"How in the hell would posting the complete version of that Sinatra song hurt Sinatra?"

Well, for example, singers don't get a residual when songs they sing air.

The owners of the writing copyright, and the owners of the publishing copyright do.

Just in time, Mr. Hollywood Shill shows up to defend the corporate thieves.

We're just trying have fun and play some music here, Mr. Hollywood, a task made more difficult due to shills like you, but anyway, this is a music thread. Take a hike.

#74

Just in time, Nulli pretends copywritten property he obviously values enough to post has no real value.

The vast majority of songs written since the dawn of time are not under copyright. Leave it to Nulli to insist on using one of the few that are still protected (admitting by its use it has value), and then contend it should have no value. I guess thieves will go to any length to justify stealing.

Play away, Null...just don't pretend it has no value, right after proving it has value by posting it.

See #75.

"See #75."

Keep whining, crybaby.

Illegally download any songs lately?

This was a real nice music thread until some corporate whore representing the entertainment cartel showed up, like a skunk at a garden party.

If Hollywood corporate shills had their way, this music thread couldn't exist.

"Yeah...how dare the creators actually own what they create."

The old 'art vs commerce' argument...

It's always the 'entertainers'(commerce) who cry about losing all their money to the internet. Real 'artists' seem happy to share their work online. And many even encourage fans to record live shows and share them online. Struggling musicians like myself generally welcome fans posting unauthorized videos on youtube.

Apparently Danforth is high enough up the artistic food-chain and has no need for free publicity. Congrats!

Yeah, Null, your position is quite clear. You believe after one public play, you should be able to steal whatever you want, and pretend it has no worth, despite the fact it's worth enough for you to steal. You'd only pay Prince for one recording, and Steven King for one book sold, and Robert DiNiro for the hours he puts in on the set. (Minimum wage, of course.) Then you'd steal it, and use it as you wish. Probably because you've never produced anything of value anyone else wanted.

Carry on. I guess thieves will say anything to justify their thievery.

"Real 'artists' seem happy to share their work online."

Spoken like someone who steals what 'real artists' produce. And who believes "real artists" don't or shouldn't get paid for their work.

Because God knows a song only takes the same amount of hours worked on as it does to play.

"Apparently Danforth is high enough up the artistic food-chain and has no need for free publicity."

Apparently MrSoul62 thinks artists can pay their bills on "free publicity".

BTW, your boss called. He thinks you should work the next month just for the "free publicity". He promises he'll speak well of you online.

Since you're playing the guessing game about me, let's try you...

I'm guessing you do commercials...a handful of one-line, walk-on roles on television's finest sitcoms...coupla shitty indie films...but I bet your cash cow is doing Jack Sharkey plays in our nation's finest dinner theaters...

Which leads me to believe you don't have a clue how struggling musicians are using the internet these days.

You're haughty little thespo aren't you?

"Fuck off, corporate teabagger."

Awwwww....the thief hates being called out.

He doesn't believe in property rights of the creators, and believes it has no value, until, of course, he wants it. Then it's valuable enough to want, and valuable enough to download, just not valuable enough to compensate. So he bags on the owners of the copyright, and whines when he can't post the entire song, because the owners have the unmitigated gall to value something he values. No matter the vast majority of songs written since the dawn of time aren't protected by copyright, he wants one of the few that IS protected, and cries every time someone suggests he actually compensate the owners.

A thief is a thief is a thief.

And the proof? He wouldn't be caught dead sending money to the artist. Instead, he hides behind a lame ass excuse -- the corporations are making money -- as the pretend reason he isn't paying a dime.

"Which leads me to believe you don't have a clue how struggling musicians are using the internet these days."

Sure I do: as a method to give away free stuff they've worked hard to produce, since artists shouldn't be paid, and they do it for the love of the 'real art'.

I've qualified for pensions when I retire from a pair of performing Unions. And had I been stripped of all credits the day I qualified, I would have qualified again. And had I been stripped of all credits that day as well, I would have qualified yet again. I've had about 2,000 jobs in "the business" in my career, and have qualified for health care through one Union (or two, or three) every year since I joined my first Union 28 years ago.

I also was recently designated a Subject Matter Expert by my state in the area of arts and business, and received a grant (unsolicited) to teach fellow artists what I know. Like you, I've made a living doing what I love. Unlike you, I believe in compensating royalty artists. One of the first and best lessons I learned in performing arts college was "if you're going to do it for a living, don't give it away for free." You've opened for national acts? Good for you. I've worked alongside Oscar winners, Tony winners, Emmy winners, Golden Globe winners, and Grammy winners. I've been aged, burned, frozen, shot, and shrunk. Yes Metallica and other hugely successful bands lose a little money due to illegal downloading. Most of the bands I like and most of the bands like mine, don't lose that much. It's a chance to get the music to a wider audience. The music business is changing drastically...for the better in my opinion. A band is able to produce, promote, and sell their music with total independence, using the internet now. It's still hard to hit the big-time this way, but that day is coming. For most bands, the days of making big money from recording, are coming to an end. Live music is the real money-maker for the working band. You've got to have fans to make it on the road. The internet and music-sharing has increased our fan based considerably.

That's it for me Danforth...I think we can agree, we both failed at the assumptions game.

So tell us, Null...how much do you send to the artists when you illegally download their songs?

"The music industry is finally paying the price for forcing people for more than a generation to buy albums with 10 crap songs in order to get the one or two you may like."

Bullshit. They're offering one at a time, and over 90% are being stolen anyway. Your argument doesn't hold water...most of the downloaders probably never bought an entire CD in their lives. Instead, they got used to getting it for free, and simply graduated from Napster to whatever torrent site Null is using to rip off artists.

" whatever torrent site Null is using to rip off artists."

Another version of Perfidia...hopefully the great grandchildren of Glenn Miller, assisted by Danforth, won't sue me...

www.youtube.com

Danforth,
There's a new business model in music. You either have to figure out how to make money without album sales(not really a prob for most musicians, it's the way they been doing it all along), or find new work.

If it wasn't for a mic check I wouldn't have a check at all...
www.youtube.com

"The raw dollars, not even adjusted for inflation, have been dropping precipitously for years."

And here's another mistake they make... they think that every illegal download is a sale that would have happened were it not available for free, and that is a mistake in logic. THe fact that it was downloaded illegally does not mean that person would have paid for it otherwise. Many would go without. But arguing like that is a way to ignore the bigger possible issues, i.e. that maybe people don't feel that the product is worth paying for, not because its just as easy to get it for free, but because the product isn't as good as it used to be and people are earning less than they were before so theyhave less money to spend. Especially kids, who drive the music market largely, are dealing with greater unemployment than every one else.

"Too bad you don't have anything to sell of value"

Now Mr Dinner Theater turns judgmental with his assumptions.

I'm betting you don't have financial leverage with any Hollywood/Broadway producer because of your box office power.

Being someone's stage puppet hardly qualifies you as an artist. Nor does being a pompous ass.

"Now Mr Dinner Theater turns judgmental with his assumptions."

What do they call them in LA anyway? It can't be, "off Broadway". Off Sunset, by any chance?

"Bullshit. They're offering one at a time, and over 90% are being stolen anyway. "

I'm saying that they created a climate over time and they're dealing with that karma. They had to be forced to offer one at a time, if you remember, and even now, they are trying to push the price of each song up. I worked for a major label under the VP who was responsible for new media sales and let me tell you that they invision $24+ per album by song (no album is worth that)and its the illegal downloaders who keep them at bay, because the remaining honest purchasers are far easier to alienate from buying music due to high prices.

Typical Null. He won't answer the question -- it would expose him for the thief and hypocrite he is -- and instead assigns a position to me I not only never took, but specifically said was fine with me.

But he won't admit he's hiding behind the "corporate thieves" argument just to skirt around the fact he's the thief himself. It's not like he's paying the artists directly. Instead, he's ripping off the people he's pretending to respect.

"There's a new business model in music."

Why? Just because someone found the key to open the vault?

Are you actually claiming copyrighted songs don't belong to the creator? Or do you think it's okay to steal, just because you probably won't get caught?

"they think that every illegal download is a sale that would have happened were it not available for free, and that is a mistake in logic."

I've never heard them claim that...their claim is over 90% of the copyrighted downloaded songs are downloaded illegally. They've also shown a drop, year after year, in revenues, even without adjusting for inflation.

" they invision $24+ per album by song"

Maybe because they have to deal with the 90% who're stealing the product. if everyone paid instead of stealing, they could make the same revenue at less than $3 a pop.

Gee, what a tough bet. That only covers about 99.995% of all artists.

"Being someone's stage puppet hardly qualifies you as an artist."

No, but my work with the best in the world over nearly 30 years probably does. At least I've got two pensions, from Arts Unions, waiting for me. What do you have, after giving your product away?

I want to offer an apology to Hagbard. I'm generally one of the first to enforce the 'play nice' policy of the Music Thread. So I'm sorry for my part in tonight's devolution. Should you host the thread again Hagbard, I promise to 'play nice'.

As penance, I shall post three killer tunes before I retire for the evening.

"not because its just as easy to get it for free, but because the product isn't as good as it used to be "

I hear that all the time, yet downloads are at an all time high. The very fact it's being downloaded means it has value to the person seeking it. Meaning it's valuable enough to steal, just not valuable enough to pay for. Bullshit. The real reason is someone invented a Universal Key, and thieves are convinced -- probably correctly -- they won't get caught.

"Drawing blood, every day..."

So how much do you send to the artists after you download their songs, Null?

Because if it's "nothing", your 'corporate thieves' argument doesn't hold any water. The only thief in that equation is you.

Shinedown gave away "Devour" on their own damn website.

Nick Cave

www.youtube.com

(Psst, Mr Barrymore, I think it's time to let the final credits roll.)

But he won't admit he's hiding behind the "corporate thieves" argument just to skirt around the fact he's the thief himself. It's not like he's paying the artists directly.

Hey Dumbforth the corporate whore: when you can guarantee me that 90%...hell, even 50% of my dollars spent on a cd will go to the artists that created it, get back to me.

"when you can guarantee me that 90%...hell, even 50% of my dollars spent on a cd will go to the artists that created it, get back to me."

That's easy: you can find out who represents them, and send it directly to the artist, care of the manager or agent. Don't blame me because you're not just a thief, but a lazy thief as well. You're still hiding behind the "corporate thieves" lie, but as long as you're not sending a dime to anyone, the only real thief is you.

"Dumbforth"

Gee, if that's your level of creativity, no wonder you have to steal from actual artists.

"Psst, Mr Barrymore, I think it's time to let the final credits roll."

No way!

You owe at least one more killer tune.

Possibly, but I bet you've seen more "premature" closing of the curtains than me. lol

Goodnight.

Here's one for you:

www.youtube.com

"Here's one for you:"

I appreciate that Dan...thanks.

Danforth,
I'm saying the cat is out of the bag and you're not getting it back in. Smart artists are figuring out how to work around this and it's working. On the indie side of things bands like Sharon Jones and the Dap-Kings and The Sea and Cake are making serious green on licensing. While, on the mega star level, Radiohead made a shit ton of money even after giving "In Rainbows" away online. The only people really suffering from illegal downloading are major labels, indie label profits are actually up. It's a much smarter move on an artists part to sign with an indie anymore, you get a much more favorable cut of the record sales. At a 50/50 split you can make more money selling 150,000 copies that you can on a million with a major. 150 grand isn't such a big number if you've got a good booking agent and a lot of fans from the internet. I know that it doesn't work this way in film. After you release a movie you don't go on tour performing it live and selling t-shirts and dvds. So I can see where this might be confusing for you, but it's the way it is. That's the reason you only hear people like Britney Spears and Metallica bitching about this, they spent to much on bullshit to be profitable in this market.

Now we've got that peaceful Music Thread vibe back...cool!

G'nite all.

Last one and I'm going to bed, not that anyone listened to any of my links anyway. Ya'll missed out, I've been dropping gems all night!

"making serious green on licensing."

Only because of copyrights, and honoring those copyrights.

"indie label profits are actually up."

Link?

"After you release a movie you don't go on tour performing it live and selling t-shirts and dvds."

You're also limiting most income to touring income. Steely Dan, for example, would never have existed. Bands that want to write, but not tour constantly, are doomed.

You're probably right that the cat's out of the bag, but it's still stealing what doesn't belong to you. Use that model with authors, and the entire book industry collapses. Use that model with movies, and all you're going to end up with is short viral videos. It's not just the Britneys and the Metallicas; the folks who are really hurt are the ones who (used to) sell several thousand CDs. Now, one person buys it, and posts a perfect digital copy for the closest 10,000 friends he never met. And unless these small-to-mid-level bands are willing to spend the majority of time on the road, they can't make a living.

"Now we've got that peaceful Music Thread vibe back...cool!"

Yeah. It's unfortunate that Hollyweird lawyers tried to derail it. But we shall overcome.

Dan, I understand that you have a professional obligation to support an industry that has put money in your pocket over the years, but yes, the model is changing because the rules of engagement have changed. you're not closing pandora's box, and it's too bad that the industry couldn't/wouldn't foresee that change coming.

"I hear that all the time, yet downloads are at an all time high. The very fact it's being downloaded means it has value to the person seeking it. Meaning it's valuable enough to steal, just not valuable enough to pay for. "

Yes, dan, it may very well be worth taking for free, but no worth paying for. Think about that. Values have changed as a result of the technology, and if people respect a live performance more than a over-produced corporate product, that's something those who've invested themslves in the short term studio investment have to get used to. More and more, artists are gettig tired of waiting for the chance that a major label may take a notice, and are willing to put the recorded product out as an advertising expense. Soon to be gone are the days where you spend a month or two recording and a month or two touring and you're free and clear the rest of the year. You're defending a dinosaur who got a foothold in something they had no part in creating, then sucked the life out of.

Sonny Bono law anyone?

Like I said, I don't download unauthorized free music, but I understand.

"I want to offer an apology to Hagbard. I'm generally one of the first to enforce the 'play nice' policy of the Music Thread. So I'm sorry for my part in tonight's devolution. Should you host the thread again Hagbard, I promise to 'play nice'."

It ain't me, babe.

No, it ain't me, babe.

It ain't me you're looking for, babe.

-R. Zimmerman

Do I owe someone some money for that, Dan?

He can take it out of my 0% satisfaction from seeing him at Jones Beach in 2000.

"It's not just the Britneys and the Metallicas; the folks who are really hurt are the ones who (used to) sell several thousand CDs. Now, one person buys it, and posts a perfect digital copy for the closest 10,000 friends he never met. And unless these small-to-mid-level bands are willing to spend the majority of time on the road, they can't make a living."

I don't think that's necessarily a bad thing. Let them work year round like the rest of us do.

" it's too bad that the industry couldn't/wouldn't foresee that change coming."

They were supposed to anticipate outright thievery? Just because someone invented a way to steal the product?!?

"it may very well be worth taking for free, but no worth paying for."

That's called stealing. Are they actually pretending it belongs to them, or they have the right to it?

"more than a over-produced corporate product"

Again, the Princes and Radioheads of the world can afford it. Who you're really shutting out are the mid-level bands who don't want to give it away for free, and are forced to either tour, or die.

"Soon to be gone are the days where you spend a month or two recording and a month or two touring and you're free and clear the rest of the year. "

Um, yeah...the time you actually work on the art. Do you think those songs write themselves? Don't authors have to have time to write? Don't moviemakers have to have time to conceptualize, and edit? Touring is not a lot of fun, unless you have the personality for it. And if you're trying to maintain a relationship at the same time, or raise a family, it's that much more difficult.

"You're defending a dinosaur"

Yeah...I should probably just try to write jingles; at least copyrights are honored in that arena. And songwriters should just get used to the idea their original music has no real value...or at least not that anyone will actually pay for. But what do you think will happen to the JK Rowlings of the world when someone cracks the code for the Kindle?

Don't sweat it Hagbard. I mentioned something about copyright and some Hollywood copper jumped in.

Null is such a pussy. He pretends he's fighting against "corporate thieves", yet reveals himself to be the only thief in the equation. Standing up for artists against "the man", yet he's never sent any of those artists a dime, and never lifted a finger to actually try to find a way to pay them. The only person he's really looking out for is himself: a little petty thief who hides behind a lie to pretend he's all about principles, all the while stealing from the very people he's purporting to support.

If only Steely Dan wouldn't have existed, thanks for giving me something good to dream about tonight.

"Only because of copyrights, and honoring those copyrights."

Yep, if somebody wants to use your music in a movie, TV show, video game, or commercial they still have to pay for it even with the big bad internet and in a much larger amounts to the song writer/performer than from record sales.

"Link?"

That's personal experience, but you just have to look at the number of indie bands playing on Conan, Letterman, and SNL to see that it's going on. Most indies aren't exactly publicly traded, so I can't link you to any financials.

"You're also limiting most income to touring income. Steely Dan, for example, would never have existed. Bands that want to write, but not tour constantly, are doomed."

Not necessarily, see above. Bands just have to step up their hustle. Bands that just want to write have to put in their time on the road. You're right that Steely Dan wouldn't exist if they came out now, but so what? It's a stupid idea to spend that much money on studio time, dreaming about the days when labels could afford to let a bunch of dudes dick around in top notch studios isn't going to make it a good plan.

"Use that model with movies, and all you're going to end up with is short viral videos"

I believe that's pretty much what I said.

"the folks who are really hurt are the ones who (used to) sell several thousand CDs. Now, one person buys it, and posts a perfect digital copy for the closest 10,000 friends he never met. And unless these small-to-mid-level bands are willing to spend the majority of time on the road, they can't make a living."

First off, nobody's making a living off of selling several thousand CDs and not touring their asses off. Even if they recorded for free, had their dad's print shop make the packaging, and spent all day every day selling them themselves just so they could keep every cent. Second, before the internet you could only DREAM about having every person who bought your album play it for 10,000 people! Some of those people might actually like it and come and see you, or buy your songs for Rock Band, drive up your web traffic to the point that your label thinks it might be a good investment to send you on a european tour, etc...

"They were supposed to anticipate outright thievery? Just because someone invented a way to steal the product?!?"

Yes.

"That's called stealing. Are they actually pretending it belongs to them, or they have the right to it?"

That's the old way of thinking about things.

Today its called tour advertising.

Pandora meet box.

"Um, yeah...the time you actually work on the art. Do you think those songs write themselves? Don't authors have to have time to write?

Then authors are going to have to negotiate part of the tour proceeds. Rules have changed. They're fighting against the wind.

"Don't moviemakers have to have time to conceptualize and edit?"

No more time than the starving artist. Einstein had to work as a clerk while he worked out his theory of relativity.

"Touring is not a lot of fun, unless you have the personality for it. And if you're trying to maintain a relationship at the same time, or raise a family, it's that much more difficult."

There are plenty of talented musicians who are willing to do just that, solely for their dedication to the art. Artists who don't have the good fortune of being discovered.

Or ar you suggesting that the artists who make it to the big labels are the only artists who have the talent and skill to make it?

They go see the starving artists too, and steal from them all the time. Coldplay is one example of an act who's stolen entire works and produced them as their own. Pop music history is replete with stories like these. Eric Clapton? The Rolling Stones?

About time for some music on what was the music thread before the cops showed up...
