Here's what Reid's letter, signed by all senate democrats, said regarding an appointment by Blagojevich:

Please understand that should you decide to ignore the request of the Senate Democratic Caucus and make an appointment we would be forced to exercise our Constitutional authority under Article I, Section 5, to determine whether such a person should be seated.

Note the amount of wiggle room - they don't say they would use their Constitutional power to reject the appointment, only that they'd use it to "determine whether the person should be seated." In other words, they will make a deal out of it and seat the person anyways, probably with the excuse that Burris wasn't mentioned in Fitzgerald's complaint.

Article 1, Section 5 is the authority the Senate claims in this. There is also precedent for denying a seat. I don't think the Senate has ever been challenged over this authority, although the House has (Adam Clayton Powell).

I would assume that is for the person selected. Not the person who selects. Now if there was obvious collusion between the two, I could understand. He is still the sitting Governor and has every right to pick Obamas replacement.

Not defending anyone, but he has been accused of impropriety not charged with any crime or has he been impeached. Morally I agree and he should step down. On the other hand if all they have is his telling Obama to fuck himself, that is not a crime. I would tell Obama and his entire staff the same thing if I had the chance.

No. But he should resign prior to the years of litigation it will require for that clearing to occur. The criminal complaint alone contains quotes from his conversations that give an overwhelming sense of impropriety and criminal conduct. Reading the details in the complaint is mind-blowing, and Illinois deserves better.

If he can beat the Feds and the wiretap evidence, he wins B.O.'s Messiah crown.

What is your definition of "charges?" My understanding is that when a criminal complaint is filed, you have at that point been charged with a crime.

My understanding is that the senate does not have the power to not seat the appointee unless it is a question of age or citizenship.

so, the cops can arrest people without a charge? you sure? because the cops can't even detain you unless they believe a crime is about to be committed, thus there is a charge.

you can be "charged", arrested, and it can be dropped without further action... no hearing, no indictment, done. but there is (or was) a charge, false or not.

I don't know. It will be interesting, to say the least. Obama has already said the guy shouldn't be seated, so Reid does have the green light on this.
