A two-decade-old Texas law that grants authorities the power to seize property used in a crime is wielded by some agencies against people who are never charged with, much less convicted, of a crime. One town of 1,100 on the Texas/Louisiana border, Tehana, seized property from 140 motorists over three years and has filed criminal charges against fewer than half.

Tenaha Mayor George Bowers, 80, defended the seizures, saying they allowed a cash-poor city the means to add a second police car in a two-policeman town and help pay for a new police station. "It's always helpful to have any kind of income to expand your police force," Bowers said.

Local police, he said, must take aggressive action to stem the drug trade that flows through town via U.S. 59. "No doubt about it. (Highway 59) is a thoroughfare that a lot of no-good people travel on. They take the drugs and sell it and take the money and go right back into Mexico," said Bowers, who has been Tenaha's mayor for 54 years.


Sounds like a right friendly little place.

So you can hire more officers to shake down passersby to get more money to hire more officers to shake down more passersby.

On a more serious note, this happens quite frequently to people guilty of no crimes at all, and I don't know how it can be stopped. They know that there's no evidence that a motorist or someone else could use to challenge the theft, and they know that their word as a cop carries more weight than joe off of the street. Some people have no morals, and they abuse the authority of their positions. I encountered one such person once, and I filed a police report that I'm sure went straight to the bottom of a fat stack of complaints which never get a second look.

The majority of cops don't have to be crooked, though. All it takes is one dude on the force in any town to create this problem. And then people distrust or disparage the police as a whole. If only ordinary cops were more aware of the backlash created by their corrupt colleagues...

And it's not just in Texas this happens either. My husband was going to school in Boston and he had his truck there, with his Texas plates still on them.. Well he got stopped by a police officer in Somerville (I can't remember if he was speeding or not). The police officer did all the normal stuff, asking for license and registration. Well I can't remember what happened to provoke this, but the Police officer proceeded to try and arrest him, without cause. My husband doesn't do drugs so there was no paraphanelia and he doesn't own a gun so it wasn't that either. He was then handcuffed and put in the back of the police vehicle while the officer was trying to get him to allow him (the officer) to search the vehicle... Well, my husband knows the law and would not give him permission and kept demanding that he speak with the officer's supervisor... He eventually was released and submitted a complaint against the officer and got a suspension... but I think that if my husband didn't know the law as well as he does then he would have been in real trouble...

And it's not just in Texas this happens either.

At least in Massachusetts, they let him keep his truck.

Back in the good old days, when the war on drugs was a baby, if you had long hair the cops in East Texas would pull you over and break out a taillight with a nightstick so they could search your car.

If they came up empty they would haul you in front of a judge for a good old-fashioned wallet vacuuming just on general principles.

I know, it happened to me.

Sounds like they may have stepped up their game a bit since then.

don't phuck with Tenaha TX -- what a shithole excuse for a town. I got pulled over there last year on my way to a business meeting in Shreveport slowing from a 45 mph to a 35 mph. the cop that pulled me over was wearing blue jeans. we had an interesting conversation.

Next time I'm going to Shreveport via Omaha.

i've lived in texas most of my life. while ill defend this state against most criticism; east texas is on its own. wanna see one of the most backwoods, segregated, racist places in the u.s. (it cuts both ways there too)? go there. any small town will do. I've never been to louisiana though. I can't imagine it being any better.

anyone put this together yet? the 80 year old mayor has held that position since he was 26! talk about entrenched. I'm pretty sure that even beats robert byrd's & thurmond's records!

As an East Texan, I can attest that many of the small-town cops are crooked. Tenaha is already well known here. There are many other cities known for "creative financing." One such small burg (less than 1000 people) near Corsicana is a major speed trap. Motorists who get speeding tickets and do the traffic school thing have a strict deadline to turn in paper work, with $560 fines for being even one day late. Rockwall is infamous for stopping anyone, everyone. It is a fast-growing city in a very small county; traffic fines account for a major portion of revenue. Tyler is well-known for maximum sentences, even for first time offenders. Far southeast Texas? As crooked as any Louisiana swampwater village. Everyone should also check out the history of New Rome, OH for an example of extremely-small-town abuses of power.

I believe in fate.

First of all. I think the guy should sue and he WILL win. Thank God they put video cameras in the cop cars. The guy did exactly what he was supposed to do.

This is why I believe in fate. Moronic cops like this woman will eventually either be taken off the street and put in a desk job or fired. She should not be allowed to have a gun after this incident. Stupid bitch! My sister and brother-in-law were arrested in New Orleans during Mardi Gras. Both of them are you regular peaceful pacifists who only questioned the cops what they might be doing wrong. They were beaten. Long story, short, The bad cop in the group eventually was forced to "retire", started selling drugs and disappeared. Probably in pieces in the Gulf of Mexico.

What goes around does eventually come around.
