On CBS's Face the Nation this morning, Obama surrogate Gen. Wesley Clark said of John McCain: "I don't think getting in a fighter plane and getting shot down is a qualification to become president."

The McCain campaign responded with a statement from Admiral Leighton "Snuffy" Smith:

If Barack Obama wants to question John McCain's service to his country, he should have the guts to do it himself and not hide behind his campaign surrogates. If he expects the American people to believe his pledges about a new kind of politics, Barack Obama has a responsibility to condemn these attacks.

Clark's attack is a bit like saying that JFK's boat getting sunk wasn't a qualification to become president in 1960. Can you imagine the outrage if someone said that Clark's getting shot four times in Vietnam didn't count as a qualification for the presidency?

When choosing a commander-in-chief, most voters do take into account the courage and heroism that candidates displayed while serving their coun

In fairness to Obama, he gave a speech today praising McCain's service and his campaign issued a statement saying directly that he rejects Clark's statement...

Clark went to far and just cost himself any consideration as Vice President I think... Now Obama's gonna have to spend time praising McCain until this story goes away.

According to insiders, Barack Obama's campaign is debating how long it can leave ambiguous the notion of "residual forces" in Iraq after a presumed Obama-ordered withdrawal of combat troops begins in January 2009. But there are worrying signs, perhaps the ugliest being the rumor that Obama might recruit Secretary of Defense Robert Gates to his campaign. (Yes, that's President Bush's secretary of defense.) The Times of London reports this stunner, even quoting Richard Danzig, Obama's top military adviser and a former secretary of the Navy in the Clinton Administration, saying:

"My personal position is Gates is a very good secretary of defence and would be an even better one in an Obama administration."

Adds the paper:

Obama's top foreign policy and national security advisers are pressing the case for keeping Robert Gates at the Pentagon after he won widespread praise for his performance. The move would be in keeping with Obama's desire to appoint a cabinet of all the talents.

Meanwhile, conservatives and cautious centrists in the Democratic party want to soft-pedal Obama's commitment to end the war in Iraq.

Michael O'Hanlon, a Brookings Institution scholar who supported President Bush's so-called surge in January, 2007, is one of those. He told the Moonie-owned Washington Times this week:

"Three or four of his Iraq advisers are hinting of greater flexibility, though speaking for themselves, not for him. That indicates the potential for some change in his previous position or at least some flexibility."

O'Hanlon's role as a Hillary Clinton adviser crashed and burned last year after he emerged as a strong advocate for continuing the war in Iraq, and he's not an Obama adviser.

The Post reports rather ominously today:

Some advisers acknowledge privately that Obama is now emphasizing the need to be "responsible" in handling Iraq -- rather than emphasizing urgency in getting troops out -- to appear more centrist, a substantial adjustment of his original antiwar stance.

But the Post quotes Obama's key foreign policy adviser, Denis McDonough saying that Obama is not changing anything. Still, according to insiders, the word "responsible" has been affixed with superglue to Obama's Iraq position by the campaign's more centrist advisers, who are trying to pull the candidate to the right.

I'd never heard of this silly Joyce Foundation before Crisp's post... but it seems pretty clear they are staunchly against gun ownership. Obama served on their board... Why would he serve on their board if he didn't share their beliefs?

I don't own a gun, I have no plans to buy one in the forseeable future, so the issue really means little to me, but what Obama said the other day doesn't seem to square with his work for this foundation.

Rob-Obama came out for individual rights before SCOTUS ruled- he was on the Joyce Foundation board which gave money to another organization. Doesn't necessarily mean he or they agrees with every tenet of every grantee. And SCOTUS made it clear they weren't opposed to some gun controls-the ruling referred only (as Alito pointed out)home protection and hunting.

A lot of his stances on guns sound reasonable to me... but his work with this foundation, and some of the other facts listed above in Crisp's post seem to show that he disagrees with the Supreme Court's latest ruling on handguns, even if he says otherwise now.

Simply go to the Foundation and see for yourself. Their mission is to get rid of guns from society.

Blair Hull, who is ready to spend 40 million dollars of his 350 million dollar net worth; Hull is smart but he lacks the ability to speak or excite in a political or public forum, and no experience even trying to do so. Worse, Hull has a messy ex-wife problem that happens to come out in the last two weeks of the campaign. There is that Obama lucky political timing again. Jack Ryan self destructs with a little help from enemies in his own party and some shadowy, flame-throwers outside his Party, as well as the Chicago Tribune. The Chicago Tribune spent a million dollars to unseal a child custody file in California, an act which the Tribune never did before, or since. Lucky Barack, again.

Jack Ryan had an ex-wife problem [she alleged in a divorce/child custody battle that he pressured her to go to sex clubs] that comes out with all the sordid details in June, 2004, causing Jack to announce by June 25, 2004 that he will withdraw. By early August, 2004, Jack Ryan drops out officially and the Republican Party in Illinois, if you can call it a Party, replaces Jack Ryan with Alan Keyes, one of the worst candidates, ever, to run for the U. S. Senate in a general election. The Keyes campaign is described derisively by Keyes own handlers as resembling more of a Pentecostal Revival meeting than a political campaign. Boy, is Obama lucky in the opponents he attracts.

Bush said oil prices would fall in his administration, yet they have hit the stratosphere with record profits for the oil companies.

In the first half of 2000, gas prices were in the news. Everyone was upset, as oil had been around $10 a barrel the previous year. Then that spring oil prices doubled to $20/barrel. Vice President and Democratic nominee Al Gore blamed oil companies. Texas Governor and Republican nominee George W. Bush blamed President Bill Clinton.

Now that Exxon-Mobil posted record-high earnings, oil is nearing $140 a barrel, and Bush has been in the White House long enough to have Cheney realize his dreams, the president's blame game has shifted.

U.S. Energy Secretary Samuel Bodman told summit attendees there is no evidence that speculators are driving up the price of oil. Instead, an increase in demand from developing countries such as India and China is to blame.

This record-shattering increase in oil prices occurred under Shrub's watch. Yet, in 2000 the meathead blamed Clinton for a mild of oil price increase compared to Shrub's lame duck gouging.

Bush has failed all of us, but he is the toast of the town as far as Big Oil is concerned, still protecting their right to make us suffer at the pump.

Of the 2.4--million self-defense cases, more than 192,000 are women defending themselves against sexual abuse


We already have over 20,000 gun laws on the books that are being ignored by criminals. In the Columbine High School tragedy, at least eighteen (18) existing anti-gun laws were broken. I just look back to what an unstable douche I was at times in high school and college... not that I would have shot people, but that time in a guys life is crazy enough without adding firearms in... I have no problem with kids having to wait until they are 21 to own a gun, just like drinking...

It thought it was taken from an ABC poll. Looking back the poll may have nothing to do with the statistics used as fact. It also claims the NORC may be biased because of the funding it gets from the Joyce Foundation and other anti 2nd amendment groups.

Questions for you gang (am working on a brief for the court of appeals right now and I am curious as to what you guys think)

a) Should law enforcement be allowed to lie to a "suspect" in order to induce said "suspect" to consent to a warrantless search?

b) If you are outside your home (on the front steps so to speak) talking with law enforcement while wearing shorts and a t-shirt in December (and its bloody cold) and said law enforcement tells you that if you do not consent to a warrantless search of your house one guy will go to get a warrant while the other two guys stay with you, however you are not allowed to go back into your house and you are not allowed to make any phone calls are you "seized" as it relates to the Fourth Amendment?

I will be interested to hear your responses.

I had always thought that the 4th amendment was basically clear in that it states "if the person feels they can go about their business" without interference from law enforcement. So far I am two for two, I feel better about this brief :)

From my research cops are allowed to lie to a suspect when it comes to a transaction ie "I want to buy so much cocaine from you, here is the money" but they are not allowed to lie when it comes to stating things that will allow a warrantless search of a premises and therefore a waiver of 4th amendment rights, which must be given without "duress, coercion or fraud" I think telling a lie in order to get a guy to consent to a search and waive his 4th amendment rights constitutes fraud.

Brit reminds me of an experience from long ago. A guy behind bars ranted (in my working newspaper days) how he was gonna kill me. He was released, and on a 110-degree day I came home from a 12-hour stint at the office to see him cruising my neighborhood. I called the cops, went to the fridge for a cold one, and when the cop arrived, his exact words were: "Sir, I can't do nothin' to protect your life, but if you step off the curb with that beer, I'll have to jug you."

Texas man cleared of killing suspected burglars

A Texas grand jury has cleared a 62-year-old retiree who who shot and killed two men he suspected of burglarizing his neighbor's home last fall in the Houston suburb of Pasadena.

Joe Horn saw the men crawling out the windows of a neighbor's house and called 911. He told the dispatcher he had a shotgun and was going to kill the men. The dispatcher pleaded with Horn not to go outside, but Horn confronted the men and shot both in the back with a 12-gauge shotgun as they fled.

The suspected burglars, Hernando Riascos Torres, 38, and Diego Ortiz, 30, were unemployed illegal immigrants from Colombia. Torres was deported to Colombia in 1999 after a 1994 cocaine-related conviction.
