If you didn't end up physically really hurt or pregnant, who would want to go thru the additional ordeal of being grilled on the witness stand by some low life defense attorney who will always try and make it look like the victim's fault. Most defense attorneys just broker plea bargains that benefit the prosecution as much as the defendant. By far most cases that go to court end up with a guilty verdict. Defense attorneys are an indispensable part of the system.

So law enforecement makes a judgment call... i.e. that the rape case doesn't often yield the high profile convictions that other crimes do, so they spend the money on cases that make the cops look good. Nice.

1) A conspiracy of law enforcement folks are purposely not running expensive tests because they just don't want to be bothered with solving a crime. Of course this can only happen to you if you are a 'protected minority' (which means anything other than white male).

It is probable that the reason the tests were not made in the preponderance of the cases is that the alleged perpetrator acknowledged that he and the alleged victim had engaged in sexual relations.

In "acquaintance or date rape," the issue is not the act itself but the context in which it occurred, and consent or acquiescence as consent by the alleged victim.

How would you feel if it were your daughter? How would you feel if it were your son? Our society and our courts have gone far afield in defining consent and have ignored human nature in doing so in transferring the burden of restraint entirely to the male.

One recent California case found that the male was under a duty to cease engaging in intercourse in a very limited time frame if the woman "withdrew her consent" verbally after intercourse had commenced. The number of strokes or midstroke cessation is not compatible with the neural transmissions that need to occur to enable the man to terminate his activity.

So-called "date rape" is probably over prosecuted rather than under prosecuted. The female has been relieved of any responsibility for her engagement in the process.
