Would have been no big deal but both the cop and the old man were hot headed bastards.

I love it!
Everything is always the fault of the cop! When they do something good, they're STILL evil bastards. Apparently it's not okay to threaten to shoot someone; thus BREAKING THE LAW, unless they're a cop? Then if it's done and you get jail time for it, it's the cop's fault?
You people are priceless.
Actually, you're worthless. Really, people like you are why only people who really shouldn't BE cops will want to become cops anymore. When police get nothing but 24/7 accusations of "abusing their power", then eventually you'll have nothing BUT people who abuse power.
Seriously, get some fucking perspective. Guy who executes someone who was laying facedown in a train station? That's an example of a BAD police action. Guy who takes down a line-cutter who threatened to kill him, and doesn't even try to arrest him personally when off-duty? That's an example of a GOOD police action.
Oh, and Manypaths: It's against the law to instigate a fight with _anyone_, unless they perform "Fighting Words" actions. Mind you if the other party participates in the fight, then they are in the wrong as well. This officer played it smart, he asked "And what would we do outside?" clarifying the intention first. The officer did not get in a fight at all. There's a big difference between "fighting" someone, and "threatening" someone. Trying to run _anyone_ over with your car just because they're in your way is a horribly illegal action no matter WHO you are running over.
In the REAL world, people who go on long enough to actually get pulled apart by the cops _both_ get charged with disturbing the peace, and BOTH have the option to charge the other with assault (they'd be stupid to do so, however).
There is no "who started it" and "self defense" doesn't mean what most people seem to think it does.
