After Seattle TV station KOMO sued the city because public information requests for police dashcam videos were not fulfilled, the city sued attorney James Egan because he asked for the videos. "I am shocked," Egan said. "What the police department is saying is if you make a request for public documents, ultimately you will be sued."

Other than withholding video while an investigation is ongoing, is there any other reason to keep it from the public? I can't think of a good one. Video/audio is there to record exactly what is going on and if that proves good/bad for the cops or good/bad for the suspects, the truth should win out. Otherwise a police state is what we get.

Probably for the same reason the public has no right to demand security footage from a McDonald's. Without a subpoena, you shouldn't HAVE access to random videos of someone doing their job. Just because someone is paid with tax dollars does not mean footage of them doing their job is available to the public because "maybe" someone's not doing their job right. This is a very tricky balance between privacy and public good, but I'd err on the side of caution and require specific subpoena for specific footage. After all, if this lawyer can't find a judge to agree with his need for that footage, then just maybe he's going on a witch hunt.

That said I'm not sure what the fuck the countersuit is for. But then none of the news stories actually say (I'd like to see a link if anyone has one). The Seattle PD have enough problems without suing a guy who makes a request they can simply reasonably refuse, and then work that out in court properly.

If you voted for Republicans or Democrats in the last 40 years, you actively supported the current police state.

The Seattle Police Department's lawsuit would qualify as a SLAPP suit in California and be thrown out. Then the Seattle Police Department and individual police department personnel who made the decision to sue would be open to a suit for malicious prosecution and the individuals (but not the Police Department itself) would be open to punitive damages. I would not be surprised if there were a similar SLAPP suit law in the State of Washington.

As employees of the public their on the job records belong to the public, unless there is some compelling reason to keep a record hidden like an ongoing undercover investigation.
