A slight change of pace in that this was an American on American killing but at the end of the day dead is dead.

Condolences to the family members affected by this violence.

Very little information is being released here. No names of victims, no name of the killer. No motive, very few details and even a denial of an earlier report that the perpetrator had been killed in the act.

Should this fellow, if found guilty, be sentenced to death by lethal injection as Sgt. Akbar currently is?

Akbars case is kinda interesting. He was the only black and muslim member of his platoon in Kuwait and as such he recieved a lot of abuse at the hands of his fellow soldiers. Finally, one night, he snaps, turns off the generator that lights the camp up, steals some grenades and then proceeds to toss a couple into the tents of senior officers who had recently reprimanded him for insubordination. After the grenades went off he just started shooting wildly at all comers by all accounts.

2 dead. 14 wounded.

If you read his diary found after the fact you can easily seee this once bright buy was more than half crazy even before the insubordination charge and subsequent madness.

Spud reckons this latest case involves PTSD plus additional factors we have yet to determine.

Keeping an eye out on this one.

The 1999 statute you referred to (9.43) did NOT give Horn the right. "Nighttime", etc.

Also, the audio from the complete 911 call indicates there were uniformed officers outside Horn's house. So, it looks like the Pasadena police didn't do so well either in either catching the burglars OR telling Horn to drop his weapon and prevent his taking the law into his own hands. No wonder this didn't go to trial. There'd have been egg on everyone's face but the dispatcher.
