Interesting. I'm wondering what the divorce laws are as far as any other gift you gave during marriage that you decide you want back. Seems to me that if she didn't sign anything saying she would give it back if she left, he's shit out of luck, but I'm no divorce expert.

Legally the husband cannot get his kidney back nor demand $1.5 from his ex-wife in their divorce settlement if she doesn't return it. Because the husband's kidney donation is legally considered a "gift" from him to her it's not required to be returned nor is it part of the community property of the husband and wife.

Although she was rotten to cheat on him once she got her health back. But in a court of law, that doesn't matter. A gift does not have to be returned.

That's what I was thinking. He should have had her sign something. I also wonder how successful any re-transplant operations tend to be, and where he got the $1.5M figure from, since you can't sell your organs legally in the US.

You're right. I don't believe NY is a community property state. But then, even if it was, what good would it do (for either of them) for the husband to get only 50% of his old kidney back? Nothing. I'm sure he was figuring more on her shelling out the $1.5 and keeping 100% of the kidney although he won't get either one in his divorce settlement.

This guy doesn't want the kidney back. No court on earth would side with Dr. Batista, but I do believe he wants justice and the best way to do that is financially. I do believe in bad Karma and this adulterous women will get it back in spades. It's unfortuanate that this man has resorted to this, but if it makes him feel better, than good for him. that was my first thought: he says he didn't want publicity, and that's probably a half truth. he'll get marriage proposals and letters of support and attack from all over the world, and many, many people will know now just how much of a bitch his wife is. that would make me feel better, if it were me betrayed this way. his hurt is now public, and her infidelity now a spectacle.

I put my ex-wife through college, paid for everything and she never had to work. I struggled with full-time work and night school. But I did it. I found out during the end of her last year she started cheating on me. How did I know? I broke into her email and caught her red handed.
