The senior Pentagon official in charge of military detainees suspected of terrorism said this week that he was dismayed that lawyers at many of the nation's top firms were representing prisoners at Guantanamo Bay, Cuba, and the firms' corporate clients should consider ending their business ties.

The central factor neccessary to understand in order to grasp where we are at present is the following.

Corporate forces have managed to corrupt and infiltrate the governemnts of almost every western so-called democracy to the point where policy is insulated from public opinion.

That's kinda important so Spud'll repeat that really loudly fer the hard of thinking....

POLICY HAS BEEN INSULATED FROM PUBLIC OPINION!

Wot that means, in short, is that yer opinion, yer vote, yer thoughts, yer ideas about how yer country should be are completely divorced from wot policies your governemnt enacts.

Spud is of course oversimplifying.

There is token lip service democracy of a kind but in the main you will find Spud is correct.

Only by increased co-operation between the great powers and a political awakening to this largely unreported fact by a large enuff chunk of the general populace can even begin to amass the kinda political will needed to solve this seemingly intractable problem.

This does not seem forthcoming.

After all, prosecutors often make the switch to the defense, and American lawyers pride themselves on being able to argue both sides.

Interestingly, our law is based on the English model, and yet the Barristers believe their job is to find the truth of the matter even if it impugns and condemns their client.

Maybe we should just start over.

These are NOT POW's according to Bush. They're enemy combatants. Some Bushit term created so he can deny them POW (Prisoner of WAR) status. This is war (Your words)

Enemy Combatants are accorded the same Protections in all respects as a POW. Protocol 1 states and I CandP it for You here

4. A combatant who falls into the power of an adverse Party while failing to meet the requirements set forth in the second sentence of paragraph 3 shall forfeit his right to be a prisoner of war, but he shall, nevertheless, be given protections equivalent in all respects to those accorded to prisoners of war by the Third Convention and by this Protocol. This protection includes protections equivalent to those accorded to prisoners of war by the Third Convention in the case where such a person is tried and punished for any offences he has committed.

The Second Sentence of Paragraph 3. States.
Recognizing, however, that there are situations in armed conflicts where, owing to the nature of the hostilities an armed combatant cannot so distinguish himself, he shall retain his status as a combatant, provided that, in such situations, he carries his arms openly:

A person who takes part in hostilities and falls into the power of an adverse Party shall be presumed to be a prisoner of war, and therefore shall be protected by the Third Convention, if he claims the status of prisoner of war, or if he appears to be entitled to such status, or if the Party on which he depends claims such status on his behalf by notification to the detaining Power or to the Protecting Power. Should any doubt arise as to whether any such person is entitled to the status of prisoner of war, he shall continue to have such status and, therefore, to be protected by the Third Convention and this Protocol until such time as his status has been determined by a competent tribunal.

If a person who has fallen into the power of an adverse Party is not held as a prisoner of war and is to be tried by that Party for an offence arising out of the hostilities, he shall have the right to assert his entitlement to prisoner-of-war status before a judicial tribunal and to have that question adjudicated. Whenever possible under the applicable procedure, this adjudication shall occur before the trial for the offence. The representatives of the Protecting Power shall be entitled to attend the proceedings in which that question is adjudicated, unless, exceptionally, the proceedings are held in camera in the interest of State security. In such a case the detaining Power shall advise the Protecting Power accordingly.

3. Any person who has taken part in hostilities, who is not entitled to prisoner-of-war status and who does not benefit from more favourable treatment in accordance with the Fourth Convention shall have the right at all times to the protection of Article 75 of this Protocol. In occupied territory, any such person, unless he is held as a spy, shall also be entitled, notwithstanding Article 5 of the Fourth Convention, to his rights of communication under that Convention.

You have a real problem with the idea of justice.
It is not a one-way street.

When you base a war on a lie, cherry pick information to inflate opintion and continue to mistate what you are doing, change the basis that the military law is based on, have no plan, and do everything to provolk and make enemies-what do you expect.

This isn't an argument about if the POW's in Gitmo deserve legal representation. This is an argument against some military mouthpiece who thinks he can blacklist American companies because he disagrees with their charity work.

But maybe Stimson has a point. Maybe there should be a boycott - but it should be a boycott of all American corporations until they can force regime change and restore some order of law and democracy to Americans.

Neil Sonnet has the right to state the case for the defense. I have a right never to use him again. How is that "a real problem with the idea of justice.".
