The Judicial Confirmation Network (JCN) says Judge Sonia Sotomayor failed to disclose to the Senate Judiciary Committee a controversial document arguing that the death penalty is "racist" and a violation of the present "humanist" thinking of society.

The 1981 memo, they say, should have been disclosed as required under Question 12 (b) of the questionnaire that the Supreme Court nominee turned in Thursday.
"It is . . . clear that (Sotomayor) has omitted controversial material from her past in which she asserts that '[c]apital punishment is associated with evident racism in our society' and advocated public opposition to restoring the death penalty in New York state," Long wrote to the committee.

Unlike "American Thinker" -- the site referenced by the link above -- the conservative Judicial Confirmation Network presents the original June 5 story that appeared in The Washington Post (voices.washingtonpost.com). Therein the message is, "A conservative group is criticizing Supreme Court nominee Sonia Sotomayor for signing a 1981 memo that opposed the death penalty and said 'capital punishment is associated with evident racism in our society.''' Why? Because it "offers a window into her thinking on the divisive issue of capital punishment."

Bill Burton, a White House spokesman, said Sotomayor's "involvement with the Puerto Rican Legal Defense and Education Fund and its position on the reinstatement of New York's death penalty was fully disclosed to the Judiciary Committee.''

He added: "We will work diligently with the Senate to make sure that they have everything they need to confirm Judge Sotomayor swiftly and in time for her to participate in case selection at the Court this September."

Cesar Perales, president of the legal defense fund, now called LatinoJustice PRLDEF, said Sotomayor's critics are taking the memo out of context. He said it is a "fair reading" of the document to conclude that Sotomayor was anti-death penalty at the time, but he said the authors were only "recapitulating" arguments against capital punishment made by religious and civic groups.

The death penalty's arbitrary (indeed, haphazard) application raises obvious questions about the impact race (as well as wealth) has upon death sentences. That Sotomayor recognized those concerns more than ten years before she became a federal judge does not disqualify her from a seat on the Supreme Court. Nor does her expression of opinions about an issue of public importance long before she donned a black robe render her unsuitable. It would be strange to think that the only citizens who are fit to sit on the Supreme Court are those who have taken no interest in questions of public policy. Certainly, an affiliation with conservative organizations that hope to influence public policy -- most notably, the Federalist Society (pdf) -- has not been regarded as a bar to judicial confirmation.

Ultimately, conservatives want to air the 1981 memo because they expect white people to resent the charge that there is "evident racism in our society" or that American judges and juries (or prosecutors who make charging decisions) are swayed by considerations of race. Appeals to the "angry white man" are still central to the GOP playbook, but they've been rendered ineffective in a climate of anger about the white men who destroyed the nation's economy, squandered its military resources, and crippled its government. However the card is played -- whether Sotomayor is labeled a racist or painted as an angry Latina who makes unfair charges of racism -- it won't give the conservative faithful a winning hand.

Probably was a few in there that would be done for racist reasons.

There were some based on facts, lack of an adequate defense, being poor, being illiterate--any reason.

That is one reason not to have the death penalty except for Ted Bundy types.

But just keep them out of society forever.

The Supremes ruled, rightly, that capital punishment is a state issue. And, since the Supremes have already turned it back to the states, I don't much care what this woman thinks -- on capital punishment.

If Texas wants to execute people who throw a Lone Star can on the ground, then when you are in Texas, don't do that.

If Massachusetts wants to give a serial rapist/ murderer a luxury condo with cable TV and health care for life, then that's up to Massachusetts taxpayers.

Sotomayor is a racist. So how can she use racism as an excuse to oppose something?

Sotmayor's thoughts are predicated on how anything will affect La Raza, The Race. Other considerations are secondary as they should be. After all, we need diversity, and all sorts of different folks on the court. As I detailed elsewhere, Sotomayor meets numerous criteria for diversity including being disagreeable. After all, disagreeable people require representation too. And she can provide the virtue of ignorance to matters relating to complicated financial matters as her virtues include he fact that she wasn't exposed to such matters as a victimized person developing in a deprived environment.

So ignorance is a virtue. Nastiness is a virtue. We try to accommodate all members of society in every capacity. Sotomayor is a lightweight, the equivalent of a midget as a basketball player in the NBA. We need such participants to make for "diversity." Diversity is by decree, a virtue, and one that overrides all other considerations, but it particularly overrides fitness and competency.,
