hahahahahaha you have got to be kidding. There are MILLIONS of illegal aliens from Mexico in L.A. County and 1/3 of our jails are filled with illegal aliens from Mexico.

Do you really think with all the illegals here to chose from to deport the Sheriff's dept. is going to risk a liberal fanatical ACLU lawsuit by deporting a somebody here legally????
Besides, poor Pedro had already been jailed BEFORE on drug charges so the sheriff's dept. was able to check his previous jail record for place of birth. And why was his mother whining and running all over TJ looking for him but did NOT bring his birth certificate with her. How did she think she was going to get her poor Pedro back over the border with no proof of citizenship?

From the much more detailed article below [SFGate.com], looks to me like poor Pedro knew he was going to be put under house arrest for his crime right after he got out of jail so when he had a chance to instead claim he was an illegal alien and be put on a bus straight to TJ Pedro decided to 'go for it' figuring he could sneak back over the border any time he wanted.

It all began when Pedro Guzman, 29, a resident of the desert city of Lancaster, was sentenced April 19 to 120 days in jail for a misdemeanor trespassing violation, according to the suit filed in federal court.

At the Men's Central Jail in Los Angeles, he was asked about his immigration status and responded that he was born in California, according to the [ACLU] suit.

Sometime after that, the Sheriff's Department identified him as a non-citizen, obtained his signature for voluntary removal from the United States and turned him over to U.S. Customs and Immigration Enforcement for deportation, according to the suit.

The American Civil Liberties Union of Southern California, which helped file the suit, has Pedro Guzman's birth certificate showing he was born at Los Angeles County-USC Medical Center, said spokeswoman Celeste Durant.

Sheriff's spokesman Steve Whitmore said the department correctly followed procedures.

"My understanding is that this individual said he was a Mexican national and was in the country illegally when we interviewed him," said Whitmore. "We turn that information over to immigration officials, who then re-interview him."

Immigration and Customs Enforcement confirmed he had been deported, and said the agency had done so correctly.

"ICE only processes persons for removal when all available credible evidence suggests the person is an alien," read a statement. "That process was followed here and ICE has no reason to believe that it improperly removed Pedro Guzman." An agency spokeswoman declined further comment because the lawsuit was pending.

On May 11, Guzman called the home of half brother Juan Carlos Chabes in Lancaster, said Michael Guzman. He spoke briefly with Chabes' wife, telling her he had been deported but didn't know to where. So he asked a passer-by where he was, and Chabes' wife heard a man respond, "Tijuana," said Michael Guzman.
"That's how we realized he was there," said Michael Guzman.

Then the phone cut off and the family hasn't heard from him since. In Tijuana, they've put up fliers, visited police stations, jails, hospitals and morgues, but haven't been able to locate him.

The family has asked various U.S. government agencies for help finding him but have been denied, said Catherine Lhamon from the ACLU of Southern California. "It's astonishing that the government who deported him by mistake has done nothing to help," said Lhamon.

Lhamon said Pedro Guzman had previously done jail time for drug possession, so he had a record that could have been cross-checked before a deportation decision was made.

Michael Guzman said his parents were from Mexico, but seven children, including Pedro, were born in California. He said Pedro spoke both English and Spanish, but couldn't read or write either.

About a week before being deported, he called from jail to say he would soon be released and put on house arrest, said Michael Guzman.

In the last two weeks, Michael Guzman said several letters have come to the house reminding his brother to show up at probation-related meetings.

As a good conservative, I TOTALLY support our government in everything it does, therefore I support this deportation. He deserved it. The only agency at fault here is the ACLU. Why do you liberals hate America?

Something stinks alright. Who called the ACLU with this little story?

My take? This Pedro dude is a drug addict (he already is on probation from prior drug charges). He gets arrested again and now was going to be on house arrest. The guy is jonesing for more drugs, knew if went right home he would be on house arrest and couldn't score any drugs. He then tells the sheriff's dept. he's an illegal alien knowing they put illegals on a bus to TJ. This would buy him time to score some drugs before going on house arrest. He figured if he got caught on the way back over the border, who cares, he scored and that's all he was looking for.

It's hard to tell if he was one of his mother's American-born seven anchor babies or not. The illegals lie about their identity and where they are born all the time.

When Pedro first got jailed on drug charges the jailers would have to take his word for it as to whether or not he was in the country legally because until only very recently were our LA jails even allowed to ask whether or not a prisoner was an illegal alien. Pedro could have lied about being born here or he could have been lying about being an illegal alien just to get the free trip to TJ and a chance to score some drugs.

THEN, when things started to get hot for Pedro back here on the homefront because the probation dept.(from his still being on probation from his prior drug charge) was still sending Pedro letters --

asking where he was, and his familia had to come up with an excuse to cover his now-missing butt.

Bingo! Pedro's relatives then cook up a story about the mean old USA deported our poor, mentally deficient little U.S. born Pedro and dumped him all alone to wander the mean streets of T.J.

To make sure they soak even more money from the U.S. taxpayers, Pedro's relatives get the anti-American Civil Liberties Union to sue the feds on their behalf. At least that's the way I see it.

Pedro probably has 50 ID's -- legal alien, legal U.S. citizen, illegal alien -- and uses whichever one suits his purpose at the time.

The jails in Los Angeles are run by the Sheriff's Dept. They check the citizenship status and, if the prisoner is here illegally in the country, the Sheriff's Dept. turns them over to ICE for deportation after they have served their time in jail.

Pedro's mother says, in the story, that she runs down to TJ to look for him every weekend but she doesn't take a cerfitied copy of Pedro's birth certificate with her? How does she think she's going to get her "mentally disabled son" back over the border into the U.S. without a birth certificate or any other ID to show he's legal? Hmmmm?
Who diagnosed Pedro as being "mentally disabled' anyway? The story says he doesn't read or write -- well, half the illegals in L.A. County are illiterate even in Spanish. That doesn't make you mentally disabled.
