me.

You conveniently leave out the specific statutory criteria the proponent must prove and the court must find in order to restore the right to own a gun that I linked for you the last time you brought up this stupidity.

BTW, got any statistics on "gun-nut NRA member" judges in AZ or is that just another example of something you pull from your nether region?

"Judicial discretion" always prevails in Arizona, statutory criteria are secondary and most often completely ignored. Just as the ten year "waiting period" is a non-existent joke. Any Judge that does not tote the NRA line, will quickly become A FORMER JUDGE

Sammy, you misunderstood the law. Judicial discretion is only available for crimes that were the inbetweens. So if something only barely made felony then the can treat it as the lessor. That would only take 8 years off but still requires the sentence and parole before the clock started. As said that is not available to violent offenders and most times the violent ones get the add on which precludes them from ever getting their rights back. Add it to sentencing and what you come up with is decades before they can try. Now you might fear them but the majority that are eligible are going to to be non violent crimes. So what you are afraid of is just not a thing and your characterization is patently false.

The actual fact is, that violent felons frequently petition the courts and are successful in getting their 2nd amendment rights restored. The "letter of the law" is quite different then the actual "practice of the law" with all the loopholes that "judicial discretion" affords the judges. The 10 year waiting period is a complete joke.

Funny sammy. What you have stated does not seem to be supported. Can you find evidence to back up your claim that the judges are making illegal rulings? Because I am calling bs. Even the absolutely insane con control extremists online make no claim like yours. So even the certified loonies don't say that. That does not bode well for you and compounded with your record of being uninformed on anything relating to guns it is only reasonable to dismiss that completely.
