I'm from alabama. i remember one time, we were visiting someone that my dad was working on their car for them. these people were real winners. my mother told me not to touch anything because they were so dirty. and they were.

I said that if you fail to report income, there is a crime committed. However, if you report the income and put it in as a per diem, then it's not taxable. Per diems are paid as expenses in advance. The regulation reads that it is the responsibility of the Employer to validate the expenses and it's the tax payer's responsibility to show it on the tax return as per diem income.

If the IRS decides that she owes taxes on it, then, she can appeal. If a judge decides she owes taxes, then she pays the tax, the penalty and the interest.

There is no crime.
