Last fall, Matthew, 16, taped the teacher, David Paszkiewicz, telling students in a history class that if they do not believe that Jesus died for their sins, they "belong in hell." On the recordings, which Matthew made surreptitiously starting in September, Mr. Paszkiewicz is heard telling the class that there were dinosaurs aboard Noah's ark and that there is no scientific basis for evolution or the Big Bang theory of the origin of the universe.

Why is this being discussed in a history class in a public school?

I did that same stunt in my private school. The lunatic teacher had thrown a hissy fit over nothing. When she found my tape recorder, she sent me to the principal's office.

I have always hated that school ever since. When they diagnosed my daughter with the same learning differences 30 yrs later, I was very upset with the evaluator. WTF was a private school going to do to help her was my line of reasoning?

Now a days the teacher would have been booted, and I would have been praised!!!!

A few months ago the American Civil Liberties Union went on record against the United States government recording inbound phone calls from suspected terrorists, and argued that in the event the evidence appeared that justified an arrest, it should be disregarded because no warrant was obtained before taping the conversation, and is thereby unconstitutional.

But here, armed with a tape made by a student without the knowledge, let alone the permission, of the teacher, the ACLU stridently claims a violation of the Constitution by the school--NOT the student--and offered to join in a lawsuit.

Hard to keep up with the ACLU, which seems to flip flop, given their mood. Until you ask, where are they likely to make the most money? And then you know.

Danforth - as we all know this wasn't that long ago. Animals were really teeny tiny back then. When God made the heavens and the earth and there was light and dark and water upon it and then land and then (whew even I'm tired) well anyways...he saved a little on the materials list and made them really small.

When Noah marched them all out he ran them through a little of the remaining flood waters and, like the little sponges where were.....POOF!!!

I heard this story weeks ago. It annoyed me to think that in the shadow of NYC, that a public school teacher could be so out of touch with the need to insulate students from teachers who put their personal religious beliefs into the curriculum!

His personal views could not have been approved by the Board of Regents of New Jersey. If he wanted to preach, then he should do so in his temple, church, or mosque. But if he wants to have the taxpayers pay his salary, then he needs to stick to strict separation of religious opinions or beliefs and facts.

He should be fired. The school district needs to be chastened and sued. And the student who recorded the BS going on in class should be rewarded.

Had a guy in my OSSF class ten years ago try to tape the instructor from the front row by placing a tape recorder on the desk.
Instructor said, "Please do not record my lectures".
No response.

In the state of Florida it is against the law to record a telephone conversation without the person's knowledge. I wonder why such a law would be passed. If someone says something then why do they have the right to not have it recorded? In my own daughter's case, her ex is a nut case yet they share custody of a child. WEre his comments, which come very often, recorded the court would have no difficulty determining that he has no business raising a child. Who do we protect with such laws?

Nope. I just take issue with your calling Aya's suggestion a lie. Say what you want about the teacher's rantings here, but you can't say they're uninteresting. Not a big deal, though. I taped my ex-wife's phone calls and tapped into her emails while we were having a custody battle, even though it was illegal to do so. The judge ruled in my favor, and made other rulings that have established precedent for surreptitious recordings in custody disputes. So, hooray for the kid who taped his teacher. Hooray for dads who are fighting for custody of their kids against an unfaithful spouse. And hooray for the government of the United States for taping phone calls of terrorists calling their pals here. The fact that the ACLU is on the right side of only one of these three is a problem for them, not me.

Years back our Union local discovered one of our premiere members was doing voiceover work under the table for less than scale. We only found this out after he was replaced and he came to the Union wanting us to recoup his "lost" monies. We wanted to fine him and the hirers as well, as they both broke the rules. Our lawyers told us we could not only not fine the member, we were obligated to take his side in the dispute. I was literally sick to my stomach.

The Union, sadly, has no choice in this matter.

And for all the bluster, nobody can produce a single American citizen who can demonstrate he was harmed by the wiretapping operations, or for that matter, that he had been. And for all I heard about the promised hearings as soon as the so-called Rethug party no longer controls the Congress, the silence is deafening. Murtha is busy scheduling hearings on Hastert's plane rides, and the rest are busy brokering votes on non-binding resolutions. Could it be it was all a smoke screen to get the hard-lefties to the polls, when deep down, the Dem leadership knew there was nothing there? After all, they sit in the same intelligence hearings the Repubs do.

The teacher was a whack job, but rules are rules, and the rules prohibit recording the teacher w/o permission. The teacher should be shit canned though, because that line of teaching does NOT belong in a public school.

If the kid had gone home and transcribed the recording into longhand notes, those could have and should have been accepted as proof of the teachers transgressions. Especially if other students signed off to their validity.

And Pugz say what you want, but next time read carefully before you retort. I went to private school that to this day is still all boys. My point was that if one of the best schools in America didn't help address my issues, why should I assume another might help my daughter at the cost of 16K a year?

If the taping is illegal and thereby the evidence is not admitted in court, the case should be dismissed to avoid any costs to the public. The school should not have to defend itself in court if the case cannot stand.

If the tape is admissable, let the school administrators go down with the teacher.

Personally, I think all these kinds of lawsuits should be against the teachers and administrators - NOT THE SCHOOL. Why should I pay in taxes to cover a lawsuit by fools who were hired and went beyond their mandate?

There are enough students to verify the story. What needs to be done is the school needs to launch an investigation and ask students from the past years if recall witnessing such behavior.

Since this is a clear violation between church and state and every teacher knows the ramifications, the teacher needs to put on probation with the understanding if he says anything related to what he did, he will instantly be fired for cause. Also is parents try to sue the district and if the school has to pay anything for the teachers transgressions, the teacher will be fired for cause.

I do feel the teacher would be better off teaching at a Christian school for the rest of his natural life.

This law is clear and everyone knows it. The teacher knew what he was doing and made a conscious decision to disobey the constitution that is the basis of this country. As a teacher, it was a risk he voluntarily took. He is not a martyr, he is a criminal and obviously harmed and offended students. Was the ark large enough to hold all the required animals?

To put this in perspective, this is the equivalent volume of 522 standard American railroad stock cars, each of which can hold 240 sheep.

If the animals were kept in cages with an average size of 50x50x30 centimetres (20x20x12 inches), that is 75,000 cm3 (cubic centimetres) or 4800 cubic inches, the 16,000 animals would only occupy 1200 m3 (42,000 cubic feet) or 14.4 stock cars. Even if a million insect species had to be on board, it would not be a problem, because they require little space. If each pair was kept in cages of 10 cm (four inches) per side, or 1000 cm3, all the insect species would occupy a total volume of only 1000 m3, or another 12 cars. This would leave room for five trains of 99 cars each for food, Noah's family and range' for the animals. However, insects are not included in the meaning of behemah or remes in Genesis 6:19-20, so Noah probably would not have taken them on board as passengers anyway.

Tabulating the total volume is fair enough, since this shows that there would be plenty of room on the Ark for the animals with plenty left over for food, range etc. It would be possible to stack cages, with food on top or nearby (to minimize the amount of food carrying the humans had to do), to fill up more of the Ark space, while still allowing plenty of room for gaps for air circulation. We are discussing an emergency situation, not necessarily luxury accommodation. Although there is plenty of room for exercise, skeptics have overstated animals' needs for exercise anyway.

Even if we don't allow stacking one cage on top of another to save floor space, there would be no problem. Woodmorappe shows from standard recommended floor space requirements for animals that all of them together would have needed less than half the available floor space of the Ark's three decks. This arrangement allows for the maximum amount of food and water storage on top of the cages close to the animals.

I don't think this guy is a professor (usually someone with a PhD who teaches in a college). Isn't he a secondary ed teacher? I know they say college professors tend to be liberals, but is this also true of public school teachers?

1. Many animals annually consume food requiring more room than the animal itself (Elephants, for example, about 8-9 times their size/year). Think about the space you take up. Now think about the space a year's worth of your food takes up.

2. In measuring the Ark, making it seaworthy would require it to be smaller at the base than the decks. This is true even for flat-bottomed boats, which probably wouldn't be seaworthy given the weight it's expected to bear. Therefore, the lower deck's assumed measurements are too large.

3. The measurements assume no space whatsoever is taken up for any boat functions. Anyone here ever been on a boat which didn't take up any space to operate?

4. If every living thing off the Ark died, as we're told, how did the herbavores survive once back on dry, barren land?

5. Along that vein, how did the carnivores survive once off the boat...or is that why there are no Unicorns?

6. The earliest anyone pegs "the great flood" is about 4800-4900 BC. How did Noah get the polar bears, since he had to travel to a theretofore unknown part of the world? Of course, the polar bears---which we know were in the Arctic Circle before that time---somehow not only got to Noah in the Middle East, but then migrated back to the Arctic Circle after nearly a year in the tropics.

7. This assumes two of each. The bible says two of some, seven of others.

8. God tells Noah to make one (yes, one) small window, 18 inches square, for ventilation. Anyone care to do the oxygen requirements for a 450 x 150 deck loaded with animals?

9. The animals borded the Ark "in the selfsame day". That's over 11 a minute, even at only 16,000.

10. Olive trees can't survive in super-high altitudes, and water over the highest peak would certainly kill them all. Yet seven days after the rains stop, a dove brings back an olive branch, supposed "proof" of dry land. Olive trees don't grow in a week.

Since science has shown it takes an extremely long time to create teh necessary erosion conditions to create sediment layers, that would equate to millions of years of erosionary(is that a word) conditions.

In answer to your question, no, I don't believe in evolution. I do believe in genetic engineering, like, when you breed different types of dogs, which is easily demonstratable by just breeding for certain traits within a few dog generations.

You can make a variety of dogs. But you can't make a dog become a turtle or any other animal. Belief in evolution requires that you believe that one animal can become another animal - a fish can become a duck, or what have you. Totally undemonstrable, scientifically speaking.

This answers all the beetle questions and such.

I posted the info about all necessary creatures making it onto the ark because about 100 posts ago someone said they did the math and it couldn't possibly be done.

I have been a public secondary school teacher (Honors and AP English) for thirty years now, and I have found liberals to be a vast minority. At my school, I think we could all fit comfortably in my car for a smoke. The conservative element forms the loud, vociferous herd. I know they brow-beat students who hold different political views or who-God forbid-think in a way that diverges from what the neocons see as the norm.

Sholagar is correct. The issue is the expectation of privacy. The government needs a warrant to record a private conversation.

But lets say that the suspected terrorist was out in a public square giving a lecture to other suspected terrorists.
The FBI would be perfectly within the Constitution to wander over with a recorder and tape the speech, and use it as evidence.

No warrant is needed where there is no expectation of privacy.

The Schools District is in violation of creating a hostile environment and should be held accountable for that.

The student is in violation of school policy (a stupid policy but a policy none the less) and should be held accountable for that...just because we agree with him is no reason to let him off the hook.

Both should be held accountable. I am sure that the school has made a greater violation and would pay a higher price. Which is probably why they reacted the way they did.

If I was a student there I would probably have done the same thing...it would have been worth it...I would write a book and make a small fortune.

Your definition of evolution is wrong, so you don't get it. Evolution doesn't say a bird becomes a man, it says through change and progression, sometimes at crawls and somtimes in leaps it moves. I have never seen it defined as one living creature turns into another(it's not the werewolf theory).

According to the article, they did not implement the policy until after the student turned in the tape.

So, it is still all on them.

Two additional things that I have not seen brought up in detail about the Noah's Ark problem are the issues of fresh water and reproduction.

Assuming that enough food could be provided, what about fresh water supplies? How much space and how much additional weight would be required? If it was a global flood, then the water raining down and the water they would be floating on would undoubtedly be sea water. You cannot drink sea water. Besides drinks, there are amphibious species that would not be able to surive the flood unless they were on the Ark, and they would also need the water asa habitat.

On reproduction, I know someone brought up the genetics of single pairs of animals repopulating the entire world, i.e. Adam & Eve, but what about the time on the Ark. Unless every animal species was seperately caged, they would reproduce, increasing the space, food and water requirements. In insects, this would be especially horrendous, as their numbers tend to increase exponentially.

Are you serious? I think that historically there remains can be located verifiably. Though I've never been there myself. You do believe in history and archaology though, right? You do think that certain things can be known with relative certainy from antiquity don't you?

Really? So DO YOU believe there are facts that actually *can* be authenticated from history, or demonstrated false with overwhelming evidence. If not, you don't even belong in a discussion about "facts" in dispute in antiquity.

If someone doesn't even want to look at the evidence, they aren't allowed on a jury. I'm pretty fair about giving people the benefit of the doubt here, but you've got to bring SOMETHING other than an excuse to the table.

TFDNIHILIST, the evidence is plentiful. Do just a little research and you'll find out.

Dr. J.P. Moreland

or go to ANY library and just *begin* trying to do an objective historical study and you'll see what I mean. Objective scientific study really comes to great conclusions, and I think it's already out there.

HOWEVER, the crucifixion and resurrection of Jesus Christ are EASILY verifiable or not historically. Look it up for yourself. The (wrath of) Khan issue is a distraction that I could care less about.
