Five Hasidic men were arrested Wednesday for a disturbing attack in New York City against a gay black man in a case initially investigated as a bias attack, police said. Fashion student Taj Patterson, 22, said he was headed to his Fort Greene home after a night of partying last December when over a dozen ultra-Orthodox men assaulted him on Flushing Avenue in Williamsburg while shouting anti-gay epithets Patterson suffered a broken eye socket, a torn retina, blood clotting and cuts and bruises to his knee and ankles. The main instigator kicked him in the face, yelling "stay down, ------, stay the ---- down," as others cheered, Patterson said.

I have problems with the hate crime stuff except in cases where a defendant has a track record of such things.
But to call this anything but a hate crime under current law is a farce.

Calling it a hate crime in the headline is inaccurate until/unless the authorities call it one.

A hate crime is a not an "inherent truth." It's a specific statutory definition under the law. Calling something a hate crime when it isn't even being investigated as one is like calling someone a murderer who hasn't been charged, indicted or convicted of murder.

You can do that as an opinion -- O.J. Simpson is a murderer! -- but a news headline should be about facts.

It was a hate crime, it was just not treated as one because the perps are also part of a protected group.

I didn't say that it doesn't. But hate crimes are much harder to prove than people think they are because they require direct knowledge of the intent of the attackers. It's like stand your ground, where if somebody says they felt threatened the burden is on the state to prove otherwise -- a tough thing to do without mindreading.

Given how close-knit the ultra-Orthodox community is, finding someone to testify that the mob set out to attack random black men (or random gay men) is a high prosecutorial burden.

Hate crimes generally are pursued against people who leak like a sieve when caught or are thoughtful enough to write about their intentions in advance.

Do you set your standards by what any other media outlet does?

My insurance agency examines the business models of other agencies to find efficiencies, added-values, etc... and that includes looking at financial ratios, revenue per employee, and specific customer service standards.

Is there something like an association or affiliation that gives you access to information that helps you with establishing or measuring metrics that help you in your business?

FTA they were looking for a vandal, not a homosexual. This guy happened to be gay and the extent to which their bigotry led to the violence is up in the air. When the punishment is 25 years in prison, it's best not to mess up the prosecution in case they walk. No matter what, if they did it, then they should be punished.

Rcade - I get your meaning and agree that only facts should be headlines. However, that is not always including the fuller reality of the story. To any casual observer this appears to be a hate crime, so I would imagine it's important to not ignore that. Besides, that "facts only" rule isn't really always adhered to - we do re-post Onion articles as well as from World Nut Daily..

On topic: This isn't unexpected from a radical Zionist, let alone a cabal of them predating upon gay people, knowing we have such limited representation. Proof of a hate crime can be the use of a prejudicial epithet during the course of committing the crime, not necessarily proving a plan to commit the crime (premeditation).

But the punishment for a type of criminal action should be consistent regardless of the perpetrator's opinions, stated or not. Hate crime is thought crime, and that will inevitably morph into criminalizing certain political thought.
