A federal appeals court delivered a stinging rebuke Friday to the Bush administration's post-Sept. 11 detention policies, ruling that former Attorney General John Ashcroft can be held liable for people who were wrongfully detained as material witnesses after 9/11. A three-judge panel of the 9th U.S. Circuit Court of Appeals said the government's improper use of material witnesses after Sept. 11 was "repugnant to the Constitution and a painful reminder of some of the most ignominious chapters of our national history."

Anomaly in the space-time continuum caused the first two links to be malformed.

I gained respect for Ashcroft after his nixing Gonzales while in the hospital, but the Bush Administration broke so many laws and lied so much - a such a great cost to America - some people NEED to go to prison for a very long time.

A section of the Court's ruling:

" Almost two and a half centuries ago, William Blackstone, considered by many to be the preeminent pre-Revolutionary War authority on the common law, wrote:

To bereave a man of life, or by violence to confiscate
his estate, without accusation or trial, would be
so gross and notorious an act of despotism, as must
at once convey the alarm of tyranny throughout the
whole kingdom. But confinement of the person, by
secretly hurrying him to gaol, where his sufferings
are unknown or forgotten; is a less public, a less
striking, and therefore a more dangerous engine of
arbitrary government.

The Fourth Amendment was written and ratified, in part, to deny the government of our then-new nation such an engine of potential tyranny. And yet, if the facts alleged in al-Kidd's complaint are actually true, the government has recently exercised such a "dangerous engine of arbitrary government" against a significant number of its citizens, and given good reason for disfavored minorities (whoever they may be from time to time) to fear the application of such arbitrary power to them. We are confident that, in light of the experience of the American colonists with the abuses of the British Crown, the Framers of our Constitution would have disapproved of the arrest, detention, and harsh confinement of a United States citizen as a "material witness" under the circumstances, and for the immediate purpose alleged, in al-Kidd's complaint. Sadly, however, even now, more than 217 years after the ratification of the Fourth Amendment to the Constitution, some confidently assert that the government has the power to arrest and detain or restrict American citizens for months on end, in sometimes primitive conditions, not because there is evidence that they have committed a crime, but merely because the government wishes to investigate them for possible wrongdoing, or to prevent them from having contact with others in the outside world. We find this to be repugnant to the Constitution, and a painful reminder of some of the most ignominious chapters of our national history."

What makes this decision so remarkable is not merely the clarity of the sentiments expressed. What makes it so remarkable is that it was authored by Milan D. Smith, Jr., appointed to the Ninth Circuit by George W. Bush and confirmed in 2006. Judge Smith is a graduate of Brigham Young University, an active Mormon, and brother of former Republican Senator Gordon Smith. In other words, a leading conservative legal voice.

(Wow, a principled non-political judge. Good for him!)

If Obama is giving the top of the hierarchy a pass for authorizing torture, he'll give Ashcroft a pass for unlawfully detaining people.

I like this precedent, though, that we can sue administration officials personally. When I go after Timmy Geithner and B.O. for running up trillions in debt to bail out Wall Street banks, I wonder who their character witnesses are going to be?

The court did not say he is liable. They said he could be held liable if the accusations are proven true. That is a huge difference.

Unfortunately, the 9th Circuit Court of Appeals is almost automatically reversed by our conservative U.S. Supreme Court on anything ideologically controversial.

As for this ruling--they wouldn't pay attention to what folks had to rely upon in making decisions following 9/11.

The Supreme Court doesn't select equal percentages of cases per Circuit. Even if they did, if the Circuit's decision was based soundly on the law - there would be no reversal by the SC.

This circuit is reversed because of the decisions of the court.

To say that, because they have more cases, more cases are reversed is a false assumption.

If their cases were done properly, their cases wouldn't be selected by the Supreme Court for review.

Their cases would be denied cert.

The fact the Supreme Court grants cert and overturns this Circuit is because their decisions are wrong.

Lots of differences between FDR's imprisonment policy and GWB's imprisonment policy... off the top of my head

1) FDR interned more than 100,000 people.
2) The people FDR had interned lost their homes and business.
3) FDR had people rounded up without regards to who they knew, what they were doing or anything else.
4) The repayment / apology was made by Regan more than 40 years later.

Apparently you missed the point entirely. Amnesty, immunity and pardons only apply to criminal cases. For example, OJ Simpson was acquitted of the murder charges, but still sued for monetary damages.

Obama has no power to prevent Ashcroft from being sued for damages in a civil suit.

At any rate this lawsuit has nothing to do with Obama. It was a decision passed down by a right wing judge and obviously one who respects the ACLU's constitutional right to initiate the lawsuit in the first place, something the hate mongers in the republican party can't stand the thought of.
