It seems the Pentagon has changed its mind on gays in the military; President Obama has begun pushing hard, to surprisingly little resistance. Tomorrow, Tuesday February 2nd, the first Congressional hearing on the issue in 17 years will take place; it seems that the issue is not if "Don't Ask, Don't Tell" will be repealed, but when and how:

I wonder what type of lawsuits could arise from gays fired from the military in the past.

I'm not wise in the legal ways, I know there are a few lawyers on this site, is this anything the Pentagon should worry about?

No lawsuits. If gays were discharged from the military under the "Don't ask, don't tell" policy in place before, they could not bring an action today for the military having upheld the law in place at the time.

Gays previously discharged, though, might be allowed to re-enlist if a new law now allows gays in the military. And if they are allowed to re-enlist, there may be a few lawsuits demanding they want to be reinstated at the same military rank and rate of pay they had been receiving when they were let go.

I'm not a lawyer, though.
