Audio has been released of Little Falls, Minn., homeowner Byron Smith shooting and killing two teen burglars after lying in wait for them in his basement, anticipating a break-in. Smith, 65, is heard shooting and killing Nick Brady, 17, after glass is broken. A minute later he shoots Haile Kifer multiple times, then delivers a fatal shot and crows gleefully over their bodies, delivering what Gawker calls "a five-minute vigilante tirade over the corpses." Smith was found guilty Thursday of premeditated murder.

While I agree it was stupid to break into the guys home, you make yourself out to be a pretty sick individual if that's all you can come up with after hearing that audio.

My brush was not that broad as the phrase I used was "far from unique." Taking a look at the comments in the Gawker article as well as the NY Daily News article linked by Gawker, more than a few individuals leap to Smith's defense so it would appear that my characterization of Smith's attitude and desires was accurate.

As for my ignorance level, I've known more than a few gun owners over the years and many of them seemed eager for confrontation and seemed to favor the Jim Malone school of conflict resolution.

I too have known gun owners who swore this or that fate for these or those little mother [...]ers blah blah blah.

All bluster and I'm sure that to the t, every one of them would lose their luster if they actually killed a person.

And here is Hannity charging to the defense of poor Byron Smith as Fox News needs to incite the righty gun-fondlers to boost its ratings since that welfare-queen-rancher-bigot fell out of disfavor.

It was a rather half-hearted defense so perhaps Fox is checking to see if that dog will hunt; we'll have to wait to see if the militia-types show up, armed of course, in Minnesota to make sure that their brand of justice is done. I look forward to Fox-News-Nation working itself up into a lather shortly.

Always the false conflation that all gun owners are like the story. You had me at the guy was sick. And lost me at that comparison. I have several guns. They've never killed anything but animals that were then used for food.

Now, I do understand his rage somewhat. Very violating to have your home broken into. You want to get back at someone. Had some tools stolen out of my car last year. And yes, there are about five seconds where I contemplated putting a nice shiny new toolbox in the back after a couple weeks and waiting up at night. Strangely, never thought of my guns, but did consider a bat and knee capping someone. Anyway, contemplated that for all of five seconds, before good sense won out and I called the insurance company and got a little money for new tools. And have since remembered not to leave nice shiny stuff like that unattended in the back seat.

That's a (relatively) normal gun owner's reaction to this sort of thing. As you can tell, by the vast number of gun owners who got up today, and didn't kill anyone. And sick as this guy's end reaction was, the kids were partly to blame. You don't break and enter anywhere unless you want to risk getting shot.

There's no way this wasn't murder. The fact that there was a robbery going on doesn't give you the right to put someone out of their misery. Any self-defense claim is laughable.

I can certainly appreciate the argument that these kids got what's coming to them. And now this guy got what's coming to him too. Everybody loses.

It sure was thoughtful of him to record these murders, though. Otherwise he might have gotten away with it.

Folks who believe that breaking into a home, while UNARMED, is deserving of the death penalty, should work to make that the law. It would reduce the prison population.
In this case Mr. Smith was sentenced to life, for murdering a young white couple, I wonder if he had gunned down 2 hoodie wearing UNARMED 17 yr old black kids, if he would received the same sentence or if he would have even been found guilty in the first place

Sheesh. I think most people here accept that a home invader who poses a threat can be justifiably shot. But this guy shot that girl to death after she no longer posed a threat. He left no doubt about that fact. Self defense law does not permit you to kill people who aren't a threat.

You forget that similar case happened in the South at the same time the Zimmerman trial was on. A older black man chased several teens from his property, one (a white teenager) turned around and charged the man, he shot and killed him, and was subsequently aqcuitted. Race has nothing to do with it, I dont see you crying tears over that young mans death. Obama never proclaimed that the older gentelman could be his father. That young mand did exactly as Trayvon did (as evidenced by the map and Jenteals testimony that Trayvon was in front of his house yet returned to confront GZ). You assault someone you bear the risk that you will end up dead.

The odds are that they were drug addicts and/or envious materialists.

It is still the chance she took when she violated the sanctity of his home, with never a subsequent pang of regret that she may have stolen something of tremendous sentimental value. Saying she no longer posed a threat is speculative. Ever hear of retaliation? It is the sociopath's motive of choice.

i do not feel sorry for her or her loser boyfriend. i do believe the homeowner is probably mentally ill; but we do not know what his history of victimization may have been. (Rage like that is often precipitated by something.)

The way i see it, Minnesota (or this district) has effectively told its citizens they must take a measured response in dealing with any law-breaking offender within the privacy and security of their homes. Oh, the poor children crying in agony as the horrible man ended their criminal careers! He saved others from being victimized by these cheats without a conscience.

The PC police are attempting to make these thieves the victims in their unrelenting attempt to make self defense a dirty word, and the means for it by the masses banned. Until one walks a mile in the shoes of others such as an elderly man who has had his home repeatedly burglarized and violated, the subsequent build up of rage may not be understandable.

Youth such as these two that would invade the homes of others are criminal sociopaths and their ultimate intentions are not benign. Those like these youth are the most dangerous as many of their ilk have tortured and raped, or perhaps the clueless haven't read the stories. Their actions had they caught the homeowner off guard are an unknown, because it didn't work out for them.

When one would break and enter the home of another, be prepared to face the consequences, because most homeowners will not know the intentions and motive.

It's 1 thing to defend your home.

It's completely another to setup an ambush, shoot down 2 people, execute them instead of calling for medical assistance, then do a 5 minute victory dance. That's gonna be murder no matter how you slice it.

#22 Rcade. "Threat" is not always clearly delineated in present tense. At least that is what law enforcement claims with regularity when household pets and unarmed individuals are shot and killed. They always get the benefit of the doubt, which I disagree with btw because they are professionals.

I'm not going to lie awake nights fretting about the deaths of these two home invaders. I'm more likely to lie awake concerned about the man driven to mental illness.. It's a shame for all.

In Minnesota, existing state statute states that persons do not have a duty to retreat before using deadly force to protect themselves or prevent a felony from being committed inside their residence.

That aside, if he had successfully prevented the felony from being committed and execute them, he's going to the slammer.

You've never even driven through a poor neighborhood, much less stopped to talk to a poor person, have you? Nobody steals things from the houses of others to "survive". People who steal to "survive" steal food from grocery stores or purse snatch and tend to face disproportionately long sentences compared to their offense. People who steal from houses are doing it for drugs or fun money; and perversely serve shorter sentences than those who actually DO steal to survive.

Libertarians should really not even pretend to care about the poor. It never comes out as anything than clueless stupidity.

Actually, that's true of nearly everything libertarians say in general.

Did you listen to the audio? There was over a minute of silence (except for a dragging sound) between the first shots and the final shots. No "adrenaline rush" explains the fact that he was no longer in danger, moved the injured girl, and then pulled the trigger again and again. The first 15 seconds of the tape, sure, I'll give you self defense/stand your ground, whatever. The last 5 minutes+ proves murder though. His rationalization makes it even more clear that this was no adrenaline rush, he meant to kill these folks regardless of whether he was in danger or not.

In the name of liberty, many youngsters are brought up in arrogance and lawlessness, and even the law enforcers (Police and Judges) are having their plates full.

People who have no fear of God will continue to bring nuisances and troubles to neighborhoods and the nation... and sometimes eliciting fear and overreaction from gun owners.

Sad to say this two young people did not live long enough even to realize their wrongs and repent before God... and have gone to the wrong side of eternity. Sad. Sad. I grieve for them.

Eventually we are going to make the connection between people snapping and being F'ed with. Did this guy murder them? Yup. Should he go to jail? Yup, for about 5 years at the most. A life sentence is too much for somebody that was terrorized in his own home. He likely killed them because he was scared. Fear aggression. He probably understands it and even mentally prepared himself ahead of time. Dummy kids looking for a thrill and they got it. Perhaps nothing malicious on their part, they were just piece's of uhmm, garbage with no respect for others. If this guy had thought it through, he would have just beat them senseless, maybe broke a bone or two, but he made the wrong choice.

Bad choices all around. Very sad.

One should assume that their life is threatened in any home invasion. It takes a desperate person to invade someone's home knowing the owner just might be armed.. Monday morning quarterbacking is easy safe and accurate.
