President Bush spared former White House aide I. Lewis "Scooter" Libby from a 2 1/2-year prison term in the CIA leak case Monday, delivering a political thunderbolt in a highly charged criminal case. Bush said the sentence was just too harsh. Bush's move came just five hours after a federal appeals panel ruled that Libby could not delay his prison term.

Well, Libby got more consideration than former Governor Seligman in Alabama. He was remanded into custody as soon as his sentence was handed down even though he's appealing his convictions as well.

It sounds like it wasn't even close. The decision by the court was unanimous, the AP reports, while Reuters says "he appeals court turned down Libby in a one-paragraph order, ruling he has not shown that his appeal 'raises a substantial question.'"

Umm, he wasn't pardoned, his sentence was commuted. There is a difference, in that he has still been convicted of a felony and has to pay $250K and serve 2 years probation.

I am not surprised by this travesty nor by the hypocrisy of celebrations from "law and order" conservatives.

Too bad the right doesn't get as worked up about the fairness of the justice system when innocent people are being sent to death row and executed. Al Gonzalez used to spend maybe five minutes reviewing those Texas death penalty petitions.

This stinks to high heaven. So did Clinton's last minute pardons of scumbags like Marc Rich. If anyone needed an argument for a constitutional amendment to strike this power from the Presidency then they have another example. As for a moderate republican like me, it is an OK compromise. I didn't want him to pardon Libby. And I had hoped Libby would get 12-18 months -- but 30 months was too much and when the court wouldn't let Libby stay out of jail during his appeal (which I believe he will win) -- I can understand why Bush commuted the sentence. and I'm gals he kept the fine and probation in place.

This I think is the truth. Libby lied under oath to protect Cheney. After his third night in prison he would have cracked just like Paris, and would have started spilling his guts to get out of there.

RCADE, Most conservatives believe the whole Plame fiasco was just a political hit job -- that Libby should never have continued beyond the moment he realized Armitage was the leaker and that Plame's status was not covered by the statute protecting covert operatives. I think most believe that Fitzgerald had decided to "bag the elephant" (Cheney, Rove, or Bush) and when he couldn't do it -- he salvaged his failed investigation as best he could by indicting Libby

As I said, I think Libby should have gotten some jail time because whatever the politics that were involved he was still convicted of a felony by a jury of his peers -- but given that the sentence was excessive and he wouldn't be allowed to stay out of jail during his appeal -- I can live with the commutation of his sentence -- as I believe that Libby will clear his name when the verdict is overturned on appeal.

On the other hand, as I said in my answer to RCADE, I think most traditional conservatives (like Fred Thompson) saw the whole Plame fiasco as a political hitjob -- and I think they saw the whole trial as a sham because of that.

Try reading something other than WND and listening to Rush, Dalton.

In other words, get a clue.

So Novak goes to the Who's Who and found her listed --confirming that she was Wilson's wife--Valerie Plame.

Danforth, the statute implies that Armitage by virtue of his security clearence and his access to classified information (he knew Plame suggested Wilson for the trip) would have or should have known that plame was covert threfore he should not have revealed her identity to a person not able to receive classified info (Novak).

Had she been covered by the statute, the burden to prove he did not know Plame's status would have been on Armitage.

That is one reason wht it makes no sense that Artmitage wasn't indicted if Fitz truly believed Plame was covert under the statute.

The second point is that "covert" under the statute requires "service" in a foreign country in the past five years. There is considerable dispute over what "service' means with lefties arguing that any trip abroad qualifies, while others maintain that the intent of the statute was meant to protect agents who are "serving" overseas on a regular basis.

The definition has never been litigated -- so neither side can claim ownership of it -- Obviously, Fitz did not believe there was a strong enough case to make that Plame, a desk jockey at Langley who may have had a single short trip overseas in 2002, was covered by the statute.

But the bottom line is that with all the information that Fitzgerald collected he couldn't even meet the low burden of proof needed to indict even a a single person for outing valerie plame.

As for having a problem with the Senate being jurors, look at the context before it. A previous poster stated Libby was convicted by jury, Clinton was not.

Lawyers for both sides can weed out jurors for a fair (hopefully) trial. Libby had his fair trial and the jury found him guilty.

If the House impeached Bush, would you say the Senate would complete the job or would they vote similarly as the last time?

Anyway, I didn't hear about this until this morning (massive migrane last night). My first reactions was: Well, that took about 15 minutes longer than I thought it would.

I've not read through this whole thread. That would take most the morning, and I really don't have the patience.

I will say this though:

A crime was committed. A person was convicted of multiple counts of lying and obstructing justice during the investigation of that crime, causing the investigation to sour. (Armitage was one of the leakers, though he was not the origin of the leak. That's why he was not charged).

The convicted party was sentenced fairly in keeping with the guidlines set forth for crimes of this nature.

Bush then, predictably, circumvented justice by commuting the sentgence because "It was overly harsh".

Interesting that he cited the probation committee (Is that the right name? I'm still semi-conscious.) who thought the sentencing guidlines should have been around 20 months, rather than 31-36 when he decided the sentence should be having him sit in the corner and think REALLY HARD about what he's done.

Kirk, I know you mentioned that you didn't think this was going to happen. The word you used was "naive". I disagree. I don't think you're naive, necessarily. I do think you were (as have been a lot of people over the last 7 or so years) duped into believing Bush is at least a semi-honourable man.

We have urged President Bush to pardon Lewis "Scooter" Libby from the moment a jury found Vice President Dick Cheney's former chief of staff guilty of perjury and obstruction in the CIA-leak case. Now, the president has acted. He didn't go as far as we would have liked, choosing to commute Libby's prison term while leaving his conviction, fine, and probation intact. But his action ensures that Libby will not go to jail, and that's a good thing.

There were a lot of reasons why presidential clemency was appropriate. The first is that the CIA-leak investigation was a fundamentally political exercise from Day One. Bush has commuted that sentence, the president's critics are howling, throwing out the kind of overheated rhetoric that gave birth to the special prosecutor's investigation in the first place. But the president took care to point out that he respects the jury's verdict, and that Libby's conviction still stands. And no one could deny that Libby, who will still have to pay a $250,000 fine, who will likely be disbarred, and who lost his high position in government, has paid a heavy price.

You're assuming a conclusion when you have no way to know what Fitzgerald believed. It's possible, even probable, he faced the same hurdle all prosecutors face: knowing the crime was committed, yet not having enough to pass the stringent bar of proof in a court of law. To suggest the fact no charges were filed, means no crime was committed, is a slap in the face to every good DA in the country.

Bogus Spin #1: Special prosecutor Patrick Fitzgerald went after Libby even after learning that Richard Armitage had been Bob Novak's "primary source" for his column outing Valerie Plame Wilson as a CIA employee.

Wrong. Armitage made his admission in early October 2003, nearly three months before Fitzgerald was appointed. So it should be clear that Fitzgerald wasn't appointed just to find out who leaked to Novak. In fact, this means that -- even with Armitage's confession in hand -- there was so much evidence of wrongdoing that a longtime GOP loyalist like John Ashcroft felt he had no choice but to recuse himself and allow the appointment of a special counsel.

Bogus Spin #2: Even so, Libby wasn't the only one who leaked about Plame.

Maybe not, but it turns out that every other Bush administration who leaked did so with information they got as a result of Libby's actions. Ari Fleischer testified during Scooter's trial that Libby told him over lunch about Plame working for the CIA, and Karl Rove reportedly told a similar story to the grand jury that indicted Libby. Meanwhile, Armitage and Bushite press flack Dan Bartlett both found out through a State Department memo that was produced in response to questions that Libby had asked a top department official about Wilson's trip to Niger. If Libby (and his boss, Dick Cheney) had been content to reply to Wilson's criticisms on their merits rather than by rattling cages in search of fodder for personal attacks, none of the other officials would ever have been able to leak about Plame.

Bogus Spin #3: The trial was just Libby's word against that of a bunch of reporters.

Although three reporters did testify, they were preceded on the stand by six different government officials who each testified to having conversations with Libby about Joe Wilson's wife before the date when Libby first claimed to have heard it from a reporter. It was these officials' testimony, more than that of the reporters, that convicted Libby.

Bogus Spin #4: Libby was convicted for having a faulty memory.

It's never mentioned in the mainstream media, but Scooter didn't just "forget" telling reporters about Joe Wilson's wife working for the CIA, and deny it when he really had told them.

No, Libby's "faulty memory" caused him not only to deny where he had learned about Plame -- a note produced in the trial showed Vice President Cheney had told him she worked in the Counterproliferation Department of the CIA (where the majority of employees are covert) -- but to invent stories saying he HAD leaked to reporters when he hadn't. He claimed to have been the first to tell Matt Cooper about Wilson's wife, thereby covering up the fact that Karl Rove had done so. And he shielded Fleischer by falsely claiming to have told the Post's Glenn Kessler as well, apparently trying to cover for the Post's October 12, 2003 report that a journalist for the Post (who turned out to be Walter Pincus) had been leaked to -- a news story that was found, with key passages underlined, in Libby's files.

Thus Libby was convicted not just of perjury but of intentionally lying in order to obstruct the investigation. And what George Bush did yesterday was intended to make sure he got away with it.

I don't agree with rudy on this point -- though I understand his legal hair splitting that probably makes him correct at least in theory.

But the fact is, the case was not dropped and Libby was indicted by a grand jury who did not see Libby's "lie" as immaterial -- neither did the jury in the criminal trial who convicted him of a felony. And while I believe the verdict will be overturned on appeal, it cannot be overlooked.

I would have liked to have seen Libby get jail time -- but 30 months was too long and he should have been able to stay out on bail during the appeal so I reluctantly agree with the commutation. I don't believe that Libby will get a pardon -- and I don't think he will need one as I said before, I believe his verdict will get overturned on appeal

Read Fitzgerald's public statement about why charges were levied against Scooter and why charges were not levied under the IPA. It has never been what you've consistently implied. Try to speak about these issues factually instead of the erroneous misstatements you continue to proffer as credible. They aren't, and they never were. Its all in the court records and the attendant remarks of the judge and prosecutor.

And yes, its an act of treason to divulge the identity of a protected person during a time of war. The fact that the IPA's statutory burden of proof could not be met doesn't mean that no crime was committed. The evidence to assure conviction wasn't there, but it has never meant no crime was committed, for there surely was, just as though Libby, Armitage, and Rove told Plame's identity to a known Soviet agent. Printing it in the newspaper had precisely the same effect, it ended her career.

And let's not forget that CIA Director Hayden submitted a statement in writing to Congress confirming her status as covert.

I don't think there is a Constitutional right that prevents Libby from being asked again for the truth and if he lies again, let's put him on trial, again!.

How many times can we put him down that road? I don't think the law prevents a second or third questioning. Libby isn't on trial - his testimony is needed in the investigation.

That must be some pretty strong koolaid the Bush supports are drinking. I thought republicans's placed the LAW above their party. They are right in one sense that it is not above the president powers to do this. However where is all the outrage that the Republicans showed when Clinton was busted for the same thing. YES the same thing. At the end of the day Libby was convicted of pergary and obstruction of justice. He was not convicted of outing a CIA agent he was convicted for lieing under oath and obstruction of justiced. Please do yourself a favor and look back at the Clinton trial. Look back and you will see that this is the same thing the Clinton was impeached for.

Bush's pardon of Libby is easily distinguishable from Clinto's pardon of Rich. Rich wasn't convicted for covering up somthing that the Clinton white house had done. There is a huge difference when Bush is pardoning a man who lied to a U.S. Attorney to cover up actions by the Executice branch. That distinction is not difficult to appreciate, even to a fool.

Likewise, Clinton fired U.S. Attorneys as a matter of course after his election, as is common practice. Bush fired 8 U.S. Attonreys selectively as a means of polticizing the DOJ and influenceing their work for political ends. This is unprecedented and any republican DOJ employee will tell you the same. the DOJ is not supposed to be used by the White house for their political ends. It is supposed to apply the law fairly. Clinton did not select U.S. attorneys to fire based on whethertor not they were doing the political bidding of the white house. That disctinction is easy too.

As for energy taskforces, nothing bad about them, but for the VP to claim executive privilege and not reveal who was influencing policy is ridiculous. Clinton didn't do this. This should scare the shit out of conservatives, not liberals. Conservatives are suuposed to fear governmnet, especially if Cheney carves out a new 4th branch for himself that apparently is not subject to any checks and balances.

Well Shrub had to "take care" of Scooter.

Just like when Plames name was leaked, Bush promised to "take care of" who ever was responsible. He is just following through on his promise of the rich and powerful taking care of the rich and powerful.

I remember Shrub promising to obey the "rule of law" and to "restore honor and dignity" to the whitehouse.

He has done neither.
