Isn't there even a possible limit of some type? Under this type of plan we could have a geriatrics wing of the military prison and still no limits. We can and should have at least a practical working plan. Forever without any real determinant isn't the way thing have worked in this country. If it is a life sentence then just say it. If the Appeals court in VA ruled that this way 5-4 I'd put solid money on the Supreme court overturning it 5-4...

That appeals court is one of the most right wing and if they were divided I think its probably a lock that Justice Kennedy will vote to overrule this...

I agree with Rob, I'd be shocked if the Supreme Court didn't over turn this ridiculous decision, especially after some of their recent decisions.

Actually, I agree with RobAhole on this one. Depending on the logic used to support the decision, the more moderate SC may well overturn the ruling. In general, the tide has been turning against GWB's unlimited war on terror for quite some time now.
While I do disagree with GWBs slash and burn policy, nonetheless the problem always will remain as to how to deal with identified terrorists sympathizers in our midst in Constitutionally acceptable manner.

No it didn't. It said ANYONE who is deemed a threat, or might be a threat, may be detained. NO time limit, and given the number of people who disappear every year, it's quite possible no one would miss you.

As for Good News - well the judges were all over the place on this one so it is ripe for appeal.

It's an interesting decision. The 5 judges were all Republican, the 4 dissenting were Democrats. The decision says he has the right to challenge his detention, but Bush has the right to hold him indefinitely. It's very odd "logic" used by the judges that overturned the lower court's ruling.

Al-Marri was under criminal process when Bush intervened and had him swept up and detained, declaring him an "enemy combatant."

From the decision:

We would also grant al-Marri habeas relief. Even assuming the truth of the Governments allegations, they provide no basis for treating al-Marri as an enemy combatant or as anything other than a civilian. This does not mean that al-Marri, or similarly situated American citizens, would have to be freed.

So if there is no basis to hold al-Marri, or similarly situated American citizens, they would not have to be freed, no matter what the Habeas challenge finds.
