The White House has been working behind the scenes to prepare for the possibility of one, and maybe two Supreme Court vacancies this spring. Court watchers believe two of the more liberal members of the court, justices John Paul Stevens and Ruth Bader Ginsburg, could decide to step aside for reasons of age and health.

Barry has alerted some of his radical buddies about the possiblity of appointment to the SCOTUS so they can get out of their lawn chairs and sober up because their might be a mandatory drug test in their future.

I always viewed miers nomination as a cynical move to make roberts seem more acceptable, though from what I could tell he was qualified for the noimination.

Cel, you should realize two things:

1) "pissing off the Repubs" is a stupid reason to nominate someone to a lifetime appointment to the Supreme Court.

2) typing in all caps does NOT make your argument stronger, better, clearer, or more insightful.

I believe Ruth BAder Ginsburg has a duty to her country to resign soon enough so that her replacement may be selected before the end of Obama's term. It is just not smart for her to remain in her position if there is any chance that a Republican president would appoint her replacement. Nothing against her but she should consider future generations who will be stuck with the decisions of a radical right wing court and we are either already there or very near it.

The Republicans need to remember two little words...Philly and Buster. Force homey to send a competent and qualified candidate...not some racist like he did last time. It would be nice if he could find someone that had actually READ the Constitution....

Are you honestly suggesting that Sotomayor is not competent?
Are you honestly suggesting that Sotomayor is not qualified?

If so, what makes you think she hasn't?

Do me a favor: Name a SCOTUS opinion of hers (be it majority, minority, concurring, dissenting, whatever) that you disagree with, and explain why.
And do so using arguments that make it very clear to us that you've read the Constitution.

I really don't have time to do a complete analysis of her opinions for you. However, I have read the Constitution. I can pick three examples of her previous rulings (I am not going to be confined to the SCOTUS opinions...it is not like her judicial history began there...besides, I see ONE opinion that sh WROTE and several that she merely "joined".)

1. Second Amendment - Maloney v. Cuomo. She contended that the Second Amendment has never been applied to the states and therefore decided a private citizen does not have a right to bear arms that is protected from his state government. A plain reading of the 14th Amendment applies the basic rights and protections to the states.

2. Discrimination - Ricci v. Desteffano - the Firefighter case. Finding that the City could void an objective promotion test on the basis that only white people performed well enough to be advanced. (This one was OVERRULED by the Supremes later....maybe they concluded she didn't understand "Equal Protection" also.)

3. Property Rights - Brody v. Village of Port Chester - Permitted the taking of private property for "Public use" in a "redevelopment" project. This is violative of the 5th Amendment "taking" clause. "redevelopment" is not a "public use".

Um, Rob, does it ever occur to you that we libs are trying to be decent by considering Chief Justice Roberts' epilepsy to be out of bounds as fodder for jokes?

What somebody is by birth or medical history should be off limits in this kind of discussion. What they do is where the comedy is, or should be.

While I thought that Sotomyers' opinions in the firefighter case were wrong, and the comment about a 'wise latina' were troubling, I don't believe either of those makes her unqualified. If BO gets to pick other candidates, I believe they will represent his belief that feeling is more important than law, and that the ends justify the means. If you have results, like the firefighter tests, and you don't like the results, then simply change the rules. If states pass laws that you don't like, simply ignore them, or throw them out.

I have a problem with this approach to law. I think it is dangerous. I don't KNOW that BO's future nominiees will take this approach... but I am quite sure that is what he will be aiming for.

I thought the job of a judge was to interpret the law (as passed by legislative bodies).

But let's ignore those legislative bodies, okay? Don't you feel better now?
