A convicted drunk driver from Spring Hill, Fl., who killed three people in a Christmas Day 2007 car crash is suing the only person who survived in the car he struck. David Belniak, who had drugs and alcohol in his system and never hit the brakes when he slammed into another car at a red light, suffered a "government sanctioned assassination against one individual," said his attorney (and sister) Debra A. Tuomey. He wants the relatives of Raymond McWilliams, the driver of the other car, to pay for his "pain and suffering."

Anybody can sue anyone for just about anything. Doesn't mean it's going anywhere. What kind of lawyer would take his case, though? Insane. I hope the lawyer is sanctioned for wasting the court's time.

This is what we need protection for AND from! How is it possible these people can be in the positions they have attained? Ifdf frivolous is a word this is what it's for! What school gave the degree? Why? And how much did they charge?

Could a 'loss of license' for six months AND payment of ALL court costs end this type of thing?

I don't understand why drunk driving laws aren't strict liability laws. A person under the influence has no business getting behind the wheel. Anything that happens consequent to that drivers choice should be the fault of the impaired driver. End of story.

suing the Bassi's auto insurance carrier or them
personally. Anyone can file a tortuous action.
Whether or not the plaintiff can prove his case
depends on the evidence they show. Another
Floriduh tort. Sad though it causes the vitim's
family more pain.

I didn't read the link, and I'm not going to bother to. But I have a question for anyone who cares to answer it:

Suppose a drunk driver is rear-ended while sitting at a stop sign by a car that is speeding with a driver who is reading a text. Should the drunk driver be able to sue the driver who rear-ended him, even if that driver died in the wreck? If he does, would the headline read, "Drunk driver sues victim"?

IMO, no. With a drunk behind the wheel, that car had no business being anywhere off the curb.

#15. Read the article he plowed into their car going 70+ mph while they were stopped at a red light. And he said it was their fault cause they changed lanes quickly right before the accident. In other words he planned to run a red light at high speed while dui. What an asshole. His attorney should be disbarred....

I have zero sympathy for the drunk moron filing the suit. Nor for his dipshit sister-lawyer. His criminal record shows what a piece of dirt he is, so I guess he has nothing to lose. Criminals do that sort of thing all the time.

I covered the legal system for many years as a reporter. Every now and then worthless lawsuits were filed -- though not as many as some here would have you believe.

The most fun suit I recall was a pro-se pleading by a prison inmate who had been convicted of burglary and being a persistent felony offender but got freed from prison a few weeks later after his attorney showed the prison an order from the judge, who had signed the guy's post-trial motion for judgment notwithstanding the verdict. Despite being freed, the inmate sued his former lawyer for not springing him from prison soon enough.

Turns out the judge meant to write DENIED on the motion and the inmate was supposed to have stayed in prison. When I reported the lawsuit in the paper, the judge freaked out and formally corrected his mistake, and the guy was rounded up and sent back to prison! If the dumbass had kept his mouth shut and not filed the suit, he might still be free today.

Now that is justice.

In 1987 I got hit by a car which had run a red light and tried to get away after totalling my KZ900 and leaving me under the wreakage in court she tried to paint herself as an innocent 30 year career teacher who was the true victim of a "filthy bearded biker" (me) despite the statements of 5 witnesses and her own teenaged son

He killed 3 people because he chose to do drugs. The real mistake is that he was alive more than a day after sentencing.

#30 i dunno. if the drinking or drugs caused the accident, then i see your point. but if they didn't, then???? in this particular case though, something should happen to the lawyer, like disbarment. the piece of shit brother killed 3 here, and killed a pedestrian before. he should never get out of jail. never. fucking psychopath.
