Comedian-turned-politician Al Franken is now a senator. The Minnesota Democrat was sworn in Tuesday, ending an eight-month political and legal struggle, and will serve on the Judiciary Committee as it begins hearings next week on President Barack Obama's first nominee to the high court. "I'm going to put my head down and get to work," he said.

I disagree RCADE. Franken needed to show that he is more than a Comic. He needed to demonstrate that he is a highly educated and intelligent individual which he is like him or not.

A majority of people say they are pro-life but also support abortion in some form. A majority of people say they are 'conservative" but want government intervention during economic downturns. They also want government intervention in health care.

The devil is in the details.. and in a sound-bite society, the details tend to get lost.

I'd rather the questions be couched in terms of freedom.. as in.. "do we control the government, or does the government control us?" "Should your health care decisions be made by a government employee, or by you and your doctor?"

I spend time in France and Germany... great folks, (yep, even the French are very friendly to me).. but their mindset is not what has traditionally been the American mindset..

Little example.. bakeries in Germany (at least where I go) may not open before 6 AM (I think that's the time).. the people there think a rule by the government that dictates when a bakery may open is perfectly fine.. Here in the US, we would think that was a severe intrusion into the rights of the business owner.

In an even stranger example.. I was staying with a colleague at his home in a small town.. we were asked not to flush the toilets after 9 PM.. it was against the regulations.. (I guess they didn't have employees at the waste water treatment plant.. I don't really know).. but my friend was completely accepting of that decision being made by the government..

I think Obama, and most around him fully embrace that model of European socialism.. where while the government doesn't actually own the bakery.. it does, in effect, run it. I don't think most Americans, liberal/conservative/
Republican/Democrat/Whatever embrace that worldview. At least, I certainly hope not.

If you've ever had to visit someone in a VA Hospital, or bothered to look at the fraud and waste in Medicare.. (which by everyone's (Dems and Republicans) measure, medicare is unsustainable)you know full well how government health care looks.

SO the answer.. more government intrusion.. it doesn't make sense.

There are very sensible things to do.. allow small businesses and others to form associations across state lines to self insure.. would result in immediate drops in health insurance costs and would allow more people to be covered. Illinois, the Second Amendment applies only to restrictions the FEDERAL government might try to impose on individuals, but does not apply to state governments.

According to the majority opinion, "it is a limitation only upon the power of Congress and the national government, and not upon that of the state."

She ruled correctly based on established law by a higher court. From reading about her decision, she also likely felt this was a good opportunity to send a case back up to the SC so they would have an opportunity to revisit the old ruling.

The Roman Empire grew to greatness by incorporating all their conquered people into the Roman Empire as citizens. They didn't try to change their customs or religions---they gave them full citizenship and taxed them and used their men in their armies. They welcomed immigration and made the best use of their new citizens. The Roman Empire fell when it rejected immigration and refused to allow new people to participate in land ownership or citizenship in general.

Sound familiar? The horse in the senate had nothing to do with it. Franken has nothing to do with our decline. I would say the decline rests more on your shoulders than Frankens.

No, because DC is a FEDERAL DISTRICT controlled by the Federal government so that ruling does not change Presser.

Don't get me wrong, I have no problem with Presser getting overturned. But based on that precedent, Sotomayor was correct in her ruling at the lower court level.

The SC ruling changed the meaning of the second amendment completely.

The second amendment now means:

Individuals have the right to keep and bear arms, but such right may be infringed as the government sees fit.

That's a far cry from the original statement, and clearly made by five activist judges over the 4 judges who actually read the Constitution. If it can change that radically, it can change again---maybe even to the original meaning.

Individual gun rights were not in the Constitution---it was always up to the States. The second amendment was designed to protect the states from a strong, evil, central government by allowing them to form a State Militia to protect the State, since there was no other way for the citizens to be effectively protected from such an entity. That's why State Militias were allowed ALL weapon--and NO RESTRICTIONS on the weapons State Militias could have and utilize. Jets--tanks--machine guns--bazookas--stinger missiles--SHALL NOT BE INFRINGED. Too bad 5 judges can't fucking read simple words.

My understanding is that the problem is that Presser essentially says that the 2nd amendment applies to what regulations the federal government can put on individuals, but does not limit the ability of the states to impose their own regulations.

So Heller doesn't completely address that because DC is a federal district, not a state.

Anyone get the feeling that the Republicans are coming undone at the seams? Judging by the anger, bitterness and stupidity expressed by wingnuts on this thread, it seems pretty extreme.

Haven't read Presser, but if that's indeed the case, then Heller disposes of it rather quickly by relying almost entirely on cases that interpreted state firearm regulations to reach its conclusion. If anything there should have been a question raised about those cases' applicability to a federal district and not vice versa.
