ACORN has dropped a lawsuit against filmmakers James O'Keefe and Hannah Giles and web publisher Andrew Breitbart over a hidden-camera video that showed its employees giving advice to the pair, who were claiming to be a pimp and a prostitute. The group's attorney said that it withdrew the case before a deadline to serve O'Keefe and is likely to refile, reports AP, but Breitbart's Big Government site claims that a judge dismissed the case.

Under Maryland's Wiretapping and Electronic Surveillance Act, it is unlawful to tape record a conversation without the permission of all the parties. See Bodoy v. North Arundel Hosp., 945 F.Supp. 890 (D. Md. 1996). Additionally, recording with criminal or tortuous purpose is illegal, regardless of consent. Md. Code Ann., Cts. & Jud. Proc. 10-402.

Disclosing the contents of intercepted communications with reason to know they were obtained unlawfully is a crime as well.

Violations of the law are felonies punishable by imprisonment for not more than five years and a fine of not more than $10,000. Civil liability for violations can include the greater of actual damages, $100 a day for each day of violation or $1,000, along with punitive damages, attorney fees and litigation costs. To recover civil damages, however, a plaintiff must prove that the defendant knew it was illegal to tape the communication without consent from all participants. MD. Code Ann., Cts. & Jud. Proc. 10-410.

"The Association of Community Organizations for Reform Now (ACORN) announced Thursday it had filed a lawsuit against James O'Keefe, Hannah Giles and Breitbart.com LLC for what it alleged was "illegal videotaping" of ACORN employees in Baltimore.

The group filed its suit in the Circuit Court for Baltimore City and is seeking "a preliminary and permanent injunction against further distribution" of a hidden-camera tape made by O'Keefe and Giles that aired on BigGovernment.com, a Web project of Andrew Breitbart's Breitbart.com company, along with compensatory and punitive damages.

ACORN's general counsel, Arthur Schwartz, said the acts of O'Keefe and Giles in making the hidden-camera taping were "clear violations of Maryland law."

By dropping the suit the way it did, ACORN showed that it wasn't serious about filing it in the first place. Instead, they just wanted publicity against O'Keefe, Giles and Breitbart.

This is not over.

I suppose the FBI, police, etc cannot video/audio record their undercover sting operations, buy/bust ops, etc and have it be admissible as evidence against the accused? Like the cops are going to tell the perps that they are being recorded?

Been absent for years---the good news was the advent of cable and the internet where the propaganda and bias of the leftwing media (NBC, CBS, and ABC and various newspapers) could be challenged and balanced with news long ignored, twisted and modified.

Ignore it if you choose, it is a free market.

The issue in the past however (since eliminated due to the internet) is that only one side was being delivered and passed off as "objective". This of course was a lie and now many Americans understand this.
