There are innocent people in prison, for starters. And I can't think of a good moral reason to allow a guilty person to be raped anyway.

It's interesting how the idea that job description trumps all other concerns became infused into our culture. If God exists, as some of us assert, I'm pretty sure such excuses really cut no ice at all.

The problem with the death penalty is our Judicial System is a completely fucked up business which brutalizes the poor while providing a myriad of paths for the rich. Human nature, not having changed much over the centuries, has again spawned a system opposite what our founding fathers tried to create.

Before any death sentence could be carried out three Judges should review every death penalty conviction with one question in mind. Is the evidence circumstantial or not? This is a simple question for one trained Judge to answer. But it is UnDemocratic to subject one poor life to the whim of one political appointee. (In Jena they would still be hanging niggers if they could get away with it). If all the evidence is circumstantial then the sentence should be automatically commuted to a life sentence, as penance for fucked-up-ness proven beyond any doubt by DNA technology. Those people can have the rest of their lives to prove their innocence. This will halve the death row population.

If this guy is guilty, he should be given the same consideration as any animal, quick, reliable, painless death. Only by adhering to this principal can our society reclaim the moral authority an executioner should be required to uphold.

Shrub is incapable of understanding this and has compromised our moral authority with unnecessary war, corruption, innocent death and arbitrary torture. We have lost standing in the world even as Putin sent Palonium assassins into the world. That's how bad things are right now.

Even though I am absolutely positive Scott Peterson killed his wife and baby, he does not pass the circumstantial evidence test. All the prosecution has is circumstantial evidence and for this reason alone, even though he surely did it, he should get a life sentence.

The point that a life sentence can be worse than a death sentence is right. It is also less expensive, because litigation in this country is soooo ridiculously expensive (by design).

As a conservative, I find the politicization of this issue sickening as well. I think that we as AMERICANS need to be outraged, and I can empathize with the outrage expressed here. The man is an animal and quite frankly should be dealt with as such.

Outrage is dependent upon identification with the victim, Americans generally don't identify with Iraqis due to cultural differences, religious differences, etc. so we don't have nearly as much sympathy for their tragedies. Of course, the cretin who murdered the little girl causes us to have a visceral reaction to his crime but if we more closely identified with the Iraqis we would probably feel similarly towards those responsible for their children's deaths. When you multiply that times many many thousands it does put Bush/cheney into a criminal category not much different than the man who fed the little girl to the gators.
