The question wouldn't be is the President a natural born citizen and the burden wouldn't be on the government/military to prove he was. The question would be did the defendant have a reasonable belief that the president would not. In essense, the defense would have to prove Obama is not a natural born citizen. She can be reprimanded, suspended or even disbarred by the state bar association where she has her license. That type of accusation is definitely not tolerated. If an American born, US citizen teenage girl gives birth in the U.S., then the kid is born American, but if she does so overseas, the kid is not???

Did it ever occure to Tadowe that you cannot court martial a soldier for challanging the law? It was not against the law or military regulations and the judge has ruled fairly. End of story. No. Conscientious objectors are different. Very. Though how a CO would end up in the military is beyond me anyway. There's a huge difference between signing up for war and then refusing to serve because you don't like your new commander-in-chief (even if you believe the birther argument), on the one hand, and averring that war is wrong and refusing to serve to begin with.

I think there also is some CO status for people who are in the military, but I don't fully get that.

REAL "conscientious objectors" are cool, so say I, a man very proud of 22 years of military service.

There are (at least) two catagories of real conscientious objectors.

One type will NEVER be in the military to begin with. If the Objector has any brains, they don't try to argue against using military force for taking out violent dictators (a good act in and of itself), but they just can't bear taking part in violence, even if in a support function.

The second type of Conscientious Objectors do join the military. The second type can't bear to PERSONALLY pull a trigger, but they are willing to do jobs like combat medic (one of the most extreme risk jobs in the military, balls of titanium steel required....).

IF REAL, a conscientious objector does NOT object to jobs that involve personal risk and possible horrible death (They could be a fire fighter).

FAKE conscientious objectors talk of "illegal wars", or "birth certificates"

I've given advice to many kids thinking of joining the military. I always start with the NEGATIVES, and tell them that if they can't get past the negatives, then stay out. One negative is that the soldier NEVER is the one to decide if a war is "legal", not even if the soldier has 4 stars on his soldier. Heck, even if the soldier KNOWS for 100% sure that it is illegal, you go, and do your job, even if that involves pulling triggers. HAVING SAID THAT, I also cover My Lai and Lt Callay. ALL soldiers, even if they have only one stripe are REQUIRED, by U.S. military law to DISOBEY and REPORT illegal orders.

Orders to deploy and conquor are NEVER "illegal Orders"

Orders to shoot unresisting non-threating non-combatants are ALWAYS illegal orders. (I give the example of Hugh Thompson as the proper response to 'real' illegal orders.....)
