U.S. District Judge Lewis A. Kaplan blocked the government from calling a man who authorities said sold explosives to Guantanamo detainee Ahmed Khalfan Ghailani. Defense lawyers say investigators only learned about the witness after Ghailani underwent torture at a secret CIA-run camp overseas between 2004 and 2006.

Sounds about right. That's the trouble with using information obtained through torture. The government would have done better to assassinate these people if they were so sure of guilt. So easy for an accident to happen at Guantanamo.

Obama's White House has spoken out against gathering information through torture or other 'enhanced interrogation' methods. At least they did in the past.

Now it seems they are fighting for such acquired information.

trial held in ny..right?

hhhhhhhhhmmmmmmmmmmm

so what happens if he walks???

it's unfortunate, but the right decision.

kind of like if a cop misuses evidence or fails to read the rights to a killer.

i don't think he would be released even if the trial goes in his favor.

i'm sure the CIA has a way to detain him for some reason.

I thought Gitmo was supposed to be closed long ago.........like two years ago..........like Obama promised..............wtf?

They did close Gitmo, but found the years of abuse, torture, and locking innocent people up with actual terrorists has made pretty much everyone we had there too dangerous now to release. Now we have no clue what to do with them.

On May 20, 2009, the United States Senate passed an amendment to the Supplemental Appropriations Act of 2009 (H.R. 2346) by a 90-6 vote to block funds needed for the transfer or release of prisoners held at the Guantánamo Bay detention camp.

it seems the Senate doesn't want it closed.

kanre...yeah right

BY THE WAY....further along in book on west point...now the 1846 grads are HAZING a younger plebe who just arrived...his name was sam grant..didnt like to go by his given name......
I wonder if there was any PAYBACK later for that hazing....

They closed it in that no more people are being sent there. There are still lots of people there for the reason I posted in #6.

post 7...and WHO was running the senate then???

Big money campaign contributors.

let's not forget that there are no comprehensive files concerning many of the detainees.

the entire operation is a cluster-fuck and is not easy to fix.

Obama is trying to go through proper proceeder.

"There are still lots of people there for the reason I posted in #6."

did you miss the fact that the senate blocked the allocation of funds needed to transfer or release them?

"and WHO was running the senate then???"

the dems. though neither side wanted it to happen, but i guess that doesn't matter to you.

90-6 is not very close, i'm not sure of the party of the 6, but in either case both sides voted primarily in unison.

I'll bet this pissed off obama

did you miss the fact that the senate blocked the allocation of funds needed to transfer or release them?

Try to not be an asshole.

What I am saying is WHY they blocked the funds to move them.

in the hopes of bipartisanship this morning...lets look at this from the national review

"thanks barry"

#15, sorry i was still stuck on fishpaw's post.

i shouldn't have attributed his points to you.

so what happens if he walks???

Not if but when. They have no case against him now.

"They closed it in that no more people are being sent there."

#21, you mean working with the local government to try and kill terrorists?

they are not on US soil and not part of a US institution.

therefore US laws are not applied.

different circumstances call for different measures.

Good job Obama - setting the scene for his terrorist friends to not only walk, but to get "free" citizenship and probably a nice cash settlement (courtesy of the US taxpayers) to boot!

There is a distinction between coercive interrogation of combatants and torture, but Obama has seen to it that it's all called torture. Win: Obama/terrorists - lose: us.

Bring these enemy soldiers onto US territory, which grants them constitutional rights they would not otherwise have. Win: Obama/terrorists - lose: us.

By fiat, apply the rules of a criminal court (e.g. reasonable doubt, rules of evidence) to what was throughout history the purview of a military tribunal. This applies, retroactively, and ridiculously, the rules of Miranda and chain-of-custody evidence rules to foreign battlefields. Win: Obama/terrorists - lose: us.

The enemy is laughing their asses off at us, and the fool that we elected as president. When the tables were reversed, they simply dragged the "suspects" through the street until they were dead.

But our leader can't even move a few hundred helpless sandal-wearing prisoners elsewhere, despite his pointless promise to "shut down Gitmo". But while moving the prisoners should have been trivial (and orrelevant), Obama somehow managed to accomplish one thing: endanger Americans (and New Yorkers in particular) by moving the trials to NYC. If that Times Square bomber had been just a little less incompetent, the blood would have been on Obama's hands, not that he would acknowledge it, or even care. He's already stated that further USA terrorist attacks are acceptable.

"Now it seems they are fighting for such acquired information."

"Good job Obama - setting the scene for his terrorist friends to not only walk, but to get "free" citizenship"

so which is it?

is Obama for or against it, he seems to be bashed by the right for both of the views here.

#23, so it is Obama's fault that a judge decided that torture was wrong and that coerced statements can't be used in courts?

yeah, before Obama no one ever heard of that and he called the judge up and told him what to do.

I thought Gitmo was supposed to be closed long ago.........like two years ago..........like Obama promised..............wtf?

Due process is slow... even under normal circumstance... besides where was he going to put the inmates until they were convicted or exonerated? Mainstream prisons would have been a death sentence for them. Especially considering how many republiclown hot heads work or live in the prison system.

GITMO seems to be the most secure place they could have been. The closing GITMO concept did not presume that those held there were all innocent and therefore should be released... it did mean that they would be given due process which was the real problem GITMO posed. The process carried on there during the Bush-administration was contrary to the constitution.

There should be a place where suspected terrorist are held during the prosecution phase...GITMO works for me... they should not be tortured... and they should be given due process while they are there.

STFU moron. all easy questions that were asked and answered when he chose to make a dumbass promise like that.

dont' get me wrong...I don't give a fuck that he lied. He is a politician and the letter beside his name means nothing to me (I know......it means EVERYTHING to an idiot like you)

go fuck yourself you ignorant pussy... it takes more to actually hold the moral high ground...which is what you repbliclown fucks were always marketing yourselves has having.... to drag a person through the streets?... that is what KKK used to do to "nigga men" when they looked at a white woman... that where you want to go? Stupid fuck.

it was the right decision - if you treat these assholes like American citizens and give them all our Constitutional protections. Holder fucked this up, and if these fuckers come back and hit us after their out for lack of evidence, Holder/BO will be to blame.

now, it's the worst of both worlds. you have terrorists getting constitutional protection when they're trying to blow us the fuck up --- and you have the administration trying to water down constitutional protections that should be afforded to all American citizens/non-enemy combatants. two words - fucked up....

if they are tried in the US they must follow US law.

By whom asshole? Bush-hole and his ilk? Deflect all you want... where are you going to send them to receive due process? What's the matter the question too deep for your little shallow awareness to wrap around? Fucking lameass idiot.

Holder fucked this up, and if these fuckers come back and hit us after their out for lack of evidence, Holder/BO will be to blame.

Well guess what dip shit that already happened November 2007 under the Bush-hole administration... hence the heavy consideration... so go fuck yourself.

Obama had a reason to change his approach... Here's the link dick wad...

housing domestic prisoners is a problem due to budget cuts... GITMO is the best place for them to be... but I know you don't get that... you obviously aren't too bright... your dribble is typical of the conservatron "Obama broke his promises" clap trap permeating this site... as if changing conditions don't' demand a change in plans or approach... ignorant assholes...so feel free to STFU

If that Times Square bomber had been just a little less incompetent, the blood would have been on Obama's hands

Okay, how much blood does that put on Bush's hands, from another NYC terror attack that was somewhat more successful?

Absolutely the correct decision by the judge. That travesty is, this should never have been.

I wonder who's neighborhood he'll move into when set free by this court? I personally hope it's in Dahlgren, Virginia.

"Judge Bars Torture-Obtained Evidence"

Oh well, at least I am comforted in knowing another POS got what he deserved. Man I hope it took him a year to finally crack.

Because as we all know....Torture Werks! ™

Mo? Well, at least it makes Crispee happy to know SOMEONE is getting tortured anyway.

powerfully correct... and righteously moral.

Cheney told me these people were bad and that's almost as good as God coming down and whispering directly into my ear.
