Holder rests his decision on a five-year-old report by the CIA's inspector general that was declassified on Monday. The most alarming details revealed by the report involve Abd al-Rahim al-Nashiri, the al-Qaeda chieftain said to have directed the October 2000 U.S.S. Cole bombing that killed 17 members of the U.S. Navy. The report alleges that a gun was brandished during Nashiri's interrogation and that a power drill was held near him and occasionally turned on and off. Moreover, it is claimed that, on more than one occasion, shots were fired in adjoining rooms in a manner suggestive of the possibility that the CIA was executing uncooperative detainees.

ignoring the fact that threats were made against family members, mothers and children-which is a violation

then there are a section on parsing the language of unauthorized while ignoring the facts that the interrogators themselves believed they were doing stuff that was illegal as expressed in their own fears of being prosecuted.

some additional considerations ignored in what I read, much of the information is redacted and presumably Holder has read, serious physical harm was induced-separated shoulders, waterboarding was not conducted in an approved manner.

I am 100% cool with discussing the moral issues, the slippery slope(s) and the legality (or illegality) of various forms of 'enhanced interrogation', or 'torture' in the most extreme sense.

These are all good points to bring to the debate.


What irritates me is when people argue that torture (whatever that means) NEVER works and/or that polite requests for info are actually MORE successful than the exertion of pressure coupled with demands for info among hardened and trained extremists who are willing to give up their lives for their twisted cause.

I can understand and respect the legal and moral argument against such techniques. But let's keep it real. This shit works! It is not 100% - no method is. But exerted pressure is far more successful than passive bullshit.

This is common-sense.

The issue is where to draw the line - NOT whether or not the ugly-side of the line is effective.

To those blithely dismissing all of this as things that don't seem particularly bothersome, I'd say two things:


(1) The fact that we are not really bothered any more by taking helpless detainees in our custody and (a) threatening to blow their brains out, torture them with drills, rape their mothers, and murder their children; (b) choking them until they pass out; (c) pouring water down their throats to drown them; (d) hanging them by their arms until their shoulders are dislocated; (e) blowing smoke in their face until they vomit; (f) putting them in diapers, dousing them with cold water, and leaving them on a concrete floor to induce hypothermia; and (g) beating them with the butt of a rifle -- all things that we have always condemend as "torture" and which our laws explicitly criminalize as felonies ("torture means. . . the threat of imminent death; or the threat that another person will imminently be subjected to death, severe physical pain or suffering . . .") -- reveals better than all the words in the world could how degraded, barbaric and depraved a society becomes when it lifts the taboo on torturing captives.


(2) As I wrote rather clearly, numerous detainees died in U.S. custody, often as a direct result of our "interrogation methods." Those who doubt that can read the details here and here. Those claiming there was no physical harm are simply lying -- death qualifies as "physical harm" -- and those who oppose prosecutions are advocating that the people responsible literally be allowed to get away with murder.

The decedent was "dead on arrival" per the Medical Treatment Facility (MTF) Emergency Room record which was otherwise non-contributory.

On the right side of the neck there are two parallel, faint, linear abraded contusions. each averaging 1 1/4 x 1/4 inches with 1/2 inch separation between the two. They average approximately 10 inches below the top of the head and three inches to the right of the anterior midline. Just to the left of these is a similar, fainter, patchy abraded contusion in
approximately the same dimensions.


Torso: Multiple contusions and abrasions including "brush burn" injuries consistent with being dragged on the ground.


Extremities: Multiple contusions and abrasions, including injuries around the wrists consistent with shackling. On the thighs were linear contusions likely made from being struck with blunt objects. The patterns in the skin of the left calf revealed the likely source of the injuries- combat boots:


On the back of the left knee and calf is a 11 x 7 1/2 inch red-dark purple contusion which extends upwards above the back of the knee in a linear fashion. On internal examination, confluent hemorrhage extends deep within the muscle which is focally necrotic. On the left calf, centrally located, is a patterned abrasion consisting of multiple parallel horizontal linear abrasions the largest averaging 1 1/2 x 1/4 inches, these are closely spaced.


The Autopsy listed the cause of death as "Pulmonary embolism due to blunt force injuries", and the manner of death as homicide

Caution Deflection Alert

Among the 10 techniques approved for use on al Qaeda commander Abu Zubaydah was one tailored to his fear of insects. Mr. Zubaydah would be placed in a box with an insect, according to a partially redacted section in one memo. Mr. Zubaydah would be told it was a stinging insect, but it would actually be a harmless one, such as a caterpillar, according to the memo.

The two are not equivacal. If I thought the war was a waste and based on a lie, one would be enough. And correspondingly, I would not try to quantify how many casualties would signify the war was worthwhile.

A considerable dialing back of his previous claims, which were that the techniques themselves were responsible. Now that the memos are released, he no longer makes that claim.

Ali Soufan, testifying to a Senate panel behind a screen to hide his identity, said that his interrogation team obtained a "treasure trove" of information from Abu Zubaydah using a non-threatening approach that outwitted the detainee even getting him to talk by using his childhood nickname.
Soufan said his team had to step aside when CIA contractors took over, using simulated drowning, sleep deprivation and other harsh methods. He said those techniques caused the prisoner to "shut down."

August 26, 2009 - Do you think the wardens will let George Tenet wear his Presidential Medal of Freedom over the orange coverall? Perhaps he and Donald Rumsfeld will end up doing time together in one of the prisons also slated to host what Rumsfeld called "the worst of the worst" from Guantanamo.
That would be poetic justice of a most ironic kind. And if the two former leaders do end up in prison they can count themselves fortunate for having dodged execution for their roles in a slew of capital offenses.
You see, punishments for violations of the War Crimes Act (18 U.S.C. 2441), applicable in their case, include the death penalty - often the sentence of choice if detainees die in their custody. And countless have.

Before you question my sanity, please know that I just completed the arduous task of reading the aging but devastating CIA Inspector General's report on torture.
Sickening
You can be forgiven for holding your nose while paging through the redacted version of the "CIA Inspector General's Special Review of Counterterrorism Detention and Interrogation Activities (September 2001 - October 2003)." Although heavily sanitized, it is still nauseating.
You can not be easily forgiven, though, if you don't make the effort to read with care at least some of this lurid account of the abuse of detainees held by the CIA - a narrative which is said to have sickened Attorney General Eric Holder and one which cries out for reinforced efforts toward accountability.
This is not the CIA in which I served for 27 years. I spent most of my career in the analysis directorate, but had substantial tours of duty in the other three directorates as well.
There were abuses before the Bush/Cheney administration, but Bush and Cheney thoroughly corrupted both substance and operations, and enlisted creeps and charlatans to do their bidding. There is now reason to believe that the careerists and contractors who cooperated in the criminality will be held to account

Water boarding seems to be their favorite method of torture and results in fewer deaths, but with almost no intelligence gathered.

I believe the interrogators were using drills on living prisoners and the interrogation tapes stolen to hide that fact among many other abuses.
