A 26-year-old New York Yankees fan who snoozed through a portion of a game in April is suing the team, Major League Baseball, ESPN and two TV announcers, accusing them of defaming him during the broadcast and afterward online. As a result of announcers John Kruk and Dan Shulman's alleged "avalanche of disparaging words" and statements published on MLB.com, Andrew Rector seeks $10 million in damages, alleging defamation and intentional infliction of emotional distress.

"John Kruck [sic] in his verbal attack insinuated that the plaintiff is an individual that know neither history nor understood the beauty or rivalry between Boston Red Sox and New York Yankee."

this doesn't make sense it could have gotten this far...I know on the ticket it says something about team not liable if you get hit by ball etc....but doesn't it also say that your image can be used by MLB and you aren't entitled to sue or get money for the use of that image?

and by accepting the ticket you're agreeing with those terms.

How could the announcers possibly know that Mr. Rector is a member of the New York Tea Party, just my watching the video ? ?

He isn't suing because they used his image - he is suing because they "defamed" him (while using his image). Not sure what the difference is legally speaking or if the disclaimer covers it.

What may be equally humorous is the complaint itself:
"Rector's complaint contains misspellings, bizarre phraseology and claims, and shows that the plaintiff is particularly upset about the purported allegations that Rector is not a die-hard Yankees fan."
So did he use a lawyer or a wannabe lawyer or is he a wannabe lawyer?

Article also talks about disparaging remarks that the announcers supposedly made that aren't in the video.

All that said - I certainly can see falling asleep at a baseball game. Certainly not a good idea but I sure understand it.

He is suing because they showed him sleeping? I never saw it before this. I saw it BECAUSE of his suit. Will he sue himself next for filing a lawsuit that makes him appear stupid?

This is HILARIOUS ~ as many comments hilariously demonstrate. His lawyer no doubt took the case for no fee unless he collects the 10million, of which he'll get 6 or 7.

(On a completely different track (not significant enough to post separate story) a lady in Bossier City, LA, was in a grocery parking lot engaged in a fight, over who had been next in line, the cop used pepper spray to separate them; and she's on the news saying [Granted i shouldn't have been fighting, but the officer used excessive force.] The officer SHOULD no doubt have inserted his body between the two screaming cats, so they could assault him & end up in prison.)

I'm assuming there's more to the video and commentary than what's shown above?
Because if he's suing over that, then he IS "someone of a confused state of mind, disgusted disgruntled and unintelligent and probably intellectually bankrupt individual."
