U.S. intelligence agencies were aware months ago that Army Major Nidal Hasan was attempting to make contact with people associated with al Qaeda, two American officials briefed on classified material in the case told ABC News.

A fellow Army doctor who studied with Hasan, Val Finell, told ABC News, "We would frequently say he was a Muslim first and an American second. And that came out in just about everything he did at the University.

Finell said he and other Army doctors complained to superiors about Hasan's statements.

"And we questioned how somebody could take an oath of officebe an officer in the military and swear allegiance to the constitution and to defend America against all enemies, foreign and domestic and have that type of conflict," Finell told ABC News.

But there are questions to be asked and I suspect many of the answers will be unsatisfying I also suspect we will see memos or some kind of paperwork on Nidal Hasan that will prove embarrassing to officials in the FBI, our intelligence services, or the military. There are many stories to relay relating to Hasan here's just one, reported by the AP: "Fellow students of Hasan in a military training course complained to the faculty about Hasan's anti-American propaganda,' but said a fear of appearing discriminatory against a Muslim student kept officers from filing a formal written complaint."

Maybe so. But given the long chain of other stories about Hasan, there had to be paperwork. There had to be knowledge. And if nothing else, nothing else, questions as to why a formal investigation was not opened up on him after the FBI tracked Internet postings about suicide bombings by someone with his name remain. Questions as to why he would cite his nationality as Palestinian when he was born in Virginia remain. Questions as to why colleagues stated they were uncomfortable referring patients to him remain. Questions as to how you can have a member of the U.S. military's fellow doctors recount that they were repeatedly harangued by Hasan about religion and that he openly claimed to be a "Muslim first and American second" remain. Questions as to how a member of the U.S. military can speak of infidels deserving to have their throats cut and have boiling oil poured down their throats and can stay in the military remain.

Questions as to why all this can at once remain true and he can be quoted as saying he wanted a discharge from the military and nothing was done remain.

I just offer this, the Code of Military Conduct:

I will make no oral or written statements disloyal to my country and its allies or harmful to their cause .... I will never forget that I am an American, fighting for freedom, responsible for my actions, and dedicated to the principles which made my country free. I will trust in my God and in the United States of America.

Final thought: If we can discharge officers and enlisted personnel for being gay, we can separate them and discharge them for being Muslim radicals, can we not? Or has, indeed, political correctness so infected our institutions that the U.S. military is now affected, too?

You could certainly classify the guy as a terrorist and I never said otherwise. Hardly. Article 104 is the "Aiding the Enemy" part of the UCMJ, the violation of which introduces the possibilty of a death sentence. You have to do a whole hell of a lot more than harbor unpopular thoughts to trigger that one into motion.

First, though, I'd like to see those who get jiggy about Muslims in the military thrash out what they mean by that term, "Muslim radicals." Conceivably, it might run the gamut from a guy who likes to eat bacon in the morning all the way to Osama Bin Laden.

No, give him life without parole in a women's prison.

Turns out this guy had hired a lawyer and gone to Military Court in order to get a discharge. This was triggered by his orders to go to Afghanistan. The Court refused his request and he went apeshit.

Previously another trooper's orders were rescinded when he claimed he wouldn't go to Iraq/Afghanistan, because Obama is not our legitimate President (not a natural born citizen).

Its supposed to be an all volunteer military, in order to avoid these life changing problems, but this is enforced in a schizophrenic way. No more so than when Shrub violated the rules.

Nidal Hassan is a hero. He is a man of conscience who could not bear living the contradiction of being a Muslim and serving in an army that is fighting against his own people. This is a contradiction that many Muslims brush aside and just pretend that it doesn't exist. Any decent Muslim cannot live, understanding properly his duties towards his Creator and his fellow Muslims, and yet serve as a US soldier. The US is leading the war against terrorism which in reality is a war against Islam. Its army is directly invading two Muslim countries and indirectly occupying the rest through its stooges.
Nidal opened fire on soldiers who were on their way to be deployed to Iraq and Afghanistan. How can there be any dispute about the virtue of what he has done? In fact the only way a Muslim could Islamically justify serving as a soldier in the US army is if his intention is to follow the footsteps of men like Nidal.
The heroic act of brother Nidal also shows the dilemma of the Muslim American community. Increasingly they are being cornered into taking stances that would either make them betray Islam or betray their nation. Many amongst them are choosing the former. The Muslim organizations in America came out in a pitiful chorus condemning Nidal's operation.
The fact that fighting against the US army is an Islamic duty today cannot be disputed. No scholar with a grain of Islamic knowledge can defy the clear cut proofs that Muslims today have the right -rather the duty- to fight against American tyranny. Nidal has killed soldiers who were about to be deployed to Iraq and Afghanistan in order to kill Muslims. The American Muslims who condemned his actions have committed treason against the Muslim Ummah and have fallen into hypocrisy.

Terrorist organizations have political goals and terrorism is the means they use to advance those goals. No matter how decentralized they are, many individuals may have a hand in plotting, rehearsing, and coordinating their attacks. It's a team effort.

To the families of the people who died, the difference may seem insignificant. It's an important distinction to make because the government can deal with terrorist organizations but it is extraordinarily difficult to prevent attacks by a deranged lone gunman.
