In a voice vote, the House approved legislation Tuesday to overturn a 2005 Supreme Court decision that allowed states to take private property under eminent domain and give it to private developers. The Kelo v. City of New London decision was widely criticized for replacing the "public use" standard, which only allowed eminent domain when the property taken was for public use. The Private Property Rights Protection act prevents states from using eminent domain on property for economic development and establishes a private right of action for property owners if a state or local government violates the new rule.

Nobody. Democrats just believe that Republicans are slightly more evil and corporatist. Myself, I think they make too much over this distinction, but I never liked the Kelo decision anyway.

Good. Kelo v. City of New London had to be one of the most unfair, intrusive, and brazen individual property right decisions ever to be decided by the Supreme Court.

It won't get anywhere without eminent domain theft of private property.

Oh, wow Corky, I didn't realize that some Republicans might do something that's officially legal, thanks to the liberal justices' decision. Their hypocrisy makes the Kelo decision totally OK then. Let's keep bulldozing poor people's homes, and keep the decision in tact, because some Republicans are hypocrites.

The issue is "public use," not "public ownership." I personally don't think a pipeline qualifies for use. But that's a hell of a lot more debatable than a Pfizer corporate office park, which was the case in Kelo. Also, the pipeline doesn't have to raze neighborhoods to be built.

This move will protect banks that have foreclosed on properties and let them rot from being bulldozed by cities attempting to mitigate blight and allowing banks to sell rotten houses.

As for the Keystone Pipeline--how were the other 30,000 miles of pipeline built over the last 30 years--well before Keystone--ever built?

Thank Christ. Long, long overdue. Kelo represented the most egregious abuse of Judicial Review in memory. This bill should have unanimous support in the Senate and be signed as soon as it hits the President's desk. Failure to do so is a tell-tale sign of the intentions of those in power. It is not in any way acceptable for Eminent Domain to be used to beef up the tax base by transferring from one private owner to the other.

Its also a clever trick to take the land under the guise of a legitimate purpose and then change course. Back in my hometown of Norfolk, Virginia there was a problem with the city taking public land under the guise of building a school in the seaside area called Oceanview. Oceanview had for years been blighted. They reversed course and decided to hand it over to a developer for construction of tightly packed high-end housing. I hope they accounted for that in the language of the bill.

#32, its a huge lot of weeds right now. They bulldozed the homes but never got around to the "economic development" part. Now the town has zero tax revenue, instead of a little bit more than the homeowners would have been paying had all gone to plan.

Government at work.
