Drudge Retort: Red Meat for Yellow Dogs

The New York Tax Court has denied a Brooklyn tax lawyer's attempt to claim over $100,000 in payments for prostitutes and pornography as medical expense deductions. William G. Halby, 78, a retired tax attorney, kept a journal for 2004 and 2005 with the date, the name of the "service provider" and the amount. "Petitioner's payments to various prostitutes were personal expenses not prescribed by a doctor and not intended to treat a medical condition," the court ruled. "Petitioner is not entitled to deductions for these amounts."

A little over a week old but I came just came across it today when catching up on my reading.

Good find. Very entertaining.

The dude was in his 70s and spent almost 100 grand on hookers - that's actually kind of impressive.

Was this research for his book?

Yikes!

Halby also lost a case last September in the New York State Division of Tax Appeals in which he had tried to deduct $322,000 in sex-related charges for 2001-2005.

Unless it only represents 2 encounters. On the other hand, sex is the best way to prevent prostate disease so it should be deductible as preventive medicine.

He must have gotten his tax advise from ACORN...

I find it obscene the IRS will not allow any deductions for funeral and burial expenses.

I think that those expenses are deductible from the estate taxes.

And his call list from Republican Senator Vitter.

SS gives $500

instead of deductions, they could be considered sin tax or pleasure tax.

But if he had employed a licensed massage therapist....????
Oh, then it is legitimate.
Bunch of crap, but then why should I, who never got a single massage or ever indulged in a hooker, pay more tax than someone who has.
Perhaps the entire concept of making massage tax deductible is ridiculous.

So if the guy had a doctor's note for treating erectile dysfunction--he would have qualified the deductions as treatment of a medical condition???

With the prices--it's more like Elliot Spitzer!

wives are nothing more than prostitutes who demand a place to stay and sleep after doing the dirty deed.

and husbands are nothing more than johns who can't feed and clothe themselves properly.

sometimes third party individuals get involved and screw the whole setup. they are called kids.

"See ACORN ---"

OK, Murphy do your best. Tie them to this.
I really think ACORN has become a virtual mental illness among people who lean to the right.

Geez--lost or misplaced your sense of humor Danni?

Legal fees are not deductible??
Oh! They mean the other type of whores. My bad.

"SS gives $500"

That'd be nice, but the SS Death Benefit is $255.

Whatsleft

I think that those expenses are deductible from the estate taxes.

I only wish I was in the monetary category where I had to pay out estate taxes. I believe for 2009 it's if you leave more than $3.5 million in your estate.

"Hookers, Porn Are Not Deductible"

Well, I guess I'm screwed, too.

And not in a good way.

SS gives $500

#11 | Posted by goatman

It's $255 and is only paid to the spouse. My Mom got $255 when my Dad passed away. I, of course, was not eligible to receive anything from SS when she passed on as I was an adult child, not a spouse. But when your wife passed away if you received $500 maybe it was a combined payment made to both you and your son -- if he qualified to receive a Social Security death benefit from his Mom because he was under age 18 at the time. I'm not quite sure how it works.

Would everyone just leave Bill Clinton alone?

The way estate law currently works, unless (and perhaps even if) the estate was bankrupt or you personally incurred expenses that exceeded the value of the estate, funeral and burial expenses were not your expenses to deduct.

#23 -- you must be right because my son did qualify. I got $1,000/mo on his behalf until he was 18 YO also.

What if I'm studying for a role?

"What if I'm studying for a role?"

Then it might be, as long as it's legal and role-specific.

Right now with my Mom and Dad's estate (my Mom was last to pass away and did so last year) I'm wearing two hats. One as Successor Trustee (the house was in a family trust) and also as one of the two Trust's only two Beneficiaries (my sibling being the other one). The funeral/burial costs will shared (1/2 to be paid by each Beneficiary) although in the meantime as Successor Trustee I've paid the funeral/burial costs in full -- until the house sells and I will then be reimbursed for half those costs by my sibling.

Tip -- if someone says they've named you as Successor Trustee for your family's Trust -- run like hell and never look back.

Only to the spouse. If the last parent dies, the kids get buptkus.

Maybe laws have changed since 1996, or Chris is right that they give a burial benefit on behalf of the child. I specifically remember receiving $500 from SS when my wife died.

Thid guy probably figured that since we all paid for Bush to keep his gay porn star lover Jeff Gannon in the Lincoln bedroom for many nights, that it would be ok to deduct his own expenses

And you cannot expense lapdances........

.....you don't need lessons to learn how to be a cocksucker, you're a natural.......

He should have taken them as a business expense under "entertainment."

At least part of it would have been deductible...

With the prices--it's more like Elliot Spitzer!

At the guy's age, I expect he'd be looking for someone with diapering experience, Muffy.

Either he was charged a higher rate because of his old wrinkled balls or this guy was/is a horn-dog. Either way that is a lot of scratch to be spending on women of the night.

"Tax Court: Hookers, Porn Are Not Deductible "

Very disappointing.
