Today in a speech McCain said he would now fire the head of the SEC if he was elected president.

Seen the reports of dissenters, calling most of the cause and effect science junk, being reprimanded? I have seen this reported elsewhere but do not have the references on hand (so don't beat me up for it). Personally, I believe that this is being promoted, not for ideological purposes but simply as a money maker, whether it be open market or our tax dollars as earmarks. We have a whole new cottage industry created by a premise that took as its spokesperson, the guy that "invented the internet". Credibility lacking. Again, that is my opinion though.

*LOL* I just scared the ever loving treacle out of a debt collector. You could almost hear his scrotum retreating into his nether regions as I was speaking to him. I was responding to an official sounding voice mail message that warned me "that a summons was going to be issued, and hmmmm yes I see that it will place a lien on jointly owned property" (the message was directed to my husband), if *me* wants to avoid this summons blah blah blah" So I called the number and let the guy on the other line hang himself for a few minutes (cause I am like that, its a bit like a cat with a mouse before she kills it you know). I eventually demanded to know what the entire thing was about *hold* comes back that it is an account with a Bailey, Banks and Biddle jewellry, which was opened in 2002 and the last payment (of $175.00 no less) was made in 2005. I calmly said to the nice gentleman "Let me just advise you before I proceed, I am a paralegal, I work for one of the most respected attorneys in our Judicial district I just want you to know that" (you could almost hear the gulp on the other end).
a) I have never purchased any jewellry from Bailey, Banks and Biddle.
b) I have never made any payments whatsoever to Baily, Banks and Biddle because I have never owed them any money.
c) If you issue the summons I will counterclaim for Unfair and deceptive trade practices and ask for punitive damages under the Fair Debt Collections Act.
d) I will immediately ask for complete discovery of all documentation proving that I am liable for this debt.
At this point he said "well a judge will give you that" I said "no a Judge will not, YOU will give me that, I am entitled to it through the process of discovery, and you are required by law to provide it to me" (gulp)
"could you hold?"
He comes back and tells me "well all I can tell you is that our documentation here shows you owe the debt" I said "what documentation you just told me you didn't have any documentation" (gulp) I then said "oh and by the way whoever left the message on my voice mail also lied to me saying that they were going to put a lien on my property which is illegal in North Carolina" He said "well what they can do is get a judgment against you and then" "yes" I said "then they have to collect on that judgment, they cannot put a lien on my property, so someone lied to me" (gulp) "well they were not from this law firm they were the processing company" "well you need to get on the phone to your processing company right now because they are representing themselves as being from your law firm and they are lying to people, because you know it's not my bosses law license that is on the line here it's yours" (gulp) "So go ahead and issue your summons I will give it to my boss" "thank you for your time" me "oh and by the way I will be calling the State Bar in the morning goodnight". I am so bad :)

PS) If I owed them any money I would be fessing up and paying it. As it is I know for a fact that I don't.
