(CNN) -- A judge has ruled that the famous flute riff in Men at Work's Australian rock anthem "Down Under" plagiarized a popular nursery rhyme about a Kookaburra written in 1932.

A song recorded in 1981 (29 years ago), copied a nursery rhyme written in 1932 (78 years ago).

I have to agree. This is absurd.

As far as I can tell, there's a five note sequence they both share.

Seriously, five notes is plagiarism?!?!?! Pfffft!
