Actually it was Thomas in his autobiography that blasted his own use of affirmative action saying it stigmatized his achievement and prevented him from getting a job. It wasn't his (contrary to Sotomayor) less than stellar achievement. It wasn't racism. It wasn't the firms he applied. No, according to Thomas it was that nasty stigma of AA.

If the United States had not had a negative action policy for so long it wouldn't have needed an affirmative action policy. What I heard in her statement was "Promote me, I deserve it, I'm Latina. Then again, she's had a large portion of the cases she's heard, overturned because of her ill-conceived interpretations of the constitution and our laws. It has been reported that she used almost the same line back in '94. Let's be honest, she has said this racist statement on two occasions. Don't expect me to buy that she chose bad words. That only works if she said it one time but multiple times? That's almost like your trying to pee on my shoes and convince me it's raining. It fails common sense.

Let me make it clear for everyone. The supreme court nominations should be reserved for justices who know the law not the ones that continually have their decisions overturned. If your a football fan, the supreme court is the superbowl of the legal system. It should be reserved for those who are so good that their decisions aren't overturned.

I don't think they looked at her record closely before this because she wasn't trying to get a position on the final say so in the judicial system. There are no further appeals than the highest court in the land. There are also no do overs when she makes a bad decision.

First, I'm curious as to when Sotomayor ceased being a Puerto Rican nationalist who favors independence -- as she says she does in the preface. (The position, as she points out in the thesis, had received 0.6 percent in a 1967 referendum, the most recent such vote before she wrote the thesis.) I don't know that I've seen it reported anywhere that she favored Puerto Rican independence, which has always been very much a fringe position....
Second, her unwillingness to call the Congress the U.S. Congress is bizarre -- in the thesis, it's always referred to as either the 'North American Congress' or the 'mainland Congress.' I guess by the language of her thesis, it should be said that she's seeking an appointment to the North American Supreme Court, subject to advice and consent of the North American Senate. This kind of rhetoric was very trendy, and not uncommon, among the Latin Americanist fringe of the academy.

Actually, the panel she was a part of ruled that there is already a Supreme Court precedent (Brown v. Walker) in which they said the 2nd Amendment applies only to limitations the FEDERAL government seeks to impose on this right, rather than to limitations imposed by a state or local government.

Since that case, the SC has never ruled definitively on whether the 2nd Amendment applies to ALL governmental entities, vs. only Federal entities. So the ruling was that, until they do, existing SC decisions must still apply.

Ok, but the point being of that post was in following up to LWalks comment that he believed that they have not looked at her record.

She will rule in favor of liberal causes, and that's what counts.She will rule for expansion of government power if exercised by leftist authoritarian government proponents. She will, rule to give judgments requested to favor so-called minorities, black, ethnic, women, regardless of precedent, being motivated by empathy for those with whom she identifies. She will vote for privilege and not putting any burden on illegal aliens, benefits, voting rights, border access.

Well, why enumerate all of these minutiae. Suffice it to say, she will do it blatantly and unashamedly because it is retribution time, and she deserves to be in a position to exact retribution because this is a democracy, and the people democratically selected a man, whom they put in power, with the ability to make such appointments.

Appointing Sotomayer to the position where she can impose her discriminatory beliefs is what we have in this democracy. It is the will of the people, who put the man with the power to appoint her in office as well as a compliant Senate. So don't complain unless you are undemocratic.

Look at Sotomayer's sterling qualifications.

1. She was raised by a single mother. That's qualifying for many things, maybe even mixing formulas in a chemistry lab, or being a phlebotomist?. Huh? Well, qualifying for Supreme Court appointment anyway.

2. She was poor. Well, that's not "really" true. She and her one sister were raised by a mother who was a Registered Nurse, so their income level was above the norm. But what the heck, maintain the fiction.

3. She was raised in a housing project. What were their income requirements? Did they qualify for low-rent housing, or did her mother "misreport" her income to qualify? Why with her income, did the mother choose to live in a housing project?

4. She was raised in a Puerto Rican community in the Bronx. Well, this seems sort of "racist," or to be some sort of "ethnic slur" that being raised among Puerto Ricans is so noxious and oppressive that it's a debility to be overcome. Shameful proposition.

These are the specious "qualifications" (whether or not they are true) presented as meriting appointment to the Supreme Court. Raised by a single mother. Poor. Lived in a housing project. Raised among Puerto Ricans. And is a woman and a Puerto Rican .

Sotomayer herself presents her insights as arising from the fact that she is a "Latina woman" as providing her with special skills.

Shortcomings notwithstanding, we live in a democracy, and the people have chosen through their elected representatives to make this candidate a sitting Justice of the Supreme Court of the United States. Elections count.

So, as some lowlifes say about being raped, that the victim was responsible because she lured the rapist on with her feminine pulchritude and that she should relax and enjoy it, here some of you feel that you are being "raped" with the appointment of a disagreeable incompetent racist ideologue like Sotomayer. So, I provide similar counsel. You folks elected Barry, who nominated her, and the Senate that will confirm her, so lean back and enjoy it. This will probably be a long term screwing depending how unstable the government and our system is, of course. Will there be a time when some who support her appointment might recognize that her rulings are not providing them with an ecstatic experience?
