The judges in Minnesota's Senate election trial threw Republican Norm Coleman a lifeline on Tuesday, opening the door to adding nearly 5,000 rejected absentee ballots to a race that Democrat Al Franken leads by just 225 votes.

FiveThirtyEight believes this won't be enough to save Coleman.

Whether its enough or not, can either of them legitimately claim to be the winner of the election at this point or even after the recount? I get that its the rules and this is how its going to happen, it just seems like the better option would be for their state legislature to pass a special election for the two of them. call this thing a flat out tie and everyone come back out again in 1 month to vote for a Senator.

I agree with the idea of holding special elections when a recount results in a race so close that it's deeply within the margin of error. No one who ever loses a recount battle in the courts will believe their guy lost fairly.

But doing so for this race would be wrong. The special election rule should be in place before the original vote.

Can't Minnesota stick with ice harvesting and leave grown up work to the grown ups?

GD you must be joking having a special election to resolve the current fiasco would make way too much sense especially in a democracy. No I think it is much better to let the courts kick this around for a while who knows after a few weeks they might be able to find their own butts with both hands...

No matter what happens in this race, the winner is not going to be seen as legit. Its too close, there are too many questions, too many court cases, and its dragged on for far too long.

I just think the best way to have a true winner is for them to do the whole thing over, with just these two on the ballot, nothing else. Winner take all, and it would actually be a legit winner.

Or we could take Statehood away from Minnisota until they learn how to run a fucking election.

UNLESS it does keep the clown from the senate floor.

Obama is still looking for a few good men who actually pay taxes so if this clown can fill out the long form he may just be offered a cabinet position...

Hopefully Coleman's lawsuit also points out the fact that the elections board rejected ballots for Coleman with an "X" over the circle but accepted ballots for Franken with the same marking. With the amount of "oops, a few more votes here" that all went to Franken after the election, my guess is that Coleman will win this lawsuit.

have you read some of the stats that shows how many billions of that deficit are due to paying billions for illegals in that state.
one way to solve thier money problems.
get rid of some of those.

Whole issue would have been resolved if Norm Coleman had been man enough to live up to his words about settling this out of court.

Consider the absentee ballots flagged by Coleman for being "wrongly rejected" that were actually considered by the counties earlier this month. Of about 150 absentee ballots that, having already been rejected twice by the counties (once on Election Night and then again pursuant to a court order), were triple-checked by the counties for potentially being wrongly rejected, only 1 was determined by county officials to be a valid ballot. At that rate of success, Coleman's 4,800 ballots would turn into a grand total of ... 32 that are actually deemed to have been rejected improperly. And those ballots were reviewed at a stage when the Coleman campaign wanted only about 650 ballots to be considered.

you are correct. Franken should admit they were attempting to steal the election and withdraw. Then the investigation should begin as to why some precincts reported more votes than are registered voters. And each of these precints just happened to be pro Franken.

I would like to see Franken in the Senate though....

3-round boxing match. to be judged by 1 republican, 1 democrat, and 1 independent. hitting below the belt o.k. it'd be quick, easy, and wildly entertaining. it could be broadcast on pay-per-view, with 1/2 of the profits going to pay for the stimulus package. plus, both submit to tax audits for an additional kicker for the package.

No offense, folks, but if you had bothered to follow this court case closely, you would have witnessed thoughtful public official taking their jobs very seriously. You would understand why number don't always match, and why there should be admiration for the state of Minnesota (but up pox on the Vikings and the Twins).

What do you say to following the laws of the state? There is no provision for such an event, so let's let them follow their laws.

There were too many irregularities with the recount so now the matter is contested.

The courts want 4800 more ballots counted. So get counting.

Essentially, those ballots will be presumed to be guilty until proven innocent, and will have to be advocated for one at a time by the Coleman campaign, rather than being opened summarily and counted in bulk. This will make Coleman's rate of success very, very, very low, as opposed to merely very, very low. As Talking Points Memo notes, however, this process could take a very long time to complete and could continue to the delay the seating of a Senator Franken -- which may be Coleman's principal objective in the first place.

The FBI is reportedly investigating allegations that a Minnesota businessman tried to funnel $75,000 in campaign contributions to Sen. Norm Coleman through the senator's wife, Laurie, at the same time Coleman was going into debt because of extensive home renovations.

According to a report from MyFOXTwinCities.com, two lawsuits allege that in the spring of 2007, Nasser Kazeminy began making $25,000 payments from Deep Marine Technology, a Texas company he controls, to Laurie Coleman's employer, insurer Hayes Companies Inc. of Minneapolis.

One of the lawsuits alleges that in March 2007, Kazeminy said that "U.S. senators don't make s---," and he would try to get money to the senator, MyFOXTwinCities.com said.

In 2006, the Colemans began renovations on their St. Paul home, adding a second-floor master bedroom, remodeling the kitchen, painting, refinishing floors and landscaping. Coleman's campaign told MyFOXTwinCities.com that the 2006 renovation project was budgeted at $328,000, but within four months the cost estimates hit $414,000 -- over-budget by $86,000.

Government ethics professor David Schultz told MyFOXTwinCities.com that the timing of the alleged donations from Kazeminy and the Colemans' burgeoning debt raise questions about the senator's credibility.

"On the one level it could just be a coincidence, on the other level this could be one of the reasons he's getting that money from elsewhere, to try to make up for his, to be able to pay off a loan, pay off a line of credit," says Schultz.

Coleman, not a party to the lawsuits, has denied any wrongdoing.

He and Democratic challenger Al Franken are still waiting out a lengthy recount to determine the winner of the state's Senate election on Nov. 4.

I have no idea who won this, and I don't think anyone else does.. and that's a terrible situation. The named winner is never going to convince the losing side that he won fairly.
